3770:1-9-288. Game rule two hundred eighty-eight
-
(A) Title and term. Ohio lottery commission game rule two hundred eighty-eight, "Merry Money" shall be conducted at such times and for such periods as the commission may determine. For the purposes of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule two hundred eighty-eight.
(B) General design.
(1) Game rule two hundred eighty-eight is a key number match game with a "multiplier" feature and is generally known as an "instant lottery."
(2) The holder of a valid ticket will remove the covering over the entire play area to reveal six "Winning Numbers," twenty "Your Numbers" and twenty corresponding prize values. If any one or more of "Your Numbers" matches one or more of the "Winning Numbers," the player wins the corresponding prize values shown below the matching "Your Numbers." If the player reveals a "Star" symbol in any of the "Your Numbers" play spots, the player wins the corresponding prize value automatically. If the player reveals an "10X" symbol in any of the "Your Numbers" play spots, the player wins ten times the corresponding prize value shown automatically. If the player reveals a "20X" symbol in any of the "Your Numbers" play spots, the player wins twenty times the prize value shown automatically. If the player matches any of "Your Numbers" to one of the "Winning Numbers" and the corresponding prize value revealed is a "TPD" symbol, the player wins five thousand five hundred dollars automatically, and upon the filing of a valid claim at an Ohio lottery commission office, shall automatically be entered into the Top Prize Drawing ("TPD") for a chance to win five hundred thousand dollars. The Top Prize Drawing shall be conducted in accordance with Ohio lottery rules and procedures established and approved by the director.
(3) The only "prize values" which shall appear on a ticket in game rule two hundred eighty-eight are: one dollar, two dollars, three dollars, four dollars, five dollars, ten dollars, twenty dollars, twenty-five dollars, fifty dollars, one hundred dollars, five hundred dollars, one thousand dollars, five thousand dollars, the "TPD" symbol corresponding to a prize value of five thousand five hundred dollars, ten thousand dollars, fifty thousand dollars and five hundred thousand dollars.
(C) Price of tickets. The price of a ticket issued by the commission in game rule two hundred eighty-eight shall be ten dollars.
(D) Structure, nature and value of prize awards
(1) There shall be two types of prizes in game rule one hundred sixty, a "regular prize award" and a "TPD" prize award.
(2) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: ten dollars, twenty dollars, twenty-five dollars, fifty dollars, one hundred dollars, five hundred dollars, one thousand dollars, five thousand dollars, five thousand five hundred dollars, ten thousand dollars, fifty thousand dollars and five hundred thousand dollars. Each ticket in game rule two hundred eighty-eight shall be imprinted in such a way that prize awards from the set listed above may be won.
(a) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" or a "Star" symbol is revealed in ten of the "Your Numbers" play spots, or any combination thereof, for one dollar ten times shall win a regular prize award of ten dollars;
(b) Holder of a valid winning ticket on which a "10X" symbol is revealed for one dollar times ten shall win a regular prize award of ten dollars;
(c) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by four of "Your Numbers" or a "Star" symbol is revealed in four of the "Your Numbers" play spots, or any combination thereof, for four dollars once, three dollars once, two dollars once, and one dollar once shall win a regular prize award of ten dollars;
(d) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" or a "Star" symbol is revealed in five of the "Your Numbers" play spots, or any combination thereof, for two dollars five times shall win a regular prize award of ten dollars;
(e) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for ten dollars once shall win a regular prize award of ten dollars;
(f) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by twenty of "Your Numbers" or a "Star" symbol is revealed in twenty of the "Your Numbers" play spots, or any combination thereof, for one dollar twenty times shall win a regular prize award of twenty dollars;
(g) Holder of a valid winning ticket on which a "20X" symbol is revealed for one dollar times twenty shall win a regular prize award of twenty dollars;
(h) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by four of "Your Numbers" or a "Star" symbol is revealed in four of the "Your Numbers" play spots, or any combination thereof, for five dollars four times shall win a regular prize award of twenty dollars;
(i) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" or a "Star" symbol is revealed in ten of the "Your Numbers" play spots, or any combination thereof, for two dollars ten times shall win a regular prize award of twenty dollars;
