  • (A) Title and term. Ohio lottery commission game number twenty-one shall be conducted at such times and for such periods as the commission may determine. For the purposes of this rule, "sales cycle" shall mean any such period beginning on the date when ticket sales are commenced and continuing through the date established by the commission as the date on which agents are to make their final settlement in respect of tickets allocated to them during the period in game number twenty-one.

    (B) General design.

    (1) Game number twenty-one is a lottery game of the type generally known as an instant lottery.

    (2) As used in this rule, "prize amount" shall mean one of the following monetary amounts: two dollars, five dollars, twenty-five dollars, five hundred dollars, one thousand dollars, and five thousand dollars. Each ticket in game number twenty-one shall be imprinted with nine symbols from the set bar, bell, orange, star and cherry, which shall be referred to in this rule as the "slot machine symbols."

    (3) The slot machine symbols in game number twenty-one shall be arranged in horizontal rows composed of three symbols each. As used in this rule, the term "left" shall have its normal meaning with respect to a person facing the front of a ticket in game number twenty-one. The slot machine symbols shall be concealed by an opaque covering which can be scraped off by the holder of the ticket to reveal the underlying slot machine symbols. Holders of valid tickets bearing the slot machine symbols in specified combinations of positions shall be entitled to prizes in accordance with paragraph (D)(2) of this rule.

    (4) After any given sales cycle in game number twenty-one, prizes called "jackpot drawing prizes" shall be awarded in a single drawing called a "jackpot drawing." All holders of valid winning tickets winning a prize of twenty-five dollars may become eligible to participate in the jackpot drawing by complying with the special claim, entry, receipt and validation requirements of this rule, and with all other applicable requirements of the rules of the commission, the regulations of the director, and the procedures established by the director pursuant thereto.

    (C) Price of tickets. The price of a ticket issued by the commission in game number twenty-one shall be one dollar.

    (D) Structure, nature and value of prize awards.

    (1) There shall be two types of prize awards in game number twenty-one called regular prizes and jackpot drawing prizes, respectively.

    (2) Holders of valid winning tickets in game number twenty-one shall win prizes only as provided in this paragraph.

    (a) The holder of a valid ticket having an occurrence of one "cherry" slot machine symbol in the far left position, and two "bar" slot machine symbols in the other positions, in any horizontal row shall win a regular prize of a free ticket for game number twenty-one.

    (b) The holder of a valid ticket having an occurrence of two "cherry" slot machine symbols in the left positions, and one "bar" slot machine symbol in the remaining position, in any horizontal row shall win a regular prize of two dollars.

    (c) The holder of a valid ticket having an occurrence of three "cherry" slot machine symbols in any horizontal row shall win a regular prize of five dollars.

    (d) The holder of a valid ticket having an occurrence of three "orange" slot machine symbols in any horizontal row shall win a regular prize of twenty-five dollars.

    (e) The holder of a valid ticket having an occurrence of three "star" slot machine symbols in any horizontal row shall win a regular prize of five hundred dollars.

    (f) The holder of a valid ticket having an occurrence of three "bell" slot machine symbols in any horizontal row shall win a regular prize of one thousand dollars.

    (g) The holder of a valid ticket having an occurrence of three "bar" slot machine symbols in any horizontal row shall win a regular prize of five thousand dollars.

    (h) If a ticket bears two or more sets of slot machines symbols entitling the holder to a regular prize pursuant to paragraph (D)(2) of this rule, only the highest prize amount will be won.

    (3) Holders of valid tickets winning twenty-five dollars shall be eligible for the jackpot drawing, in which the following prizes shall be awarded:

    (a) One prize of five hundred thousand dollars;

    (b) One prize of fifty thousand dollars;

    (c) One prize of twenty thousand dollars;

    (d) Seven prizes of five thousand dollars; and

    (e) Thirty prizes of five hundred dollars.

    (E) Number of prize awards.

    (1) The number of prize awards in any sales cycle of game number twenty-one will depend upon the number of tickets sold during that cycle. Tickets shall be printed in accordance with this rule using random techniques in order that:

    (a) Combinations of slot machine symbols winning each prize amount are randomly distributed throughout all tickets printed in any given ticket issuance; and

    (b) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per one million tickets sold will be as follows:

    (i) Five tickets winning five thousand dollars;

    (ii) Five tickets winning one thousand dollars;

    (iii) Twenty tickets winning five hundred dollars;

    (iv) Two thousand seven hundred tickets winning twenty-five dollars;

    (v) Twenty-six thousand tickets winning five dollars;

    (vi) Eighty-two thousand tickets winning two dollars; and

    (vii) Fifty-six thousand tickets winning a free ticket for game number twenty-one.

