3770:1-9-371. Game rule number three hundred seventy-one
-
(A) Title and term. Ohio lottery commission game rule number three hundred seventy-one, "Lifetime Riches," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number three hundred seventy-one.
(B) General design.
(1) Game rule number three hundred seventy-one is a key number match game with an additional instant win feature, and is generally known as an "instant lottery."
(2) Holders of valid tickets will remove the covering off the entire main play area to reveal six "Winning Numbers," fifteen "Your Numbers" and fifteen corresponding prize values. If the player matches any one or more of "Your Number(s)" to one or more of the "Winning Numbers(s)," the player wins the corresponding prize value shown below the matching "Your Numbers." If the player reveals a "Moneybag" symbol in any of the "Your Numbers" play spots, the player wins ten times its corresponding prize value automatically. If the player matches any one of "Your Number(s)" to any one of the "Winning Numbers," and the "Life" play symbol appears below the matching "Your Number," the player wins the "Life Prize" award (which is two hundred fifty thousand dollars a year before taxes until a minimum of seven million five hundred thousand dollars is reached, or for the life span of the prize winner, whichever is greater) or the elected cash-option prize award of approximately four million dollars in lieu of the "Life Prize" award. If a player matches any one of "Your Numbers" to one of the "Winning Numbers," and the corresponding prize value revealed is a "TPD" symbol, the player wins two thousand five hundred dollars automatically, and, upon the filing of a valid claim at an Ohio lottery commission office, shall also automatically be entered in the Top Prize Drawing ("TPD") to win the "Life Prize" award or the elected cash-option prize award of approximately four million dollars in lieu of the "Life Prize" award. The Top Prize Drawing shall be conducted in accordance with Ohio lottery rules and procedures established and approved by the director. The duration of the "Life Prize" award shall be determined by the prize winner's life span. If there is more than one prize winner of the "Life Prize" award, then all claimants shall only be entitled to the shared cash-option prize award. Subject to provisions of rule 3770:1-8-01(B)(6)(c), should the life span of the prize winner be less than thirty years, then the prize winner's beneficiary(ies) shall be entitled to continue receiving annual payments of two hundred fifty thousand dollars a year before taxes until seven million five hundred thousand dollars is reached. Should the "Life Prize" award be claimed by any "person" other than an individual (specifically; a corporation, limited liability company, business trust, estate, trust, partnership or association, etc.), such claimant(s) shall only be entitled to the cash-option prize award. Any claimant under eighteen years of age shall only be entitled to the cash-option prize award.
(3) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: twenty dollars, twenty-five dollars, fifty dollars, one hundred dollars, two hundred dollars, five hundred dollars, one thousand dollars, two thousand five hundred dollars, five thousand dollars, twenty thousand dollars and seven million five hundred thousand dollars (or the cash-option prize award of approximately four million dollars in lieu of the "Life Prize" award). Each ticket in game rule number three hundred seventy-one shall be imprinted in such a way that prize awards from the set listed above may be won.
(C) Price of tickets. The price of a ticket issued by the commission in game rule number three hundred seventy-one shall be twenty dollars.
(D) Structure, nature and value of prize awards.
(1) There shall be two types of prizes in game rule number three hundred seventy-one, a "regular prize award" and a "TPD" prize award.
(2) The only "prize values" which shall appear on a ticket in game rule number three hundred seventy-one are those listed as follows: five dollars, ten dollars, fifteen dollars, twenty dollars, twenty-five dollars, thirty dollars, forty dollars, fifty dollars, seventy-five dollars, one hundred dollars, two hundred dollars, five hundred dollars, one thousand dollars, two thousand dollars, the "TPD" symbol corresponding to a prize value of two thousand five hundred dollars, four thousand dollars, five thousand dollars, fifteen thousand dollars, twenty thousand dollars and a "Life Prize" award as described in Section (B)(2) of this Rule or the cash-option prize award of approximately four million dollars in lieu of the "Life Prize" award. Numbers, prize values and play symbols appearing on any ticket in game rule number three hundred seventy-one shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.
