  • (A) Title and Term. Ohio Lottery Game Number Three ("Game No. 3") shall be conducted at such times and for such periods as the Commission may determine.

    (B) General Design.

    (1) Game No. 3 will be a number-match lottery game.

    (2) There will be three types of prize drawings to be called regular drawings, 1000 drawings, and millionaire drawings, respectively.

    (3) During each week of the game a regular drawing will be conducted at which one six-digit number; one five-digit number; one four-digit number and one three-digit number will be selected at random from the sets of all such numbers. Holders of valid tickets bearing any of the numbers drawn shall be entitled to a prize award in accordance with this Rule.

    (4) A drawing of numbers in another Commission game may serve as the regular drawing in this Game.

    (C) Price of Tickets. The price of a ticket issued by the Commission in Game No. 3 shall be $.50.

    (D) Structure and Size of Prize Disbursements.

    (1) The ticket shall bear three three-digit numbers in an area associated with a prize of $10; three three-digit numbers in an area associated with a prize of $20; one four-digit number in an area associated with a prize of $50; one four-digit number in an area associated with a prize of $100; one five-digit number in an area associated with a prize of $250; one five-digit number in an area associated with a prize of $500; three six-digit numbers in an area associated with eligibility to be awarded a prize in a 1000 drawing; and three six-digit numbers in an area associated with eligibility to be awarded a prize in a millionaire drawing.

    (2) Based upon the numbers drawn in a regular drawing, the prizes of $10, $20, $50, $100, $250 and $500 shall be awarded to the holder of a valid ticket for that drawing as follows:

    (a) a prize of $10 if the ticket bears the three-digit number drawn in the area associated with the $10 prize;

    (b) a prize of $20 if the ticket bears the three-digit number drawn in the area associated with the $20 prize;

    (c) a prize of $50 if the ticket bears the four-digit number drawn in the area associated with the $50 prize;

    (d) a prize of $100 if the ticket bears the four-digit number drawn in the area associated with the $100 prize;

    (e) a prize of $250 if the ticket bears the five-digit number drawn in the area associated with the $250 prize; and

    (f) a prize of $500 if the ticket bears the five-digit number drawn in the area associated with the $500 prize.

    (3) The holder of a valid ticket for a regular drawing bearing the six-digit number drawn in that drawing in the area associated with the 1000 drawings shall be eligible to receive a prize award in a 1000 drawing.

    (a) In each 1000 drawing, one prize of $1,000 per month until the winner's death, or until an aggregate amount of $400,000 has been paid, whichever occurs later, will be awarded. If the winner is other than an individual, this prize will be measured by the life of the oldest principal of the winner.

    (b) In each 1000 drawing, additional prizes in the amounts of $50,000; $40,000; $30,000; $25,000; $20,000; $15,000; $10,000; $7,500; $5,000; $4,000; $3,000; $2,000; and $1,000 may be awarded. Every ticket holder entitled to participate in a 1000 drawing shall win at least $1,000.

    (4) The holder of a valid ticket for a regular drawing bearing the six-digit number drawn in that drawing in the area associated with the millionaire drawings shall be eligible to receive a prize award in a millionaire drawing. In each millionaire drawing, one prize of $1,000,000 will be awarded, and additional prizes in the amounts of $100,000, $50,000, $10,000, $2,000 and $1,000 may be awarded. Each participant in a millionaire drawing shall win at least $1,000.

    (5) A mechanical error in printing the numbers on a ticket shall not invalidate that ticket. To the extent feasible, the Director shall establish procedures by which the holder of any ticket on which the numbers are incorrectly printed due to mechanical malfunction can be advised of the correct numbers for the ticket. If it is not technically feasible to recover the numbers from a mechanically misprinted ticket, and it is possible that the ticket was a winning ticket, the holder shall be entitled to a return of the ticket price or a free ticket for the next regular drawing in the Game, if any.

    (E) Number of Prize Disbursements.

    (1) The number of prize awards in any regular drawing will depend on the number of tickets actually sold for that drawing. Tickets shall be printed using random techniques in order that:

    (a) the possible numbers are randomly distributed throughout all the tickets printed in any given ticket issuance; and

    (b) mathematical reasoning indicates that, over a sufficiently large number of weeks, the average number of winning tickets in the regular drawings per one million tickets sold is as follows:

    (i) 3,000 tickets winning prizes of $10;

    (ii) 3,000 tickets winning prizes of $20;

    (iii) 100 tickets winning prizes of $50;

    (iv) 100 tickets winning prizes of $100;

    (v) 10 tickets winning prizes of $250;

    (vi) 10 tickets winning prizes of $500;

    (vii) 3 tickets winning eligibility for a 1000 drawing; and

    (viii) 3 tickets winning eligibility for a millionaire drawing.

    (2) In each 1000 drawing, one prize of $1,000 per month until the winner's death or payment of a minimum of $400,000, as described in paragraph 3770:1-7-03(D)(3), will be awarded. The number of prizes of each possible lesser amount will depend on the number of persons eligible for the particular drawing. The Commission shall determine the exact structure of lesser prizes for any given number of participants. The Commission may modify the prize structure from time to time during the conduct of Game No. 3, provided that the prize structure must comply with the requirements of this Rule and the Lottery Act.

    (3) In each millionaire drawing one prize of $1,000,000 will be awarded. The Commission shall determine the exact structure of lesser prizes for the millionaire drawing. The prize structure may be modified by the Commission during the conduct of the game, provided that the prize structure must comply with the requirements of this Rule and of the Lottery Act. The Director may limit the number of participants in any given millionaire drawing to 100.

    (F) Frequency of Prize Drawings. A regular drawing will be held each week on a day to be determined by the Director; a 1000 drawing will be held in every week, on a day to be determined by the Director, except the first week of the game; and a millionaire drawing will be held as soon as is practicable after each date on which 100 eligible holders are determined.

    (G) Manner of Prize Drawings.

    (1) Prize drawings shall be open to the public and, whenever possible, persons eligible to win prizes shall be encouraged to attend and participate. Drawings may be held at the Commission's headquarters, its regional offices or other places throughout the State as the Director determines. The Director shall inform the public as to the time and place of each prize drawing.

    (2) All holders of valid tickets for a given regular weekly drawing are eligible to win in that drawing. Prize winners shall claim their prizes won in regular drawings by surrendering their ticket in accordance with the procedures of these Rules.

    (3) At each 1000 and millionaire drawing, the participant who wins a given prize shall be selected at random from the set of all participants who have not yet been awarded a prize in the drawing.

    (4) For every drawing in Game No. 3, the Director will design mechanism for the selection of winners and the awarding of prizes in order that, insofar as is possible, random selection will be achieved.

    (H) Director's Conduct of Game No. 3.

    (1) The Director shall conduct Game No. 3 in a manner consistent with the Lottery Act, the Rules of the Commission, including without limitation, this Rule 3770:1-7-03, and the Regulations of the Director. As he deems it necessary or advisable, he shall adopt management regulations, orders or directives to implement and operate this lottery game.

    (2) Names and definitions of elements of Game No. 3 used in this Rule are to be considered generic terms used solely for the purpose of this Rule. In actual operation, Game No. 3 and these elements may be given names or titles chosen by the Commission.
