  • (A) Title and term. Ohio lottery commission game rule number four hundred fifty-nine,"Double Doubler," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number four hundred fifty-nine.

    (B) General design.

    (1) Game rule number four hundred fifty-nine is a match three of six lottery game with a "Double" feature and a "Double Doubler" feature, and is generally known as an "instant lottery."

    (2) The player will remove the covering over the play area to reveal six prize values or five prize values and a "Star" play symbol. If three of the six prize values revealed match, or if two of the six prize values revealed match and a "Star" symbol is revealed, the player wins the matched prize value. The player will then remove the covering over the "Your Prize Level" play area to reveal a"Single Prize" level symbol, "Double Prize" level symbol or a "Double Doubler Prize" level symbol. A "Double" prize level symbol increases the matched prize amount by a factor of two. A "Double Doubler" prize level symbol increases the matched prize amount by a factor of four.

    (3) As used in this rule, "prize award" shall mean one of the following monetary amounts which is the total of all winning prize values appearing on the ticket: one dollar, two dollars, four dollars, five dollars, eight dollars, twenty dollars, fifty dollars, one hundred dollars, two hundred dollars, two thousand five hundred dollars and ten thousand dollars. Each ticket in game rule number four hundred fifty-nine shall be imprinted in such a way that prize awards from the set listed above may be won.

    (C) Price of tickets. The price of a ticket issued by the commission in game rule number four hundred fifty-nine shall be one dollar.

    (D) Structure, nature and value of prize awards.

    (1) There shall be one type of prize in game rule number four hundred fifty-nine called a "regular prize award."

    (2) The only "prize values" which shall appear on a ticket in game rule number four hundred fifty-nine are: one dollar, two dollars, five dollars, twenty-five dollars, fifty dollars, one hundred dollars and two thousand five hundred dollars. Prize values, play symbols and prize levels shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying prize values, play symbols and prize levels.

    (a) Holder of a valid winning ticket on which three of the prize values revealed are one dollar and the "Your Prize Level" play area contains a"Single" symbol shall win a regular prize award of one dollar;

    (b) Holder of a valid winning ticket on which two of the prize values revealed are one dollar, a "Star" symbol is revealed and the "Your Prize Level" play area contains a "Single" symbol shall win a regular prize award of one dollar;

    (c) Holder of a valid winning ticket on which three of the prize values revealed are two dollars and the "Your Prize Level" play area contains a"Single" symbol shall win a regular prize award of two dollars;

    (d) Holder of a valid winning ticket on which two of the prize values revealed are two dollars, a "Star" symbol is revealed and the "Your Prize Level" play area contains a "Single" symbol shall win a regular prize award of two dollars;

    (e) Holder of a valid winning ticket on which three of the prize values revealed are two dollars and the "Your Prize Level" play area contains a"Double" symbol shall win a regular prize award of four dollars;

    (f) Holder of a valid winning ticket on which two of the prize values revealed are two dollars, a "Star" symbol is revealed and the "Your Prize Level" play area contains a "Double" symbol shall win a regular prize award of four dollars;

    (g) Holder of a valid winning ticket on which three of the prize values revealed are one dollar and the "Your Prize Level" play area contains a"Double Doubler" symbol shall win a regular prize award of four dollars;

    (h) Holder of a valid winning ticket on which three of the prize values revealed are five dollars and the "Your Prize Level" play area contains a "Single" symbol shall win a regular prize award of five dollars;

    (i) Holder of a valid winning ticket on which two of the prize values revealed are five dollars, a "Star" symbol is revealed and the "Your Prize Level" play area contains a "Single" symbol shall win a regular prize award of five dollars;

    (j) Holder of a valid winning ticket on which three of the prize values revealed are two dollars and the "Your Prize Level" play area contains a"Double Doubler" symbol shall win a regular prize award of eight dollars;

    (k) Holder of a valid winning ticket on which two of the prize values revealed are two dollars, a "Star" symbol is revealed and the "Your Prize Level" play area contains a "Double Doubler" symbol shall win a regular prize award of eight dollars;

    (l) Holder of a valid winning ticket on which three of the prize values revealed are five dollars and the "Your Prize Level" play area contains a "Double Doubler" symbol shall win a regular prize award of twenty dollars;