(a) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for twenty dollars once shall win a regular prize award of twenty dollars;
(b) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for five dollars once and fifteen dollars once shall win a regular prize award of twenty dollars;
(c) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by four of "Your Numbers" for five dollars four times shall win a regular prize award of twenty dollars;
(d) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for ten dollars two times shall win a regular prize award of twenty dollars;
(e) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by three of "Your Numbers" for five dollars two times and ten dollars once shall win a regular prize award of twenty dollars;
(f) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for twenty-five dollars once shall win a regular prize award of twenty-five dollars;
(g) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" for five dollars five times shall win a regular prize award of twenty-five dollars;
(h) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by four of "Your Numbers" for five dollars three times and ten dollars once shall win a regular prize award of twenty-five dollars;
(i) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by three of "Your Numbers" for five dollars once and ten dollars two times shall win a regular prize award of twenty-five dollars;
(j) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for ten dollars once and fifteen dollars once shall win a regular prize award of twenty-five dollars;
(k) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for fifty dollars once shall win a regular prize award of fifty dollars;
(l) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for twenty-five dollars two times shall win a regular prize award of fifty dollars;
(m) Holder of a valid winning ticket on which a "Moneybag" symbol is revealed in one of the "Your Numbers" play spots for five dollars ten times shall win a regular prize award of fifty dollars;
(n) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" for five dollars ten times shall win a regular prize award of fifty dollars;
(o) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" for ten dollars five times shall win a regular prize award of fifty dollars;
(p) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for one hundred dollars once shall win a regular prize award of one hundred dollars;
(q) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" for ten dollars ten times shall win a regular prize award of one hundred dollars;
(r) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by all fifteen of "Your Numbers" for five dollars ten times and ten dollars five times shall win a regular prize award of one hundred dollars;
(s) Holder of a valid winning ticket on which a "Moneybag" symbol is revealed in one of the "Your Numbers" play spots for ten dollars ten times shall win a regular prize award of one hundred dollars;
(t) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for fifty dollars two times shall win a regular prize award of one hundred dollars;
(u) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by four of "Your Numbers" for twenty-five dollars four times shall win a regular prize award of one hundred dollars;
(v) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for two hundred dollars once shall win a regular prize award of two hundred dollars;
(w) Holder of a valid winning ticket on which a "Moneybag" symbol is revealed in one of the "Your Numbers" play spots for twenty dollars ten times shall win a regular prize award of two hundred dollars;
(x) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by all fifteen of "Your Numbers" for ten dollars ten times and twenty dollars five times shall win a regular prize award of two hundred dollars;
(y) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" for forty dollars five times shall win a regular prize award of two hundred dollars;
(z) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for five hundred dollars once shall win a regular prize award of five hundred dollars;
(aa) Holder of a valid winning ticket on which a "Moneybag" symbol is revealed in one of the "Your Numbers" play spots for fifty dollars ten times shall win a regular prize award of five hundred dollars;
(bb) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" for seventy-five dollars four times and two hundred dollars once shall win a regular prize award of five hundred dollars;
(cc) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by all fifteen of "Your Numbers" for twenty-five dollars ten times and fifty dollars five times shall win a regular prize award of five hundred dollars;
