  • (A) Title and term. Ohio lottery commission game rule number two hundred eighty-nine, "It Takes 2," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number two hundred eighty-nine.

    (B) General design.

    (1) Game rule number two hundred eighty-nine is a reveal a symbol game with a "multiplier" feature, and is generally known as an "instant lottery."

    (2) Holders of valid tickets will remove the covering off the entire play area to reveal ten symbols and ten corresponding prize values. If a player reveals a "Two" symbol within a game, the player wins the corresponding prize award shown for that game. If a player reveals a "Double Two" symbol within a game, the player wins double the corresponding prize award shown for that game. There are ten chances to win on each ticket and a player may win up to ten times.

    (3) The only "prize values" which shall appear on a ticket in game rule number two hundred eighty-nine are: one dollar, two dollars, three dollars, four dollars, five dollars, six dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars, five hundred dollars, and twenty thousand dollars. Numbers, prize values and play symbols appearing on any ticket in game rule number two hundred eighty-nine shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.

    (C) Price of tickets. The price of a ticket issued by the commission in game rule number two hundred eighty-nine shall be two dollars.

    (D) Structure, nature and value of prize awards.

    (1) There shall be one type of prize in game rule one hundred thirty nine, a "regular prize award."

    (2) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: two dollars, three dollars, four dollars, five dollars, six dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars, five hundred dollars, and twenty thousand dollars. Each ticket in game rule number two hundred eighty-nine shall be imprinted in such a way that prize awards from the set listed above may be won.

    (a) Holder of a valid winning ticket on which a "Double Two" symbol is revealed for one dollar doubled shall win a regular prize award of two dollars;

    (b) Holder of a valid winning ticket on which two "Two" symbols are revealed for one dollar two times shall win a regular prize award of two dollars;

    (c) Holder of a valid winning ticket on which a "Two" symbol is revealed two dollars once shall win a regular prize award of two dollars;

    (d) Holder of a valid winning ticket on which a "Double Two" symbol is revealed for one dollar doubled and on which a "Two" symbol is revealed for one dollar once shall win a regular prize award of three dollars;

    (e) Holder of a valid winning ticket on which three "Two" symbols are revealed for one dollar three times shall win a regular prize award of three dollars;

    (f) Holder of a valid winning ticket on which a "Two" symbol is revealed for three dollars once shall win a regular prize award of three dollars;

    (g) Holder of a valid winning ticket on which two "Two" symbols are revealed for one dollar once and two dollars once shall win a regular prize award of three dollars;

    (h) Holder of a valid winning ticket on which a "Two" symbol is revealed for four dollars once shall win a regular prize award of four dollars;

    (i) Holder of a valid winning ticket on which four "Two" symbols are revealed for one dollar four times shall win a regular prize award of four dollars;

    (j) Holder of a valid winning ticket on which a "Double Two" symbol is revealed for two dollars doubled shall win a regular prize award of four dollars;

    (k) Holder of a valid winning ticket on which a "Double Two" symbol is revealed for one dollar doubled and on which two "Two" symbols are revealed for two dollars once and one dollar once shall win a regular prize award of five dollars;

    (l) Holder of a valid winning ticket on which four "Two" symbols are revealed for one dollar three times and two dollars once shall win a regular prize award of five dollars;

    (m) Holder of a valid winning ticket on which five "Two" symbols are revealed for one dollar five times shall win a regular prize award of five dollars;

    (n) Holder of a valid winning ticket on which a "Two" symbol is revealed for five dollars once shall win a regular prize award of five dollars;

    (o) Holder of a valid winning ticket on which six "Two" symbols are revealed for one dollar six times shall win a regular prize award of six dollars;

    (p) Holder of a valid winning ticket on which a "Double Two" symbol is revealed for three dollars doubled shall win a regular prize award of six dollars;

    (q) Holder of a valid winning ticket on which three "Two" symbols is revealed for two dollars three times shall win a regular prize award of six dollars;

    (r) Holder of a valid winning ticket on which a "Two" symbol is revealed for six dollars once shall win a regular prize award of six dollars;

