3770:1-9-189. Game number one hundred eighty-nine
-
(A) Title and term. Ohio lottery commission game number one hundred eighty-nine, "Cash Explosion ," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which agents are to make their final settlement with respect to tickets allocated to them during the period in game number one hundred eighty-nine.
(B) General design.
(1) Game number one hundred eighty-nine is a match three lottery game of the type generally known as an "instant lottery," and which contains a TV game show "entry" feature.
(2) As used in this rule, "prize award" shall mean a free ticket of comparable price or one of the following monetary amounts: Two dollars, five dollars, twenty-five dollars, fifty dollars and five hundred dollars. A player may also win a prize of an "entry" which entitles that person to be entered into a weekly drawing with a chance to become a participant on the "Cash Explosion " TV game show. Each ticket in game number one hundred eighty-nine shall be imprinted with six prize values based on the set of prize awards listed above.
(3) Holders of valid tickets on which at least three of the prize values are the same shall win a prize award equal to such prize value and called a "regular prize award." Such tickets shall be called "winning tickets."
(4) All holders of valid winning tickets containing the word "entry" three times shall become eligible to become contestants on the weekly "Cash Explosion " TV game show by complying with the special claim, entry, receipt, validation and drawing requirements of this rule, and with all other applicable requirements of the rules of the commission, the regulations of the director and the procedures established by the director. After each week in game number one hundred eighty-nine, prizes called "weekly game show prizes" shall be awarded to eight contestants participating in the weekly "Cash Explosion " TV game show, and one "grand prize" shall be awarded to an eligible finalist at the end of that show.
(C) Price of tickets. The price of a ticket issued by the commission in game number one hundred eighty-nine shall be one dollar.
(D) Structure, nature and value of prize awards.
(1) Three types of prizes shall be awarded in game number one hundred eighty-nine: "Regular prizes," "weekly game show prizes" and one weekly "grand prize."
(2) The only "prize values" which shall appear on a ticket in game number one hundred eighty-nine are: "Entry," free "ticket," two dollars, five dollars, twenty-five dollars, fifty dollars and five hundred dollars. Prize values and symbols shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying prize values and symbols.
(a) Holder of a valid winning ticket on which at east three of the prize values are "entry" ticket symbols shall win a regular prize award of an entry for a chance to be selected in a weekly drawing to appear on the "Cash Explosion " TV game show;
(b) Holder of a valid winning ticket on which at least three of the prize values are free "ticket" symbols shall win a regular prize award of a free prize award of a free ticket of comparable price;
(c) Holder of a valid winning ticket on which at least three of the prize values are two dollars shall win a regular prize award of two dollars;
(d) Holder of a valid winning ticket on which at least three of the prize values are five dollars shall win a regular prize award of five dollars;
(e) Holder of a valid winning ticket on which at least three of the prize values are twenty-five dollars shall win a regular prize award of twenty-five dollars;
(f) Holder of a valid winning ticket on which at least three of the prize values are fifty dollars shall win a regular prize award of fifty dollars; and
(g) Holder of a valid winning ticket on which at least three of the prize values are five hundred dollars shall win a regular prize award of five hundred dollars.
(3) Each of the eight eligible holders of "entry" tickets whose names are drawn for participation in the weekly "Cash Explosion " TV game show shall be selected to participate as contestants in one of two semi-final game show rounds during which up to approximately one hundred fifty thousand dollars in weekly game show prizes shall be awarded pursuant to game show procedures established by the director. A finalist shall emerge from each of the semi-final rounds to participate in the championship round with the winner of the previous week's championship round unless the winner of the previous week's championship round was retired because he or she won the maximum grand prize amount of two hundred thousand dollars. In such a case, there will be only two participants in the championship round. A weekly grand prize shall be awarded to the winner of the championship round at the end of the TV game show in the amount of fifty thousand dollars, one hundred thousand dollars or two hundred thousand dollars. Grand prize amounts are awarded sequentially, with the winner of the previous week's championship round having the possibility of doubling his or her grand prize winnings from the previous grand prize. An eligible finalist may participate in a maximum of three championship rounds. No grand prize winner appearing more than once shall forfeit a prize won during the last appearance if he or she fails to win during subsequent appearances.
(E) Number of prize awards. The number of prize awards in any sales cycle of game number one hundred eighty-nine will depend upon the number of tickets sold during that cycle. Tickets shall be printed in accordance with this rule using random techniques in order that:
(1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and
(2) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred forty thousand tickets sold will be as follows:
(a) Twelve tickets winning five hundred dollars;
(b) Six hundred twenty five tickets winning fifty dollars;
(c) One thousand one hundred sixty four tickets winning twenty-five dollars;
(d) Three thousand six hundred tickets winning five dollars;
(e) Sixteen thousand eight hundred tickets winning two dollars;
(f) Twenty five thousand two hundred tickets winning a free "ticket" of comparable price; and
(g) Three hundred seventy five tickets winning an "entry" into the weekly drawing to appear on the "Cash Explosion " TV game show.
(3) The number of weekly TV game show prizes and the weekly grand prize shall be determined in accordance with paragraph (D)(3) of this Rule.
(F) Tickets sold. An instant ticket game may continue to be sold even when some or all of the top prizes have been claimed.
(G) Frequency of prize drawings.
(1) Random imprinting of prize awards on all tickets issued in game number one hundred eighty-nine shall be accomplished in a manner which complies with the commission's rules and procedures.
(2) When a ticket issued in game number one hundred eighty-nine is sold or deemed sold in accordance with this rule, and the covering material over any of the numbers and symbols has been removed, the holder shall be deemed to have drawn the numbers and symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular awards shall be deemed announced no later than the last day of the sales of game number one hundred eighty-nine in which the ticket was sold.
(3) Drawings conducted for the purposes of determining who shall become entitled to appear as a contestant on the "Cash Explosion " TV game show, and any other drawings conducted in connection with the TV game show shall comply with the rules and regulations of the commission governing "prize drawings" and "special lottery drawings."
(4) Weekly game show prizes and a grand prize shall be awarded each week during game number one hundred eighty-nine on the "Cash Explosion " TV game show. The TV game show shall be held on dates determined and announced by the director.
(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by agents of tickets winning prizes which are to be paid by agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.
(I) Validity of tickets.
(1) A mechanical error in printing prize awards or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game number one hundred eighty-nine void if it is stolen, unissued, not sold or deemed not sold in accordance with commission rules; if the front or back of the ticket is illegible, mutilated, altered, counterfeit, misregistered or reconstituted; if the ticket is miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to the refund of the retail sales price of the ticket or the issuance of a replacement ticket of comparable price.
(J) Director's conduct of game number one hundred eighty-nine.
(1) The director shall conduct game number one hundred eighty-nine in a manner consistent with the Lottery Act, the rules of the commission, including without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game number one hundred eighty-nine.
(2) Names and definitions of elements of game number one hundred eighty-nine used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game number one hundred eighty-nine and these elements may be given names or titles chosen by the commission.
