3769-12-17. Must furnish records

(A) Every permit holder shall, upon demand in writing by the commission, furnish the commission a full and complete statement of receipts, expenditures, attendance and such other information as the commission shall require, with respect to any meeting, or with respect to any accounting period specified by the commission.
(B) Every commercial permit holder which does not own the real property at the place where a race meeting is to be conducted, at the time the application is filed for a permit, shall file a copy of the current lease with the commission unless there is one on file with the commission.
(C) The owner of the real estate shall, at the time the application for a racing permit is filed by its lessee, provide the following to the commission:
(1) A current financial statement showing assets and liabilities;
(2) Its latest operating statement showing its income and expenses relating to the real estate;
(3) A list containing the names and addresses, and occupations of all officers, directors, owners, shareholders, or partners. In case of a corporation whose stock is publicly traded, this information need only be supplied as to all officers and directors, and those stockholders owning or controlling ten per cent or more of the stock of the corporation;
(4) Any other pertinent information requested by the commission. If any other corporation or partnership owns ten per cent or more of the stock of the corporate owner of the real estate, such corporation or partnership shall be required to file the same information.