    (s) Holder of a valid winning ticket on which a "Two" symbol is revealed for two dollars once and on which a "Double Two" symbol is revealed for four dollars doubled shall win a regular prize award of ten dollars;

    (t) Holder of a valid winning ticket on which ten "Two" symbols are revealed for one dollar ten times shall win a regular prize award of ten dollars;

    (u) Holder of a valid winning ticket on which a "Double 2" symbol is revealed in for five dollars doubled shall win a regular prize award of ten dollars;

    (v) Holder of a valid winning ticket on which four "Two" symbols are revealed for two dollars three times and four dollars once shall win a regular prize award of ten dollars;

    (w) Holder of a valid winning ticket on which a "Two" symbol is revealed for ten dollars once shall win a regular prize award of ten dollars;

    (x) Holder of a valid winning ticket on which ten "Two" symbols are revealed for two dollars ten times shall win a regular prize award of twenty dollars;

    (y) Holder of a valid winning ticket on which two "Double 2" symbols are revealed for five dollars doubled two times times shall win a regular prize award of twenty dollars;

    (z) Holder of a valid winning ticket on which a "Double Two" symbol is revealed for ten dollars doubled shall win a regular prize award of twenty dollars;

    (aa) Holder of a valid winning ticket on which a "Two" symbol is revealed for twenty dollars once shall win a regular prize award of twenty dollars;

    (bb) Holder of a valid winning ticket on which ten "Two" symbols are revealed for five dollars ten times shall win a regular prize award of fifty dollars;

    (cc) Holder of a valid winning ticket on which a "Two" symbol is revealed in one game for ten dollars once and on which a "Double Two" symbol is revealed for twenty dollars doubled shall win a regular prize award of fifty dollars;

    (dd) Holder of a valid winning ticket on which a "Two" symbol is revealed for five dollars two times and on which a "Double Two" symbol is revealed for twenty dollars doubled shall win a regular prize award of fifty dollars;

    (ee) Holder of a valid winning ticket on which ten "Two" symbols are revealed for ten dollars three times, two dollars five times, and five dollars two times shall win a regular prize award of fifty dollars;

    (ff) Holder of a valid winning ticket on which five "Double Two" symbols are revealed for five dollars doubled five times shall win a regular prize award of fifty dollars;

    (gg) Holder of a valid winning ticket on which a "Two" symbol is revealed for fifty dollars once shall win a regular prize award of fifty dollars;

    (hh) Holder of a valid winning ticket on which ten "Two" symbols are revealed for ten dollars ten times shall win a regular prize award of one hundred dollars;

    (ii) Holder of a valid winning ticket on which ten "Double Two" symbols are revealed for five dollars doubled ten times shall win a regular prize award of one hundred dollars;

    (jj) Holder of a valid winning ticket on which a "Double Two" symbol is revealed for fifty dollars doubled shall win a regular prize award of one hundred dollars;

    (kk) Holder of a valid winning ticket on which a "Two" symbol is revealed for one hundred dollars once shall win a regular prize award of one hundred dollars;

    (ll) Holder of a valid winning ticket on which seven "Two" symbols are revealed for fifty dollars four times and one hundred dollars three times shall win a regular prize award of five hundred dollars;

    (mm) Holder of a valid winning ticket on which a "Double Two" symbol is revealed for one hundred dollars doubled and on which three "Two" symbols are revealed for one hundred dollars three times shall win a regular prize award of five hundred dollars;

    (nn) Holder of a valid winning ticket on which "Two" symbol is revealed for five hundred dollars once shall win a regular prize award of five hundred dollars; and

    (oo) Holder of a valid winning ticket on which a "Two" symbol is revealed for twenty thousand dollars once shall win a regular prize award of twenty thousand dollars.

