3301-73-01. Applicability of rules

If any provision of the rules in Chapter 3301-73 of the Administrative Code is held invalid or if the application of any provision of the rules in Chapter 3301-73 of the Administrative Code to any person or circumstance is held invalid, the invalidity does not affect any other provision of the rules in this chapter, or the application of any other provision of the rules in Chapter 3301-73 of the Administrative Code, that can be given effect without the invalid provision or application, and, to this end, the provisions of the rules in this chapter are hereby declared severable. The promulgation of the rules in this chapter shall not limit the state board's or superintendent's authority to establish policies and procedures to carry out the duties assigned under Title XXXIII of the Revised Code, rule 3301-20-01 of the Administrative Code, and Chapter 3301-73 of the Administrative Code.
