3770:1-9-125. Game rule number one hundred twenty-five
-
(A) Title and term. Ohio lottery commission game rule number one hundred twenty-five, "Some Like It Hot," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number one hundred twenty-five.
(B) General design.
(1) Game rule number one hundred twenty-five is a key number match game and is generally known as an "instant lottery."
(2) The player will remove the covering over the entire play are to reveal one "Winning Number," five "Your Numbers" and five corresponding prize values. If any one or more of "Your Numbers" matches the "Winning Number," the player wins the corresponding prize value(s) shown below the matching "Your Number(s)." If the player reveals a "Hot" symbol in any of the "Your Numbers" play spots, the player wins double the prize shown automatically. There are five chances to win on each ticket, and a player may win up to five times on one ticket.
(3) The only "prize values" which shall appear on a ticket in game rule number one hundred twenty-five are: one dollar, two dollars, four dollars, five dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars and one thousand dollars. Numbers, prize values and play symbols appearing on any ticket in game rule number one hundred twenty-five shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.
(C) Price of tickets. The price of a ticket issued by the commission in game rule number one hundred twenty-five shall be one dollars.
(D) Structure, nature and value of prize awards.
(1) There shall be one type of prize in game rule number one hundred twenty-five called a "regular prize award."
(2) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: one dollar, two dollars, four dollars, five dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars and one thousand dollars. Each ticket in game rule number one hundred twenty-five shall be imprinted in such a way that prize awards from the set listed above may be won.
(a) Holder of a valid winning ticket on which the "Winning Number" is matched by one of "Your Numbers" for one dollar shall win a regular prize award of one dollar;
(b) Holder of a valid winning ticket on which the "Winning Number" is matched by one of "Your Numbers" for two dollars shall win a regular prize award of two dollars;
(c) Holder of a valid winning ticket on which the "Hot" symbol is revealed as a "Your Number" for one dollar doubled shall win a regular prize award of two dollars;
(d) Holder of a valid winning ticket on which the "Winning Number" is matched by four of "Your Numbers" for one dollar shall win a regular prize award of four dollars;
(e) Holder of a valid winning ticket on which the "Winning Number" is matched by two of "Your Numbers" for two dollars shall win a regular prize award of four dollars;
(f) Holder of a valid winning ticket on which the "Hot" sumbol is revealed as "Your Number" for two dollars doubled shall win a regular prize award of four dollars;
(g) Holder of a valid winning ticket on which the "Winning Number" is matched by one of "Your Numbers" for four dollars shall win a regular prize award of four dollars;
(h) Holder of a valid winning ticket on which the "Winning Number" is matched by five of "Your Numbers" for one dollar shall win a regular prize award of five dollars;
(i) Holder of a valid winning ticket on which the "Hot" symbol is revealed as "Your Number" for two dollars doubled and the "Winning Number" is matched by one of "Your Numbers" for one dollar shall win a regular prize award of five dollars;
(j) Holder of a valid winning ticket on which the "Winning Number" is matched by three of "Your Numbers" for one dollar and one of "Your Numbers" for two dollars shall win a regular prize award of five dollars;
(k) Holder of a valid winning ticket on which the "Winning Number" is two of "Your Numbers" for two dollars and one of "Your Numbers" for one dollar shall win a regular prize award of five dollars;
(l) Holder of a valid winning ticket on which the "Winning Number" is matched by one of "Your Numbers" for five dollars shall win a regular prize award of five dollars;
(m) Holder of a valid winning ticket on which the "Hot" symbol is revealed as "Your Number" for five dollars doubled shall win a regular prize award of ten dollars;
(n) Holder of a valid winning ticket on which the "Winning Number" is matched by five of "Your Numbers" for two dollars shall win a regular prize award of ten dollars;
(o) Holder of a valid winning ticket on which the "Winning Number" is matched by one of "Your Numbers" for ten dollars shall win a regular prize award of ten dollars;
(p) Holder of a valid winning ticket on which the "Winning Number" is matched by four of "Your Numbers" for five dollars shall win a regular prize award of twenty dollars;
(q) Holder of a valid winning ticket on which the "Hot" symbol is revealed as "Your Number" for ten dollars doubled shall win a regular prize award of twenty dollars;
(r) Holder of a valid winning ticket on which the "Winning Numbers" is matched by five of "Your Numbers" for four dollars shall win a regular prize award of twenty dollars;
(s) Holder of a valid winning ticket on which the "Winning Number" is matched by one of "Your Numbers" for twenty dollars shall win a regular prize award of twenty dollars;
(t) Holder of a valid winning ticket on which the "Winning Number" is matched by five of the "Your Numbers" for ten dollars shall win a regular prize award of fifty dollars;
(u) Holder of a valid winning ticket on which the "Hot" symbol is revealed as "Your Number" for twenty dollars doubled and the "Winning Number" is matched by one of "Your Numbers" for ten dollars shall win a regular prize award of fifty dollars;
(v) Holder of a valid winning ticket on which the "Winning Number" is matched by one of "Your Numbers" for fifty dollars shall win a regular prize award of fifty dollars;
