122:12-2-06. Targeted energy efficiency and weatherization program

(A) To the extent practicable and to ensure efficient and cost effective program administration, the office of energy efficiency shall consolidate the administration and coordinate the design of the operations of the home weatherization assistance program with the targeted energy efficiency and weatherization programs that are to be undertaken by the fund. These programs shall be coordinated with other low-income customer energy efficiency programs, including but not limited to low-income housing rehabilitation and home repair programs.

(B) To the extent practicable, the office of energy efficiency shall target high-cost, high-volume use structures occupied by customers eligible for the percentage of income payment plan program, with the goal of reducing the energy bills of the occupants residing in the targeted structures in a cost-effective manner. In determining whether targeting is practicable the following factors may be used:

(1) The extent to which an adequate delivery infrastructure is available to serve the targeted structures within a given region;

(2) The extent to which additional training is necessary to deliver the services; and

(3) The net present value of savings to the fund. Any energy efficiency measure yielding a savings to investment ratio of greater than one shall constitute a cost-effective measure.

(C) Customers participating in the percentage of income payment plan program must accept services provided through the targeted energy efficiency and weatherization program.

(D) Owners of rental housing inhabited by a tenant eligible for the percentage of income payment plan program shall, as a pre-condition to the provision of energy efficiency and weatherization services, provide to those units:

(1) Protection from rent increases attributable to energy efficiency and weatherization services provided through the fund, and

(2) Funding contributions to the energy efficiency and weatherization services provided on their units in instances where enhancement of the value of those units would result from the work being done, except where the owner is also eligible for participation in the percentage of income payment plan program.

(E) Funding contributions from electric distribution utilities, energy services companies, municipal electric utilities, electric cooperative utilities or other parties may be used for funding targeted energy efficiency programs as defined in section 4928.55 of the Revised Code.

(F) Authorized providers of weatherization or energy efficiency services. Authorized providers of weatherization or energy efficiency services shall:

(1) Be able to provide services comparably and in accordance with the sections, of the weatherization program standards, as amended, relevant to the services provided which are paid for by the fund;

(2) Employ electronic data collection methods for the reporting of service data, cost data, and customer eligibility data, and report all such data to the director;

(3) Provide for the proper verification of service delivery; and

(4) Cooperate fully in an evaluation of their services through an objective third party review, which may include an on-site evaluation, the collection and analysis of pre and post energy usage, and an analysis of bill payment behavior.

(G) The director shall analyze all of this information in a full evaluation and analysis of direct and related energy efficiency and weatherization program services to determine if the efforts are reducing energy consumption and ratepayer costs for the percentage of income payment plan program.