(j) Holder of a valid winning ticket on which a "10X" symbol is revealed for two dollars times ten shall win a regular prize award of twenty dollars;
(k) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" or a "Star" symbol is revealed in two of the "Your Numbers" play spots, or any combination thereof, for ten dollars two times shall win a regular prize award of twenty dollars;
(l) Holder of a valid winning ticket on which one of the "Winning Number" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for twenty dollars once shall win a regular prize award of twenty dollars;
(m) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" or a "Star" symbol is revealed in five of the "Your Number" play spots, or any combination thereof, for five dollars five times shall win a regular prize award of twenty-five dollars;
(n) Holder of a valid winning ticket on which one or more of the "Winning Numbers" is matched by eleven of "Your Numbers" or a "Star" symbol is revealed in three of the "Your Numbers" play spots, or any combination thereof, for two dollars ten times and five dollars once shall win a regular prize award of twenty-five dollars;
(o) Holder of a valid winning ticket on which a "10X" symbol is revealed for two dollars times ten and on which one of the "Winning Number" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for five dollars once shall win a regular prize award of twenty-five dollars;
(p) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by six of "Your Numbers" or a "Star" symbol is revealed in six of the "Your Numbers" play spots, or any combination thereof, for ten dollars once, five dollars once, four dollars once, three dollars once, two dollars once, and one dollar once shall win a regular prize award of twenty-five dollars;
(q) Holder of a valid winning ticket on which one or more of the "Winning Numbers" is matched by twenty of "Your Numbers" or a "Star" symbol is revealed in twenty of the "Your Numbers" play spots, or any combination thereof, for one dollar fifteen times and two dollars five times shall win a regular prize award of twenty-five dollars;
(r) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" or a "Star" symbol is revealed in two of the "Your Numbers" play spots, or any combination thereof, for five dollars once and twenty dollars once shall win a regular prize award of twenty-five dollars;
(s) Holder of a valid winning ticket on which one or more of the "Winning Numbers" is matched by three of "Your Numbers" or a "Star" symbol is revealed in three of the "Your Numbers" play spots, or any combination thereof, for five dollars once and ten dollars two times shall win a regular prize award of twenty-five dollars;
(t) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for twenty-five dollars once shall win a regular prize award of twenty-five dollars;
(u) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by four of "Your Numbers" or a "Star" symbol is revealed in four of the "Your Numbers" play spots, or any combination thereof, for twenty-five dollars once, ten dollars two times and five dollars once shall win a regular prize award of fifty dollars;
(v) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" or a "Star" symbol is revealed in ten of the "Your Numbers" play spots, or any combination thereof, for five dollars ten times shall win a regular prize award of fifty dollars;
(w) Holder of a valid winning ticket on which an "10X" symbol is revealed in one of the "Your Numbers" play spots for five dollars times ten shall win a regular prize award of fifty dollars;
(x) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by twenty of "Your Numbers" or a "Star" symbol is revealed in twenty of the "Your Numbers" play spots, or any combination thereof, for one dollar eight times, two dollars six times and five dollars six times shall win a regular prize award of fifty dollars;
(y) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" or a "Star" symbol is revealed in two of the "Your Numbers" play spots, or any combination thereof, for twenty-five dollars two times shall win a regular prize award of fifty dollars;
(z) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by four of "Your Numbers" or a "Star" symbol is revealed in four of the "Your Numbers" play spots, or any combination thereof, for ten dollars three times and twenty dollars once shall win a regular prize award of fifty dollars;
(aa) Holder of a valid winning ticket on which a "20X" symbol is revealed for two dollars times twenty and on which one of the "Winning Number" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for ten dollars once shall win a regular prize award of fifty dollars;
(bb) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" or a "Star" symbol is revealed in five of the "Your Numbers" play spots, or any combination thereof, for ten dollars five times shall win a regular prize award of fifty dollars;