(dd) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by fourteen of "Your Numbers" for thirty dollars ten times and fifty dollars four times shall win a regular prize award of five hundred dollars;
(ee) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for one thousand dollars once shall win a regular prize award of one thousand dollars;
(ff) Holder of a valid winning ticket on which a "Moneybag" symbol is revealed in one of the "Your Numbers" play spots for one hundred dollars ten times shall win a regular prize award of one thousand dollars;
(gg) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" for one hundred dollars ten times shall win a regular prize award of one thousand dollars;
(hh) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" and a "TPD" prize symbol is revealed for two thousand five hundred dollars shall win a regular prize award of two thousand five hundred dollars, and, upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing to win the "Life Prize" award as described in Section (B)(2) of this Rule, or the cash-option prize award of approximately four million dollars in lieu of the "Life Prize" award;
(ii) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for five thousand dollars once shall win a regular prize award of five thousand dollars;
(jj) Holder of a valid winning ticket on which a "Moneybag" symbol is revealed in one of the "Your Numbers" play spots for five hundred dollars ten times shall win a regular prize award of five thousand dollars;
(kk) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" for one thousand dollars five times shall win a regular prize award of five thousand dollars;
(ll) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by three of "Your Numbers" for one thousand dollars once and two thousand dollars two times shall win a regular prize award of five thousand dollars;
(mm) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for twenty thousand dollars once shall win a regular prize award of twenty thousand dollars;
(nn) Holder of a valid winning ticket on which a "Moneybag" symbol is revealed in one of the "Your Numbers" play spots for two thousand dollars ten times shall win a regular prize award of twenty thousand dollars;
(oo) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by six of "Your Numbers" for one thousand dollars five times and fifteen thousand dollars once shall win a regular prize award of twenty thousand dollars;
(pp) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" for four thousand dollars five times shall win a regular prize award of twenty thousand dollars; and
(qq) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" and the corresponding prize value revealed is the "Life" symbol, shall win a regular prize award of a "Life Prize" award as described in Section (B)(2) of this Rule, or the cash option prize award of approximately four million dollars in lieu of the "Life Prize" award.
(E) Number of prize awards. The number of prize awards in any sales cycle of game rule number three hundred seventy-one will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that:
(1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and
(2) Mathematical reasoning indicates that the number of winning tickets per five million two hundred thousand tickets sold should be as follows:
(a) Two tickets matching numbers for the "Life Prize" award as described in Section (B)(2) of this Rule, or the cash-option prize award of approximately four million dollars in lieu of the "Life Prize" award;
(b) Three tickets matching numbers for four thousand dollars five times to win twenty thousand dollars;
(c) Three tickets matching numbers for one thousand dollars five times and fifteen thousand dollars once to win twenty thousand dollars;
(d) Three tickets revealing the "Moneybag" symbol for two thousand dollars ten times to win twenty thousand dollars;
(e) Three tickets matching numbers for twenty thousand dollars once to win twenty thousand dollars;
(f) Fifteen tickets matching numbers for one thousand dollars once and two thousand dollars two times to win five thousand dollars;
(g) Fifteen tickets matching numbers for one thousand dollars five times to win five thousand dollars;
(h) Fifteen tickets revealing the "Moneybag" symbol for five hundred dollars ten times to win five thousand dollars;
(i) Fifteen tickets matching numbers for five thousand dollars once to win five thousand dollars;
(j) Twenty tickets matching numbers for one hundred dollars ten times to win one thousand dollars;
(k) Twenty tickets revealing the "Moneybag" symbol for one hundred dollars ten times to win one thousand dollars; and
(l) Twenty tickets matching numbers for one thousand dollars once to win one thousand dollars.