(w) Holder of a valid winning ticket on which the "Winning Number" is matched by five of "Your Numbers" for twenty dollars shall win a regular prize award of one hundred dollars;
(x) Holder of a valid winning ticket on which the "Hot" symbol is revealed as "Your Number" for fifty dollars doubled shall win a regular prize award of one hundred dollars;
(y) Holder of a valid winning ticket on which the "Winning Number" is matched by one of "Your Numbers" for one hundred dollars shall win a regular prize award of one hundred dollars;
(z) Holder of a valid winning ticket on which the "Winning Number" is matched by one of "Your Numbers" for one thousand dollars shall win a regular prize award of one thousand dollars;
(E) Number of prize awards. The number of prize awards in any sales cycle of game rule number one hundred twenty-five will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using techniques in order that the following occur:
(1) Combinations winning each prize award are distributed throughout all tickets printed in any given ticket issuance;
(2) Mathematical reasoning indicates that the number of winning tickets per six million tickets sold in the following prize categories should be as follows:
(a) Thirty tickets with the winning prize combination as set fourth in (D)(2)(z) of this rule to win one thousand dollars;
(b) One hundred fifty tickets with the winning prize combination as set fourth in (D)(2)(y) of this rule to win one hundred dollars;
(c) Three hundred tickets with the winning prize combination as set fourth in (D)(2)(x) of this rule to win one hundred dollars;
(d) Three hundred tickets with the winning prize combination as set fourth in (D)(2)(w) of this rule to win one hundred dollars;
(e) Six hundred tickets with the winning prize combination as set fourth in (D)(2)(v) of this rule to win fifty dollars;
(f) One thousand two hundred tickets with the winning prize combination as set fourth in (D)(2)(u) of this rule to win fifty dollars;
(g) Six hundred tickets with the winning prize combination as set fourth in (D)(2)(t) of this rule to win fifty dollars;
(h) Seven thousand five hundred tickets with the winning prize combination as set fourth in (D)(2)(s) of this rule to win twenty dollars;
(i) Seven thousand five hundred tickets with the winning prize combination as set fourth in (D)(2)(r) of this rule to win twenty dollars;
(j) Seven thousand five hundred tickets with the winning prize combination as set fourth in (D)(2)(q) of this rule to win twenty dollars;
(k) Seven thousand five hundred tickets with the winning prize combination as set fourth in (D)(2)(p) of this rule to win twenty dollars;
(l) Seven thousand five hundred tickets with the winning prize combination as set fourth in (D)(2)(o) of this rule to win ten dollars;
(m) Seven thousand five hundred tickets with the winning prize combination as set fourth in (D)(2)(n) of this rule to win ten dollars;
(n) Fifteen thousand tickets with the winning prize combination as set fourth in (D)(2)(m) of this rule to win ten dollars;
(o) Fifteen thousand tickets with the winning prize combination as set fourth in (D)(2)(l) of this rule to win five dollars;
(p) Fifteen thousand tickets with the winning prize combination as set fourth in (D)(2)(k) of this rule to win five dollars;
(q) Fifteen thousand tickets with the winning prize combination as set fourth in (D)(2)(j) of this rule to win five dollars;
(r) Thirty thousand tickets with the winning prize combination as set fourth in (D)(2)(i) of this rule to win five dollars;
(s) Fifteen thousand tickets with the winning prize combination as set fourth in (D)(2)(h) of this rule to win five dollars;
(t) Thirty thousand tickets with the winning prize combination as set fourth in (D)(2)(g) of this rule to win four dollars;
(u) Thirty thousand tickets with the winning prize combination as set fourth in (D)(2)(f) of this rule to win four dollars;
(v) Thirty thousand tickets with the winning prize combination as set fourth in (D)(2)(e) of this rule to win four dollars;
(w) Sixty thousand tickets with the winning prize combination as set fourth in (D)(2)(d) of this rule to win four dollars;
(x) Three hundred thirty thousand tickets with the winning prize combination as set fourth in (D)(2)(c) of this rule to win two dollars;
(y) One hundred eighty thousand tickets with the winning prize combination as set fourth in (D)(2)(b) of this rule to win two dollars;
(z) Four hundred eighty thousand tickets with the winning prize combination as set fourth in (D)(2)(a) of this rule to win one dollar;
(F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.
(G) Frequency of prize drawings.
(1) Imprinting of prize awards on all tickets issued in game rule number one hundred twenty-five shall be accomplished in a manner which complies with the commission's rules and procedures.
(2) When a ticket issued in game rule number one hundred twenty-five is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number one hundred twenty-five in which the ticket was sold.
(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.
(I) Validity of tickets.
(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number one hundred twenty-five void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.
(J) Director's conduct of game rule number one hundred twenty-five.
(1) The director shall conduct game rule number one hundred twenty-five in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number one hundred twenty-five. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.
(2) Names and definitions of elements of game rule number one hundred twenty-five used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number one hundred twenty-five and these elements may be given names or titles chosen by the commission.