(cc) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for fifty dollars once shall win a regular prize award of fifty dollars;
(dd) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" or a "Star" symbol is revealed in ten of the "Your Numbers" play areas, or any combination thereof, for ten dollars ten times shall win a regular prize award of one hundred dollars;
(ee) Holder of a valid winning ticket on which an "10X" symbol is revealed in one of the "Your Numbers" play spots for ten dollars times ten shall win a regular prize award of one hundred dollars;
(ff) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by twenty of "Your Numbers" or a "Star" symbol is revealed in twenty of the "Your Numbers" play spots, or any combination thereof, for five dollars twenty times shall win a regular prize award of one hundred dollars;
(gg) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by seven of "Your Numbers" or a "Star" symbol is revealed in seven of the "Your Numbers" play spots, or any combination thereof, for five dollars four times, ten dollars once, twenty dollars once and fifty dollars once shall win a regular prize award of one hundred dollars;
(hh) Holder of a valid winning ticket on which "20X" symbol is revealed in one of the "Your Numbers" play spots for five dollars times twenty shall win a regular prize award of one hundred dollars;
(ii) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by fifteen of "Your Numbers" or a "Star" symbol is revealed in fifteen of the "Your Numbers" play spots, or any combination thereof, for five dollars ten times and ten dollars five times shall win a regular prize award of one hundred dollars;
(jj) Holder of a valid winning ticket on which a "10X" symbol is revealed for five dollars times ten and on which one or more of the "Winning Number" are matched by five of "Your Numbers" or a "Star" symbol is revealed in five of the "Your Numbers" play spots, or any combination thereof, for ten dollars five times shall win a regular prize award of one hundred dollars;
(kk) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for one hundred dollars once shall win a regular prize award of one hundred dollars;
(ll) Holder of a valid winning ticket on which an "10X" symbol is revealed in one of the "Your Numbers" play spots for fifty dollars times ten shall win a regular prize award of five hundred dollars;
(mm) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" or a "Star" symbol is revealed in ten of the "Your Numbers" play spots, or any combination thereof, for fifty dollars ten times shall win a regular prize award of five hundred dollars;
(nn) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by fifteen of "Your Numbers" or a "Star" symbol is revealed in fifteen of the "Your Numbers" play spots, or any combination thereof, for twenty dollars ten times, fifty dollars four times and one hundred dollars once shall win a regular prize award of five hundred dollars;
(oo) Holder of a valid winning ticket on which "20X" symbol is revealed in one of the "Your Numbers" play spots for twenty-five dollars times twenty shall win a regular prize award of five hundred dollars;
(pp) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for five hundred dollars once shall win a regular prize award of five hundred dollars;
(qq) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" or a "Star" symbol is revealed in ten of the "Your Numbers" play spots, or any combination thereof, for one hundred dollars ten times shall win a regular prize award of one thousand dollars;
(rr) Holder of a valid winning ticket on which "10X" symbol is revealed in one of the "Your Numbers" play spots for one hundred dollars times ten shall win a regular prize award of one thousand dollars;
(ss) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by twelve of "Your Numbers" or a "Star" symbol is revealed in twelve of the "Your Numbers" play spots, or any combination thereof, for fifty dollars four times and one hundred dollars eight times shall win a regular prize award of one thousand dollars;
(tt) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by twenty of "Your Numbers" or a "Star" symbol is revealed in twenty of the "Your Numbers" play spots, or any combination thereof, for fifty dollars twenty times shall win a regular prize award of one thousand dollars;
(uu) Holder of a valid winning ticket on which "20X" symbol is revealed in one of the "Your Numbers" play spots for fifty dollars times twenty shall win a regular prize award of one thousand dollars;
(vv) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" or a "Star" symbol is revealed in two of the "Your Numbers" play spots, or any combination thereof, for five hundred dollars two times shall win a regular prize award of one thousand dollars;
(ww) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for one thousand dollars once shall win a regular prize award of one thousand dollars;