(3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:
(a) One ticket revealing a "TPD" prize symbol to win two thousand five hundred dollars, and, upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing to win a "Life Prize" award as described in Section (B)(2) of this Rule, or the cash-option prize award of approximately four million dollars in lieu of the "Life Prize" award;
(b) Ten tickets matching numbers for thirty dollars ten times and fifty dollars four times to win five hundred dollars;
(c) One hundred tickets matching numbers for twenty-five dollars ten times and fifty dollars five times to win five hundred dollars;
(d) One hundred tickets matching numbers for seventy-five dollars four times and two hundred dollars once to win five hundred dollars;
(e) One hundred tickets revealing the "Moneybag" symbol for fifty dollars ten times to win five hundred dollars;
(f) One hundred tickets matching numbers for five hundred dollars once to win five hundred dollars;
(g) Two hundred tickets matching numbers for forty dollars five times to win two hundred dollars;
(h) Two hundred tickets matching numbers for ten dollars ten times and twenty dollars five times to win two hundred dollars;
(i) Two hundred tickets revealing the "Moneybag" symbol for twenty dollars ten times to win two hundred dollars;
(j) Two hundred tickets matching numbers for two hundred dollars once to win two hundred dollars;
(k) Five hundred tickets matching numbers for twenty-five dollars four times to win one hundred dollars;
(l) One thousand tickets matching numbers for fifty dollars two times to win one hundred dollars;
(m) One thousand tickets revealing the "Moneybag" symbol for ten dollars ten times to win one hundred dollars;
(n) One thousand tickets matching numbers for five dollars ten times and ten dollars five times to win one hundred dollars;
(o) One thousand tickets matching numbers for ten dollars ten times to win one hundred dollars;
(p) One thousand tickets matching numbers for one hundred dollars once to win one hundred dollars;
(q) Two thousand tickets matching numbers for ten dollars five times to win fifty dollars;
(r) Two thousand tickets matching numbers for five dollars ten times to win fifty dollars;
(s) Three thousand one hundred tickets revealing the "Moneybag" symbol for five dollars ten times to win fifty dollars;
(t) Two thousand tickets matching numbers for twenty-five dollars two times to win fifty dollars;
(u) Two thousand tickets matching numbers for fifty dollars once to win fifty dollars;
(v) Two thousand five hundred tickets matching numbers for ten dollars once and fifteen dollars once to win twenty-five dollars;
(w) Two thousand five hundred tickets matching numbers for five dollars once and ten dollars two times to win twenty-five dollars;
(x) Two thousand five hundred tickets matching numbers for five dollars three times and ten dollars once to win twenty-five dollars;
(y) Two thousand five hundred tickets matching numbers for five dollars five times to win twenty-five dollars;
(z) Three thousand tickets matching numbers for twenty-five dollars once to win twenty-five dollars;
(aa) Eight thousand tickets matching numbers for five dollars two times and ten dollars once to win twenty dollars;
(bb) Eight thousand tickets matching numbers for ten dollars two times to win twenty dollars;
(cc) Eight thousand tickets matching numbers for five dollars four times to win twenty dollars;
(dd) Four thousand tickets matching numbers for five dollars once and fifteen dollars once to win twenty dollars; and
(ee) Four thousand tickets matching numbers for twenty dollars once to win twenty dollars.
(F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.
(G) Frequency of prize drawings.
(1) Random imprinting of prize awards on all tickets issued in game rule number three hundred seventy-one shall be accomplished in a manner which complies with the commission's rules and procedures.
(2) When a ticket issued in game rule number three hundred seventy-one is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number three hundred seventy-one in which the ticket was sold.
(3) The Top Prize Drawing to award one grand prize of a "Life Prize" award as described in Section (B)(2) of this Rule, or the cash-option prize award of approximately four million dollars in lieu of the "Life Prize" award, shall take place in accordance with rules and procedures established and approved by the director, and specifically, rule 3770:1-6-05 of the Administrative Code governing"Prize drawings" and rule 3770:1-6-01 of the Administrative Code governing"Special lottery drawings." Such drawings shall be held on dates determined and announced by the director, however, the earliest Top Prize Drawing date shall be one hundred eighty days from the game close date or when all tickets winning a prize value corresponding with a "TPD" symbol have been claimed, whichever is earlier.
(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by agents of tickets winning prize awards which are to be paid by agents in accordance with commission rules, as well as procedures for entry into the Top Prize Drawings described in Section (G)(3) of this Rule. Prize awards shall be claimed within the time limits set forth by commission rules.
(I) Validity of tickets.
(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number three hundred seventy-one void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.
(J) Director's conduct of game rule number three hundred seventy-one.
(1) The director shall conduct game rule number three hundred seventy-one in a manner consistent with the Lottery Act, the rules of the commission, including without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number three hundred seventy-one. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.
(2) Names and definitions of elements of game rule number three hundred seventy-one used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number three hundred seventy-one and these elements may be given names or titles chosen by the commission.
