  • (A) Title and term. Ohio lottery commission game rule number two hundred seventy-six, "Double Diamond" shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number two hundred seventy-six.

    (B) General design.

    (1) Game rule number two hundred seventy-six is a key number match and a match three prize amount game and is generally known as an "instant lottery."

    (2) Holders of valid tickets will remove the covering off the entire play area to reveal two "Winning Numbers," ten "Your Numbers" and ten corresponding prize values. If any one or both of "Your Numbers" matches the "Winning Numbers," the player wins the corresponding prize. If the player reveals three identical prize amounts, the player wins the corresponding prize amount. There are ten chances to win on each ticket.

    (3) The only "prize values" which shall appear on a ticket in game rule number two hundred seventy-six are: one dollar, two dollars, four dollars, five dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars, one thousand dollars, and twenty thousand dollars. Numbers, prize values and play symbols appearing on any ticket in game rule number two hundred seventy-six shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.

    (C) Price of tickets. The price of a ticket issued by the commission in game rule number two hundred seventy-six shall be two dollars.

    (D) Structure, nature and value of prize awards.

    (1) There shall be one type of prize in game rule number two hundred seventy-six called a "regular prize award."

    (2) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: two dollars, four dollars, five dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars, one thousand dollars, and twenty thousand dollars. Each ticket in game rule number two hundred seventy-six shall be imprinted in such a way that prize awards from the set listed above may be won.

    (a) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" for one dollar two times shall win a regular prize award of two dollars;

    (b) Holder of a valid winning ticket matching three like prize amounts for two dollars once shall win a regular prize award of two dollars;

    (c) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for two dollars once shall win a regular prize award of two dollars;

    (d) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" for two dollars two times shall win a regular prize award of four dollars;

    (e) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" for one dollar two times and matching three like prize amounts for two dollars once shall win a regular prize award of four dollars;

    (f) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by three of "Your Numbers" for one dollar two times and two dollars once shall win a regular prize award of four dollars;

    (g) Holder of a valid winning ticket matching three like prize amounts for four dollars once shall win a regular prize award of four dollars;

    (h) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for four dollars once shall win a regular prize award of four dollars;

    (i) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" for two dollars two times and matching three like prize amounts for one dollar once shall win a regular prize award of five dollars;

    (j) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by three of "Your Numbers" for one dollar once and two dollars two times shall win a regular prize award of five dollars;

    (k) Holder of a valid winning ticket matching three like prize amounts for five dollars once shall win a regular prize award of five dollars;

    (l) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for five dollars once shall win a regular prize award of five dollars;

    (m) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by four of "Your Numbers" for one dollar two times and two dollars two times and matching three like prize amounts for four dollars once shall win a regular prize award of ten dollars;

    (n) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by three of "Your Numbers" for one dollar once and two dollars two times and matching three like prize amounts for five dollars once shall win a regular prize award of ten dollars;

    (o) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by three of "Your Numbers" for four dollars two times and two dollars once shall win a regular prize award of ten dollars;

    (p) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" for five dollars two times shall win a regular prize award of ten dollars;

    (q) Holder of a valid winning ticket matching three like prize amounts for ten dollars once shall win a regular prize award of ten dollars;

    (r) Holder of a valid winning ticket on which one of the "Winning Numbers" are matched by one of "Your Numbers" for ten dollars once shall win a regular prize award of ten dollars;

    (s) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by three of "Your Numbers" for five dollars two times and ten dollars once shall win a regular prize award of twenty dollars;

    (t) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by six of "Your Numbers" for one dollar two times, two dollars two times and five dollars two times and matching three like prize amounts for four dollars once shall win a regular prize award of twenty dollars;

    (u) Holder of a valid winning ticket matching three like prize amounts for twenty dollars once shall win a regular prize award of twenty dollars;

    (v) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for twenty dollars once shall win a regular prize award of twenty dollars;

    (w) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by five of "Your Numbers" for five dollars two times, ten dollars two times and twenty dollars once shall win a regular prize award of fifty dollars;

    (x) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by four of "Your Numbers" for five dollars two times and ten dollars two times and matching three like prize amounts for twenty dollars once shall win a regular prize award of fifty dollars;

    (y) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by three of "Your Numbers" for ten dollars once and twenty dollars two times shall win a regular prize award of fifty dollars;

    (z) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by eight of "Your Numbers" for one dollar two times, four dollars two times, five dollars two times, ten dollars once and twenty dollars once shall win a regular prize award of fifty dollars;

    (aa) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" for twenty dollars two times and matching three like prize amounts for ten dollars once shall win a regular prize award of fifty dollars;

