Chapter3770:1-7. Conduct of Specific Games |
3770:1-7-16. Ohio lottery commission game number sixteen
-
(A) Title and term. Ohio lottery commission game number sixteen shall be conducted at such times and for such periods as the commission may determine. For the purposes of this rule, "sales cycle" shall mean any such period beginning on the date when ticket sales are commenced, and continuing through the date on which such sales are terminated, by the commission.
(B) General design.
(1) Game number sixteen will be a number-match lottery game.
(2) A ticket in game number sixteen shall consist of two portions, one called the "main ticket" and the other called the "stub ticket." Neither portion of a ticket may be sold separately; however, once a ticket is sold or deemed sold in accordance with these rules, the main ticket and the stub ticket shall each have all the characteristics of a ticket as that term is defined for the purposes of these rules and the regulations of the director.
(3) There will be three types of drawings associated with the main ticket to be called regular drawings, millionaire finalist selection drawings, and millionaire prize drawings, respectively.
(4) There will be one type of drawing associated with the stub ticket to be called a regular stub drawing. During each week of the game a regular stub drawing will be conducted at which one five-digit number shall be selected at random from the set of all such numbers.
(5) During each week of the game a regular drawing will be conducted at which one one-digit number, one two-digit number, and one three-digit number shall be selected at random from the sets of all such numbers. Holders of valid tickets for a given regular drawing bearing any of the numbers drawn in that drawing shall be entitled to a prize award or eligibility for a millionaire finalist selection drawing in accordance with this rule.
(6) A drawing of numbers in another commission game may serve as the regular drawing in this game.
(C) Price of tickets. The price of a ticket issued by the commission in game number sixteen shall be fifty cents.
(D) Structure, nature and value of prize awards.
(1) The main ticket shall bear one one-digit number in an area designated the "first area"; one two-digit number in an area designated the "second area"; and one three-digit number in an area designated the "third area."
(2) Based upon the numbers drawn in each regular drawing, the prizes of five dollars, ten dollars, one hundred dollars, one thousand dollars, and ten thousand dollars shall be awarded to the holders of valid tickets for that drawing as follows:
(a) A prize of five dollars if the ticket bears the two-digit number drawn in the second area;
(b) A prize of twenty dollars if the ticket bears the three-digit number drawn in the third area;
(c) A prize of twenty dollars if the ticket bears the one-digit number drawn in the first area and the two-digit number drawn in the second area;
(d) A prize of five hundred dollars if the ticket bears the one-digit number drawn in the first area and the three-digit number drawn in the third area;
(e) A prize of two thousand dollars if the ticket bears the two-digit number drawn in the second area and the three-digit number drawn in the third area; and
(f) A prize of five thousand dollars if the ticket bears the one-digit number drawn in the first area, the two-digit number drawn in the second area, and the three-digit number drawn in the third area.
(3) Holders of valid tickets for a regular drawing which bear the one-digit number drawn in the first area, and who comply with all applicable provisions of this rule, shall be eligible to participate in a millionaire finalist selection drawing.
(4) In each millionaire finalist selection drawing, a number of millionaire finalists shall be selected in order that, as nearly as is practicable, two such finalists are selected for every one million tickets sold in the game. Participants in millionaire finalist selection drawings who are not selected as finalists shall not receive a prize award. In each millionaire prize drawing, one prize of one million dollars will be awarded, and additional prizes in the amounts of one hundred thousand dollars, fifty thousand dollars, ten thousand dollars, two thousand dollars, and one thousand dollars may be awarded. Each millionaire finalist in a millionaire prize drawing shall win at least one thousand dollars.
(5) The stub shall bear eight distinct five-digit numbers.
(6) Based upon the numbers drawn in each regular stub drawing, a prize of five hundred dollars shall be awarded to each holder of a valid stub ticket for that drawing which bears the five-digit number drawn.
(E) Number of prize awards.
(1) The number of prize awards in any regular drawing will depend on the number of tickets actually sold for that drawing. Tickets shall be printed using random techniques in order that:
(a) The possible numbers specified in this rule are randomly distributed throughout all the tickets printed in any given ticket issuance; and
(b) Mathematical reasoning indicates that, over a sufficiently large number of weeks, the average number of winning tickets in the regular drawings per one million tickets sold is as follows:
(i) Ninety-eight thousand eight hundred ninety-nine tickets winning eligibility for millionaire finalist selection drawings;
(ii) Eight thousand nine hundred eighty-nine tickets winning prizes of five dollars;
(iii) One thousand eight hundred eighty-eight tickets winning prizes of twenty dollars;
(iv) Ninety-nine tickets winning prizes of five hundred dollars;
(v) Nine tickets winning prizes of two thousand dollars; and
(vi) One ticket winning a prize of five thousand dollars.