(xx) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" or a "Star" symbol is revealed in ten of the "Your Numbers" play spots, or any combination thereof, for five hundred dollars ten times shall win a regular prize award of five thousand dollars;
(yy) Holder of a valid winning ticket on which "10X" symbol is revealed in one of the "Your Numbers" play spots for five hundred dollars times ten shall win a regular prize award of five thousand dollars;
(zz) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by sixteen of "Your Numbers" or a "Star" symbol is revealed in sixteen of the "Your Numbers" play spots, or any combination thereof, for five hundred dollars four times, one hundred dollars ten times and one thousand dollars two times shall win a regular prize award of five thousand dollars;
(aaa) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" or a "Star" symbol is revealed in five of the "Your Numbers" play spots, or any combination thereof, for one thousand dollars five times shall win a regular prize award of five thousand dollars;
(bbb) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for five thousand dollars once shall win a regular prize award of five thousand dollars;
(ccc) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" and a "TPD" prize symbol is revealed for five thousand five hundred dollars shall win a regular prize award of five thousand five hundred dollars, and, upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing for a chance to win the top prize award of five hundred thousand dollars before taxes;
(ddd) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" or a "Star" symbol is revealed in two of the "Your Numbers" play spots, or any combination thereof, for five thousand dollars two times shall win a regular prize award of ten thousand dollars;
(eee) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by fifteen of "Your Numbers" or a "Star" symbol is revealed in fifteen of the "Your Numbers" play spots, or any combination thereof, for one hundred dollars ten times, one thousand dollars four times and five thousand dollars once shall win a regular prize award of ten thousand dollars;
(fff) Holder of a valid winning ticket on which a "10X" symbol is revealed for one hundred dollars times ten and on which one or more of the "Winning Number" are matched by five of "Your Numbers" or a "Star" symbol is revealed in five of the "Your Numbers" play spots, or any combination thereof, for one hundred dollars four times and five thousand dollars once shall win a regular prize award of ten thousand dollars;
(ggg) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" or a "Star" symbol is revealed in ten of the "Your Numbers" play spots, or any combination thereof, for one thousand dollars ten times shall win a regular prize award of ten thousand dollars;
(hhh) Holder of a valid winning ticket on which "10X" symbol is revealed in one of the "Your Numbers" play spots for one thousand dollars times ten shall win a regular prize award of ten thousand dollars;
(iii) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by twenty of "Your Numbers" or a "Star" symbol is revealed in ten of the "Your Numbers" play spots, or any combination thereof, for five hundred dollars twenty times shall win a regular prize award of ten thousand dollars;
(jjj) Holder of a valid winning ticket on which "20X" symbol is revealed in one of the "Your Numbers" play spots for five hundred dollars times twenty shall win a regular prize award of ten thousand dollars;
(kkk) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for ten thousand dollars once shall win a regular prize award of ten thousand dollars;
(lll) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by twelve of "Your Numbers" or a "Star" symbol is revealed in twelve of the "Your Numbers" play spots, or any combination thereof, for five thousand dollars five times, one thousand dollars five times and ten thousand dollars two times shall win a regular prize award of fifty thousand dollars;
(mmm) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" or a "Star" symbol is revealed in ten of the "Your Numbers" play spots, or any combination thereof, for five thousand dollars ten times shall win a regular prize award of fifty thousand dollars;
(nnn) Holder of a valid winning ticket on which "10X" symbol is revealed in one of the "Your Numbers" play spots for five thousand dollars times ten shall win a regular prize award of fifty thousand dollars;
(ooo) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for fifty thousand dollars once shall win a regular prize award of fifty thousand dollars;
(ppp) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" or a "Star" symbol is revealed in ten of the "Your Numbers" play spots, or any combination thereof, for fifty thousand dollars ten times shall win a regular prize award of five hundred thousand dollars; and
(qqq) Holder of a valid winning ticket on one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for five hundred thousand dollars once shall win a regular prize award of five hundred thousand dollars.