    (bb) Holder of a valid winning ticket matching three like prize amounts for fifty dollars once shall win a regular prize award of fifty dollars;

    (cc) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for fifty dollars once shall win a regular prize award of fifty dollars;

    (dd) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" for fifty dollars two times shall win a regular prize award of one hundred dollars;

    (ee) Holder of a valid winning ticket matching three like prize amounts for one hundred dollars once shall win a regular prize award of one hundred dollars;

    (ff) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for one hundred dollars once shall win a regular prize award of one hundred dollars;

    (gg) Holder of a valid winning ticket matching three like prize amounts for one thousand dollars once shall win a regular prize award of one thousand dollars;

    (hh) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for one thousand dollars once shall win a regular prize award of one thousand dollars;

    (ii) Holder of a valid winning ticket matching three like prize amounts for twenty thousand dollars once shall win a regular prize award of twenty thousand dollars; and

    (jj) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for twenty thousand dollars once shall win a regular prize award of twenty thousand dollars.

    (E) Number of prize awards. The number of prize awards in any sales cycle of game rule number two hundred seventy-six will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:

    (1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

    (2) Mathematical reasoning indicates that the average number of winning tickets per six million tickets sold should be as follows:

    (a) Seven tickets with the winning prize combination as set forth in paragraph (D)(2)(jj) of this rule to win twenty thousand dollars;

    (b) Seven tickets with the winning prize combination as set forth in paragraph (D)(2)(ii) of this rule to win twenty thousand dollars;

    (c) Seventy-five tickets with the winning prize combination as set forth in paragraph (D)(2)(hh) of this rule to win one thousand dollars;

    (d) One hundred twenty-five tickets with the winning prize combination as set forth in paragraph (D)(2)(gg) of this rule to win one thousand dollars;

    (e) One thousand two hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(ff) of this rule to win one hundred dollars;

    (f) Two thousand four hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(ee) of this rule to win one hundred dollars;

    (g) Three thousand nine hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(dd) of this rule to win one hundred dollars;

    (h) One thousand two hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(cc) of this rule to win fifty dollars;

    (i) One thousand two hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(bb) of this rule to win fifty dollars;

    (j) One thousand eight hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(aa) of this rule to win fifty dollars;

    (k) Two thousand seven hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(z) of this rule to win fifty dollars;

    (l) Two thousand four hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(y) of this rule to win fifty dollars;

    (m) One thousand eight hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(x) of this rule to win fifty dollars;

    (n) Two thousand seven hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(w) of this rule to win fifty dollars;

    (o) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(v) of this rule to win twenty dollars;

    (p) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(u) of this rule to win twenty dollars;

    (q) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(t) of this rule to win twenty dollars;

    (r) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(s) of this rule to win twenty dollars;

    (s) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(r) of this rule to win ten dollars;

    (t) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(q) of this rule to win ten dollars;

    (u) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(p) of this rule to win ten dollars;

    (v) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(o) of this rule to win ten dollars;

    (w) Thirty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(n) of this rule to win ten dollars;

    (x) Thirty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(m) of this rule to win ten dollars;

    (y) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(l) of this rule to win five dollars;

    (z) Thirty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(k) of this rule to win five dollars;

    (aa) Thirty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(j) of this rule to win five dollars;

    (bb) Forty-five thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(i) of this rule to win five dollars;

    (cc) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(h) of this rule to win four dollars;

    (dd) Forty-five thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(g) of this rule to win four dollars;

    (ee) One hundred twenty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(f) of this rule to win four dollars;

    (ff) One hundred twenty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(e) of this rule to win four dollars;

    (gg) One hundred twenty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(d) of this rule to win four dollars;

    (hh) One hundred twenty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(c) of this rule to win two dollars;

    (ii) One hundred eighty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(b) of this rule to win two dollars; and

    (jj) Three hundred thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(a) of this rule to win two dollars.

    (F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

    (G) Frequency of prize drawings.

    (1) Random imprinting of prize awards on all tickets issued in game rule number two hundred seventy-six shall be accomplished in a manner which complies with the commission's rules and procedures.

    (2) When a ticket issued in game rule number two hundred seventy-six is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number two hundred seventy-six in which the ticket was sold.

    (H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

    (I) Validity of tickets.

    (1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number two hundred seventy-six void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

    (J) Director's conduct of game rule number two hundred seventy-six.

    (1) The director shall conduct game rule number two hundred seventy-six and any promotions associated therewith in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number two hundred seventy-six. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

    (2) Names and definitions of elements of game rule number two hundred seventy-six used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number two hundred seventy-six and these elements may be given names or titles chosen by the commission.