    (2) The number of jackpot drawing prizes awarded shall be one prize of five hundred thousand dollars; one prize of fifty thousand dollars; one prize of twenty thousand dollars; seven prizes of five thousand dollars; and thirty prizes of five hundred dollars. The number of holders eligible to participate in the jackpot drawing will depend upon the number of tickets sold and the number of valid tickets winning prizes of twenty-five dollars, which are claimed, surrendered, received and validated in accordance with this rule, so as to make their holders eligible to participate in such drawing.

    (F) Frequency of prize drawings.

    (1) The random imprinting of slot machine symbols on all tickets issued in game number twenty-one shall be accomplished in a manner which complies with the commission's rules and procedures authorized thereunder.

    (2) When a ticket issued in game number twenty-one is sold or deemed sold in accordance with this rule, and the covering material over any of the slot machine symbols has been removed, the holder shall be deemed to have drawn the slot machine symbols on that ticket which determine whether the holder is entitled to a regular prize. All regular prizes shall be deemed to be announced no later than the last day of the sales cycle of game number twenty-one in which the ticket was sold.

    (3) One jackpot drawing shall be held after each sales cycle of game number twenty-one. The jackpot drawing shall be held on a date to be determined and announced by the director, which date shall be a reasonable period of time after the date established by the commission as the end of the sales cycle.

    (G) Manner of prize drawings.

    (1) The selection of persons eligible to participate in prize drawings, and the prize drawings, in game number twenty-one shall be open to the public and, whenever practicable, persons eligible to win prizes in such drawings shall be encouraged to attend and participate. Drawings may be held at the commission's headquarters, at its regional offices or at any other place or places in the state. The director shall inform the public as to the time and place of each drawing.

    (2) Subject to compliance with authorized claim and validation procedures, all holders of valid tickets are entitled to win the regular prizes determined by the slot machine symbols imprinted on those tickets in accordance with paragraph (D)(2) of this rule.

    (3) Subject to compliance with authorized entry, claim, receipt, and validation procedures, all holders of tickets who become eligible for the jackpot drawing shall be entitled to participate in the jackpot drawing.

    (4) For every participant selection and drawing in game number twenty-one, the director shall approve procedures and mechanisms for the selection of drawing participants, numbers and winners, and the awarding of prizes, in order that insofar as is possible, random selection will be achieved.

    (H) Special claim, entry, receipt and validation procedures.

    (1) The director shall establish special entry, claim receipt and validation procedures, including procedures for validation by agents of tickets winning prizes which are to be paid by agents in accordance with these rules, governing eligibility for participation in drawing and the jackpot drawing.

    (2) Eligibility for participation in the jackpot drawing is expressly conditioned on compliance with the provisions of this rule and the procedures of the director authorized hereunder. The director's procedures governing the jackpot drawing shall provide, without limitation, procedures for the transmittal to the state lottery by agents of redeemed tickets winning prizes of twenty-five dollars; procedures for the claim and surrender of such tickets at the lottery offices; procedures for any necessary special validation; procedures to establish and announce deadlines at a reasonable time after the date established by the commission at the end of any given sales cycle by which tickets winning prizes of twenty-five dollars must be claimed, redeemed and surrendered to agents, or lottery offices; and actually received at lottery headquarters, in order to cause their holders to become eligible for selection for the jackpot drawing; procedures for the identification of the holders of such tickets; and procedures as to all other matters which the director may deem necessary or advisable consistent with these rules.

    (3) As to tickets surrendered to sales agents or otherwise transmitted to the lottery for entry into the jackpot drawing, all risk of loss in transit arising from any source shall be borne by the holder of such tickets, regardless of any negligence, misfeasance or nonfeasance on the part of any lottery sales agent or any bank providing safekeeping and depository services to the lottery, or by any lottery employee. The commission shall have no responsibility or liability as to any such tickets lost or damaged in transit or otherwise not actually received at lottery headquarters in Cleveland. All such tickets must pass all validation tests before their holder may become eligible for the jackpot drawing.

    (I) Validity of tickets.

    (1) A mechanical error in printing slot machine symbols on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction can be advised of the correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price.

    (2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game number twenty-one to be void if it is stolen, unissued, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error, or incomplete; if other than exactly one slot machine symbol appears in any or all of the nine locations on the ticket; or if any portion of the "void if removed" number is exposed; or if the ticket fails any of the validation tests or procedures established by the director pursuant hereto. The commission's liability and responsibility for a ticket declared void, if any, is limited to the refund of the retail sales price of the ticket.

    (J) Director's conduct of game number twenty-one.

    (1) The director shall conduct game number twenty-one in a manner consistent with the Lottery Act, the rules of the commission, including, without limitation, this rule and the regulations of the director. As he deems it necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule, and the procedures established pursuant hereto, which affect the play of game number twenty-one.

    (2) Names and definitions of elements of game number twenty-one used in this rule are to be considered generic terms used solely for the purpose of this rule. In actual operation, game number twenty-one and these elements may be given names or titles chosen by the commission.
