  • (A) Title and term. Ohio lottery commission game number thirty-nine, "Sweetheart Cash," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which agents are to make their final settlement with respect to tickets allocated to them during the period in game number thirty-nine.

    (B) General design.

    (1) Game number thirty-nine shall contain two play areas described on the ticket as "game one" and "game two." In "game one," the player must match any one or more of "your numbers" to the "sweetheart number(s)" to win the prize amount shown below your matched number(s). A "heart" symbol revealed in the play area of "game one" automatically entitles the player to the prize value shown beneath that symbol. In "game two," the player must match three like prize amounts or two like prize amounts and a "rose" symbol to win the matched prize amount. A player may win up to four times on one ticket.

    (2) As used in this rule, "prize award" shall mean a free ticket of comparable price or one of the following monetary figures which is the total of all winning prize values appearing on the ticket: Two dollars, four dollars, seven dollars, fourteen dollars, twenty-four dollars, fifty dollars, one hundred dollars, one hundred fourteen dollars, two hundred fourteen dollars and five hundred dollars. Each ticket in game number thirty-nine shall be imprinted in such a way that prize awards from the set listed above may be won.

    (C) Price of tickets. The price of a ticket issued by the commission in game number thirty-nine shall be one dollar.

    (D) Structure, nature and value of prize awards.

    (1) There shall be one type of prize in game number thirty-nine called a "regular prize award."

    (2) The only "prize values" which shall appear on a ticket in game number thirty-nine are: Free "ticket," one dollar, two dollars, four dollars, seven dollars, ten dollars, fourteen dollars, fifty dollars, one hundred dollars, two hundred fourteen dollars and five hundred dollars. Prize values appearing on any ticket in game number thirty-nine shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying prize values.

    (a) Holder of a valid winning ticket on which one of "your numbers" matches a "sweetheart number" or a "heart" symbol is revealed in "game one" for a free "ticket" shall win a regular prize award of a free ticket of comparable price;

    (b) Holder of a valid winning ticket revealing three matching "ticket" symbols or two matching "ticket" symbols plus a "rose" symbol in "game two" shall win a regular prize award of a free ticket of comparable price;

    (c) Holder of a valid winning ticket on which "your numbers" match the "sweetheart numbers" or a "heart" symbol is revealed to win one dollar two times in "game one" shall win a regular prize award of two dollars;

    (d) Holder of a valid winning ticket matching two dollars three times or two dollars two times and revealing a "rose" symbol in "game two" shall win a regular prize award of two dollars;

    (e) Holder of a valid winning ticket on which one of "your numbers" matches a "sweetheart number" or a "heart" symbol is revealed to win two dollars once in "game one" shall win a regular prize award of two dollars;

    (f) Holder of a valid winning ticket on which "your numbers" match the "sweetheart numbers" or a "heart" symbol is revealed to win one dollar two times in "game one," and matching two dollars three times or two dollars two times and revealing a "rose" symbol to win two dollars in "game two" shall win a regular prize award of four dollars;

    (g) Holder of a valid winning ticket on which one of "your numbers" matches a "sweetheart number" or a "heart" symbol is revealed to win four dollars once in "game one" shall win a regular prize award of four dollars;

    (h) Holder of a valid winning ticket matching four dollars three times or four dollars two times and revealing a "rose" symbol in "game two" shall win a regular prize award of four dollars;

    (i) Holder of a valid winning ticket on which one of "your numbers" matches a "sweetheart number" or a "heart" symbol is revealed to win seven dollars once in "game one" shall win a regular prize award of seven dollars;

    (j) Holder of a valid winning ticket matching seven dollars three times or seven dollars two times and revealing a "rose" symbol in "game two" shall win a regular prize award of seven dollars;

    (k) Holder of a valid winning ticket on which "your numbers" match the "sweetheart numbers" or a "heart" symbol is revealed to win two dollars three times in "game one," and matching one dollar three times or one dollar two times and revealing a "rose" symbol to win one dollar in "game two" shall win a regular prize award of seven dollars;

    (l) Holder of a valid winning ticket on which one of "your numbers" matches a "sweetheart number" or a "heart" symbol is revealed to win fourteen dollars once in "game one" shall win a regular prize award of fourteen dollars;