(2) In each millionaire prize drawing one prize of one million dollars will be awarded. The commission shall determine the exact structure of lesser prizes for the millionaire prize drawings. The prize structure may be modified by the commission during the conduct of the game, provided that the prize structure must comply with the requirements of this rule and the Lottery Act. The director may limit the number of participants in any given millionaire prize drawing to one hundred.
(3) The number of prize awards in any regular stub drawing will depend on the number of stub tickets actually sold for that drawing. Stub tickets shall be printed using random techniques in order that:
(a) The possible numbers specified in this rule are randomly distributed throughout all the tickets printed in any given ticket issuance; and
(b) Mathematical reasoning indicates that, over a sufficiently large number of weeks, the average number of winning stub tickets in the regular stub drawings per one million tickets sold will be eighty.
(F) Frequency of prize drawings.
(1) A regular drawing shall be held each week on a day to be determined by the director. Millionaire finalist selection drawings shall be held at such times during a sales cycle as the director shall determine, and a millionaire prize drawing shall be held as soon as is practicable after each date during a sales cycle on which one hundred eligible holders are determined.
(2) If holders of valid winning tickets who are eligible to participate in a millionaire finalist selection drawing claim their eligibility after the last such drawing of a given cycle of game number sixteen, but otherwise in accordance with these rules and the Lottery Act, the director shall adopt procedures to afford such persons the opportunity to participate in a millionaire finalist selection drawing and, for the millionaire finalists there selected, the opportunity to participate in a millionaire prize drawing under circumstances as similar as is practicable to the circumstances of such drawings held during the applicable sales cycle of the game.
(3) A regular stub drawing shall be held each week on a day to be determined by the director.
(G) Manner of prize drawings.
(1) Prize drawings shall be open to the public and, whenever possible, persons eligible to win prizes shall be encouraged to attend and participate. Drawings may be held at the commission's headquarters, its regional offices or other places throughout the state as the director determines. The director shall inform the public as to the time and place of each prize drawing.
(2) All holders of valid tickets for a given regular drawing are eligible to win in that drawing. Prize winners shall claim their prizes, or their eligibility for a millionaire finalist selection drawing, won in regular drawings, by surrendering their tickets in accordance with the procedures of these rules.
(3) All drawings in game number sixteen will be conducted in accordance with random procedures approved by the director. For every drawing in game number sixteen, the director will approve procedures and mechanisms for the selection of winners and the awarding of prizes in order that, insofar as is possible, random selection will be achieved.
(H) Special claim, entry, receipt and validation procedures.
(1) The director shall establish special entry, claim, receipt and validation procedures governing eligibility for, and participation in, millionaire finalist selection drawings.
(2) Eligibility for such millionaire finalist selection drawings is expressly conditioned on compliance with the provisions of this rule and the procedures of the director authorized hereunder. The director's procedures governing these drawings shall provide, without limitation, procedures for the submission to the lottery of each entry of a valid winning ticket conferring eligibility; procedures for the identification of the holder of such ticket; procedures for deadlines by which such entries must be received to be eligible for given drawings; procedures for any necessary special validation; procedures for the transmittal to the state lottery by agents of tickets conferring eligibility; procedures for the claim and surrender of such tickets at lottery offices; and procedures governing all other matters which he may deem necessary or advisable consistent with the provisions of these rules.
(3) As to tickets transmitted by any means for entry into millionaire finalist selection drawings, whether surrendered to agents or otherwise transmitted, all risk of loss in transit arising from any source shall be borne by the holders of such tickets, regardless of any negligence, misfeasance or nonfeasance on the part of any agent or any bank providing safekeeping and depository services to the lottery, or by any lottery employee. The commission shall have no responsibility or liability as to any such tickets lost or damaged in transit or otherwise not actually received at lottery headquarters in Cleveland. All such tickets must pass all validation tests before their holders may become eligible for a millionaire finalist selection drawing.
(I) Validity of tickets.
(1) A mechanical error in printing the numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction can be advised of the correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, and it is possible that the ticket was a winning ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a free replacement ticket if ticket sales are still continuing in that sales cycle.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game number sixteen to be void if it is stolen, unissued, not sold or not deemed sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error, or incomplete; if other than the specified types of numbers appear in the specified locations on the ticket; or if the ticket fails any of the validation tests or procedures established by the director pursuant hereto. The commission's liability and responsibility for a ticket declared void, if any, is limited to the refund of the retail sales price of the ticket.
(J) Director's conduct of game number sixteen.
(1) The director shall conduct game number sixteen in a manner consistent with the Lottery Act, the rules of the commission, including without limitation, this rule 3770:1-7-16 of the Administrative Code, and the regulations of the director. As he deems it necessary or advisable, he shall adopt management regulations, orders or directives to implement and operate this lottery game.
(2) Names and definitions of elements of game number sixteen used in this rule are to be considered generic terms used solely for the purposes of this rule. In actual operation, game number sixteen and these elements may be given names or titles chosen by the commission.