    (E) Number of prize awards. The number of prize awards in any sales cycle of game rule number two hundred eighty-nine will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using techniques in order that the following occur:

    (1) Combinations winning each prize award are distributed throughout all tickets printed in any given ticket issuance; and

    (2) Mathematical reasoning indicates that the number of winning tickets per six million tickets sold in the following prize categories should be as follows:

    (a) Ten tickets with the winning prize combination as set forth in paragraph (D)(2)(oo) of this rule to win twenty thousand dollars;

    (b) Twenty-five tickets with the winning prize combination as set forth in paragraph (D)(2)(nn) of this rule to win five hundred dollars;

    (c) Fifty tickets with the winning prize combination as set forth in paragraph (D)(2)(mm) of this rule to win five hundred dollars;

    (d) Forty tickets with the winning prize combination as set forth in paragraph (D)(2)(ll) of this rule to win five hundred dollars;

    (e) Four hundred fifty tickets with the winning prize combination as set forth in paragraph (D)(2)(kk) of this rule to win one hundred dollars;

    (f) Two thousand two hundred fifty tickets with the winning prize combination as set forth in paragraph (D)(2)(jj) of this rule to win one hundred dollars;

    (g) Two thousand four hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(ii) of this rule to win one hundred dollars:

    (h) One thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(hh) of this rule to win one hundred dollars;

    (i) Two thousand two hundred fifty tickets with the winning prize combination as set forth in paragraph (D)(2)(gg) of this rule to win fifty dollars;

    (j) Three thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(ff) of this rule to win fifty dollars;

    (k) Two thousand two hundred fifty tickets with the winning prize combination as set forth in paragraph (D)(2)(ee) of this rule to win fifty dollars;

    (l) Three thousand seven hundred fifty tickets with the winning prize combination as set forth in paragraph (D)(2)(dd) of this rule to win fifty dollars;

    (m) Three thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(cc) of this rule to win fifty dollars;

    (n) Two thousand two hundred fifty tickets with the winning prize combination as set forth in paragraph (D)(2)(bb) of this rule to win fifty dollars;

    (o) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(aa) of this rule to win twenty dollars;

    (p) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(z) of this rule to win twenty dollars;

    (q) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(y) of this rule to win twenty dollars;

    (r) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(x) of this rule to win twenty dollars;

    (s) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(w) of this rule to win ten dollars;

    (t) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(v) of this rule to win ten dollars;

    (u) Forty-five thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(u) of this rule to win ten dollars;

    (v) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(t) of this rule to win ten dollars;

    (w) Thirty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(s) of this rule to win ten dollars;

    (x) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(r) of this rule to win six dollars;

    (y) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(q) of this rule to win six dollars;

    (z) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(p) of this rule to win six dollars;

    (aa) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(o) of this rule to win six dollars;

    (bb) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(n) of this rule to win five dollars;

    (cc) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(m) of this rule to win five dollars;

    (dd) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(l) of this rule to win five dollars;

    (ee) Fifteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(k) of this rule to win five dollars;

    (ff) Ninety thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(j) of this rule to win four dollars;

    (gg) Sixty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(i) of this rule to win four dollars;

    (hh) Thirty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(h) of this rule to win four dollars;

    (ii) One hundred twenty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(g) of this rule to win three dollars;

    (jj) Sixty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(f) of this rule to win three dollars;

    (kk) One hundred eighty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(e) of this rule to win three dollars;

    (ll) Two hundred forty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(d) of this rule to win three dollars;

    (mm) Thirty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(c) of this rule to win two dollars;

    (nn) Sixty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(b) of this rule to win two dollars; and

    (oo) One hundred fifty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(a) of this rule to win two dollars.

    (F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

    (G) Frequency of prize drawings.

    (1) Imprinting of prize awards on all tickets issued in game rule number two hundred eighty-nine shall be accomplished in a manner which complies with the commission's rules and procedures.

    (2) When a ticket issued in game rule number two hundred eighty-nine is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number two hundred eighty-nine in which the ticket was sold.

    (H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

    (I) Validity of tickets.

    (1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number two hundred eighty-nine void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

    (J) Director's conduct of game rule number two hundred eighty-nine.

    (1) The director shall conduct game rule number two hundred eighty-nine in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number two hundred eighty-nine. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

    (2) Names and definitions of elements of game rule number two hundred eighty-nine used in this rule are used solely for purposes of this rule. In actual operation, game rule number two hundred eighty-nine and these elements may be given names or titles chosen by the commission.