    (m) Holder of a valid winning ticket matching fourteen dollars three times or fourteen dollars two times and revealing a "rose" symbol in "game two" shall win a regular prize award of fourteen dollars;

    (n) Holder of a valid winning ticket on which "your numbers" match the "sweetheart numbers" or a "heart" symbol is revealed to win four dollars two times and two dollars once in "game one," and matching four dollars three times or four dollars two times and revealing a "rose" symbol to win four dollars in "game two" shall win a regular prize award of fourteen dollars;

    (o) Holder of a valid winning ticket on which "your numbers" match the "sweetheart numbers" or a "heart" symbol is revealed to win seven dollars once, two dollars once and one dollar once in "game one," and matching fourteen dollars three times or fourteen dollars two times and revealing a "rose" symbol to win fourteen dollars in "game two" shall win a regular prize award of twenty-four dollars;

    (p) Holder of a valid winning ticket on which "your numbers" match the "sweetheart numbers" or a "heart" symbol is revealed to win fourteen dollars once, two dollars once and one dollar once in "game one," and matching seven dollars three times or seven dollars two times and revealing a "rose" symbol to win seven dollars in "game two" shall win a regular prize award of twenty-four dollars;

    (q) Holder of a valid winning ticket on which one of "your numbers" matches a "sweetheart number" or a "heart" symbol is revealed to win fifty dollars once in "game one" shall win a regular prize award of fifty dollars;

    (r) Holder of a valid winning ticket matching fifty dollars three times or fifty dollars two times and revealing a "rose" symbol to win fifty dollars in "game two" shall win a regular prize award of fifty dollars;

    (s) Holder of a valid winning ticket on which one of "your numbers" matches a "sweetheart number" or a "heart" symbol is revealed to win one hundred dollars once in "game one" shall win a regular prize award of one hundred dollars;

    (t) Holder of a valid winning ticket matching one hundred dollars three times or one hundred dollars two times and revealing a "rose" symbol to win one hundred dollars in "game two" shall win a regular prize award of one hundred dollars;

    (u) Holder of a valid winning ticket on which one of "your numbers" matches a "sweetheart number" or a "heart" symbol is revealed to win fourteen dollars once in "game one," and matching one hundred dollars three times or one hundred dollars two times and revealing a "rose" symbol to win one hundred dollars in "game two" shall win a regular prize award of one hundred fourteen dollars;

    (v) Holder of a valid winning ticket on which "your numbers" match the "sweetheart numbers" or a "heart" symbol is revealed to win fifty dollars two times in "game one," and matching fourteen dollars three times or fourteen dollars two times and revealing a "rose" symbol to win fourteen dollars in "game two" shall win a regular prize award of one hundred fourteen dollars;

    (w) Holder of a valid winning ticket on which "your numbers" match the "sweetheart numbers" or a "heart" symbol is revealed to win ten dollars once and two dollars two times in "game one," and matching one hundred dollars three times or one hundred dollars two times and revealing a "rose" symbol to win one hundred dollars in "game two" shall win a regular prize award of one hundred fourteen dollars;

    (x) Holder of a valid winning ticket on which one of "your numbers" matches a "sweetheart number" or a "heart" symbol is revealed to win two hundred fourteen dollars once in "game one" shall win a regular prize award of two hundred fourteen dollars;

    (y) Holder of a valid winning ticket matching two hundred fourteen dollars three times or two hundred fourteen dollars two times and revealing a "rose" symbol to win two hundred fourteen dollars in "game two" shall win a regular prize award of two hundred fourteen dollars;

    (z) Holder of a valid winning ticket on which "your numbers" match the "sweetheart numbers" or a "heart" symbol is revealed to win one hundred dollars two times in "game one," and matching fourteen dollars three times or fourteen dollars two times and revealing a "rose" symbol to win fourteen dollars in "game two" shall win a regular prize award of two hundred fourteen dollars;

    (aa) Holder of a valid winning ticket on which one of "your numbers" matches a "sweetheart number" or a "heart" symbol is revealed to win five hundred dollars once in "game one" shall win a regular prize award of five hundred dollars; and

    (bb) Holder of a valid winning ticket matching five hundred dollars three times or five hundred dollars two times and revealing a "rose" symbol in "game two" shall win a regular prize award of five hundred dollars.