(E) Number of prize awards. The number of prize awards in any sales cycle of game rule two hundred eighty-eight will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:
(1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance;
(2) Mathematical reasoning indicates that the number of winning tickets per four million tickets sold should be as follows:
(a) One ticket with the winning prize combination as set forth in paragraph (D)(2)(qqq) of this rule to win five hundred thousand dollars;
(b) One ticket with the winning prize combination as set forth in paragraph (D)(2)(ppp) of this rule to win five hundred thousand dollars;
(c) One ticket with the winning prize combination as set forth in paragraph (D)(2)(ooo) of this rule to win fifty thousand dollars;
(d) One ticket with the winning prize combination as set forth in paragraph (D)(2)(nnn) of this rule to win fifty thousand dollars;
(e) One ticket with the winning prize combination as set forth in paragraph (D)(2)(mmm) of this rule to win fifty thousand dollars;
(f) Two tickets with the winning prize combination as set forth in paragraph (D)(2)(lll) of this rule to win fifty thousand dollars;
(g) Two tickets with the winning prize combination as set forth in paragraph (D)(2)(kkk) of this rule to win ten thousand dollars;
(h) One ticket with the winning prize combination as set forth in paragraph (D)(2)(jjj) of this rule to win ten thousand dollars;
(i) Two tickets with the winning prize combination as set forth in paragraph (D)(2)(iii) of this rule to win ten thousand dollars;
(j) One ticket with the winning prize combination as set forth in paragraph (D)(2)(hhh) of this rule to win ten thousand dollars;
(k) Two tickets with the winning prize combination as set forth in paragraph (D)(2)(ggg) of this rule to win ten thousand dollars;
(l) One ticket with the winning prize combination as set forth in paragraph (D)(2)(fff) of this rule to win ten thousand dollars;
(m) Two tickets with the winning prize combination as set forth in paragraph (D)(2)(eee) of this rule to win ten thousand dollars;
(n) One ticket with the winning prize combination as set forth in paragraph (D)(2)(ddd) of this rule to win ten thousand dollars;
(o) Twenty tickets with the winning prize combination as set forth in paragraph (D)(2)(ccc) of this rule to win five thousand five hundred dollars, and upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing for a chance to win a top prize of five hundred thousand dollars;
(p) Four tickets with the winning prize combination as set forth in paragraph (D)(2)(bbb) of this rule to win five thousand dollars;
(q) Four tickets with the winning prize combination as set forth in paragraph (D)(2)(aaa) of this rule to win five thousand dollars;
(r) Eight tickets with the winning prize combination as set forth in paragraph (D)(2)(zz) of this rule to win five thousand dollars;
(s) Eight tickets with the winning prize combination as set forth in paragraph (D)(2)(yy) of this rule to win five thousand dollars;
(t) Eight tickets with the winning prize combination as set forth in paragraph (D)(2)(xx) of this rule to win five thousand dollars;
(u) Fifty tickets with the winning prize combination as set forth in paragraph (D)(2)(ww) of this rule to win one thousand dollars;
(v) Fifty tickets with the winning prize combination as set forth in paragraph (D)(2)(vv) of this rule to win one thousand dollars;
(w) One hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(uu) of this rule to win one thousand dollars;
(x) Fifty tickets with the winning prize combination as set forth in paragraph (D)(2)(tt) of this rule to win one thousand dollars;
(y) One hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(ss) of this rule to win one thousand dollars;

(F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.
(G) Frequency of prize drawings.
(1) Random imprinting of prize awards on all tickets issued in game rule two hundred eighty-eight shall be accomplished in a manner, which complies with the commission's rules and procedures.
(2) When a ticket issued in game rule two hundred eighty-eight is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule two hundred eighty-eight in which the ticket was sold.
(3) The Top Prize Drawing to award one grand prize of five hundred thousand dollars before taxes shall take place in accordance with rules and procedures established and approved by the director, and specifically, rule 3770:1-6-05 of the Administrative Code governing "Prize drawings" and rule 3770:1-6-01 of the Administrative Code governing "Special lottery drawings." Such drawings shall be held on dates determined and announced by the director, however, the earliest Top Prize Drawing date shall be one hundred eighty-one days from the game close date or when all tickets winning a prize value corresponding with a "TPD" symbol have been claimed, whichever is earlier.
(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.
(I) Validity of Tickets.
(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule two hundred eighty-eight void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.
(J) Director's conduct of game rule two hundred eighty-eight.
(1) The director shall conduct game rule two hundred eighty-eight and any promotions or drawings associated therewith in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule two hundred eighty-eight. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.
(2) Names and definitions of elements of game rule one hundred sixty used in this rule are to be used solely for purposes of this rule. In actual operation, game rule two hundred eighty-eight and these elements may be given names or titles chosen by the commission.