    (E) Number of prize awards. The number of prize awards in any sales cycle of game number thirty-nine will depend upon the number of tickets sold during that cycle. Tickets shall be printed in accordance with this rule using random techniques in order that:

    (1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance;

    (2) Mathematical reasoning indicates that the number of winning tickets sold per ten million tickets sold in the following categories will be as follows:

    (a) Five tickets winning five hundred dollars in "game two" to win five hundred dollars; and

    (b) Five tickets winning five hundred dollars once in "game one" to win five hundred dollars.

    (3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per five hundred thousand tickets sold will be as follows:

    (a) One ticket winning one hundred dollars two times in "game one" and fourteen dollars in "game two" to win two hundred fourteen dollars;

    (b) One ticket winning two hundred fourteen dollars in "game two" to win two hundred fourteen dollars;

    (c) One ticket winning two hundred fourteen dollars once in "game one" to win two hundred fourteen dollars;

    (d) Eight tickets winning ten dollars once and two dollars two times in "game one" and one hundred dollars in "game two" to win one hundred fourteen dollars;

    (e) Eight tickets winning fifty dollars two times in "game one" and fourteen dollars in "game two" to win one hundred fourteen dollars;

    (f) Eight tickets winning fourteen dollars once in "game one" and one hundred dollars in "game two" to win one hundred fourteen dollars;

    (g) Ten tickets winning one hundred dollars in "game two" to win one hundred dollars;

    (h) Ten tickets winning one hundred dollars once in "game one" to win one hundred dollars;

    (i) Forty tickets winning fifty dollars in "game two" to win fifty dollars;

    (j) Forty tickets winning fifty dollars once in "game one" to win fifty dollars;

    (k) One thousand four hundred tickets winning fourteen dollars once, two dollars once and one dollar once in "game one" and seven dollars in "game two" to win twenty-four dollars;

    (l) One thousand four hundred eighteen tickets winning seven dollars once, two dollars once and one dollar once in "game one" and fourteen dollars in "game two" to win twenty-four dollars;

    (m) One thousand tickets winning four dollars two times and two dollars once in "game one" and four dollars in "game two" to win fourteen dollars;

    (n) One thousand five hundred tickets winning fourteen dollars in "game two" to win fourteen dollars;

    (o) One thousand five hundred tickets winning fourteen dollars once in "game one" to win fourteen dollars;

    (p) Two thousand tickets winning two dollars three times in "game one" and one dollar in "game two" to win seven dollars;

    (q) Two thousand five hundred tickets winning seven dollars in "game two" to win seven dollars;

    (r) One thousand five hundred tickets winning seven dollars once in "game one" to win seven dollars;

    (s) Three thousand five hundred tickets winning four dollars in "game two" to win four dollars;

    (t) Two thousand five hundred tickets winning four dollars once in "game one" to win four dollars;

    (u) Five thousand tickets winning one dollar two times in "game one" and two dollars in "game two" to win four dollars;

    (v) Eight thousand tickets winning two dollars once in "game one" to win two dollars;

    (w) Six thousand tickets winning two dollars in "game two" to win two dollars;

    (x) Six thousand tickets winning one dollar two times in "game one" to win two dollars;

    (y) Twenty-five thousand five hundred tickets matching three "ticket" symbols in "game two" to win a free ticket of comparable price; and

    (z) Twenty-seven thousand five hundred tickets winning a free "ticket" once in "game one" to win a free ticket of comparable price.

    (F) Frequency of prize drawings.

    (1) Random imprinting of prize awards on all tickets issued in game number thirty-nine shall be accomplished in a manner which complies with the commission's rules and procedures.

    (2) When a ticket issued in game number thirty-nine is sold or deemed sold in accordance with this rule and the covering material over any of the numbers has been removed, the holder shall be deemed to have drawn the numbers on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game number thirty-nine in which the ticket was sold.

    (G) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by agents of tickets winning prizes which are to be paid by agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

    (H) Validity of tickets.

    (1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game number thirty-nine void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

    (I) Director's conduct of game number thirty-nine.

    (1) The director shall conduct game number thirty-nine in a manner consistent with the Lottery Act, the rules of the commission, including without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game number thirty-nine.

    (2) Names and definitions of elements of game number thirty-nine used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game number thirty-nine and these elements may be given names or titles chosen by the commission.