    (m) Holder of a valid winning ticket on which two of the prize values revealed are five dollars, a "Star" symbol is revealed and the "Your Prize Level" play area contains a "Double Doubler" symbol shall win a regular prize award of twenty dollars;

    (n) Holder of a valid winning ticket on which three of the prize values revealed are twenty-five dollars and the "Your Prize Level" play area contains a "Double" symbol shall win a regular prize award of fifty dollars;

    (o) Holder of a valid winning ticket on which two of the prize values revealed are twenty-five dollars, a "Star" symbol is revealed and the "Your Prize Level" play area contains a "Double" symbol shall win a regular prize award of fifty dollars;

    (p) Holder of a valid winning ticket on which three of the prize values revealed are fifty dollars and the "Your Prize Level" play area contains a "Single" symbol shall win a regular prize award of fifty dollars;

    (q) Holder of a valid winning ticket on which two of the prize values revealed are fifty dollars, a "Star" symbol is revealed and the "Your Prize Level" play area contains a "Single" symbol shall win a regular prize award of fifty dollars;

    (r) Holder of a valid winning ticket on which three of the prize values revealed are twenty-five dollars and the "Your Prize Level" play area contains a "Double Doubler" symbol shall win a regular prize award of one hundred dollars;

    (s) Holder of a valid winning ticket on which two of the prize values revealed are twenty-five dollars, a "Star" symbol is revealed and the "Your Prize Level" play area contains a "Double Doubler" symbol shall win a regular prize award of one hundred dollars;

    (t) Holder of a valid winning ticket on which two of the prize values revealed are one hundred dollars, a "Star" symbol is revealed and the "Your Prize Level" play area contains a "Single" symbol shall win a regular prize award of one hundred dollars;

    (u) Holder of a valid winning ticket on which three of the prize values revealed are fifty dollars and the "Your Prize Level" play area contains a "Double Doubler" symbol shall win a regular prize award of two hundred dollars;

    (v) Holder of a valid winning ticket on which two of the prize values revealed are fifty dollars, a "Star" symbol is revealed and the "Your Prize Level" play area contains a "Double Doubler" symbol shall win a regular prize award of two hundred dollars;

    (w) Holder of a valid winning ticket on which three of the prize values revealed are two thousand five hundred dollars and the "Your Prize Level" play area contains a "Single" symbol shall win a regular prize award of two thousand five hundred dollars;

    (x) Holder of a valid winning ticket on which two of the prize values revealed are two thousand five hundred dollars, a "Star" symbol is revealed and the "Your Prize Level" play area contains a "Single" symbol shall win a regular prize award of two thousand five hundred dollars;

    (y) Holder of a valid winning ticket on which three of the prize values revealed are two thousand five hundred dollars and the "Your Prize Level" play area contains a "Double Doubler" symbol shall win a regular prize award of ten thousand dollars; and

    (z) Holder of a valid winning ticket on which two of the prize values revealed are two thousand five hundred dollars, a "Star" symbol is revealed and the "Your Prize Level" play area contains a "Double Doubler" symbol shall win a regular prize award of ten thousand dollars.

    (E) Number of prize awards. The number of prize awards in any sales cycle of game rule number four hundred fifty-nine will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that:

    (1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

    (2) Mathematical reasoning indicates that the number of winning tickets per twenty million tickets sold in the following categories should be as follows:

    (a) Forty tickets matching two thousand five hundred dollars two times and revealing a "Star" symbol and a "Double Doubler" prize level to win ten thousand dollars;

    (b) Forty tickets matching two thousand five hundred dollars three times and revealing a "Double Doubler" prize level to win ten thousand dollars;

    (c) Thirty tickets matching two thousand five hundred dollars two times and revealing a "Star" symbol and a "Single" prize level to win two thousand five hundred dollars;

    (d) Forty tickets matching two thousand five hundred dollars three times and revealing a "Single" prize level to win two thousand five hundred dollars;

    (e) One hundred tickets matching fifty dollars two times and revealing a"Star" symbol and a "Double Doubler" prize level to win two hundred dollars; and

    (f) One hundred tickets matching fifty dollars three times and revealing a"Double Doubler" prize level to win two hundred dollars.

    (3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, and average number of winning tickets per two hundred thousand tickets sold should be as follows:

    (a) Ten tickets matching one hundred dollars two times and revealing a "Star" symbol and a "Single" prize level to win one hundred dollars;

    (b) Ten tickets matching twenty-five dollars two times and revealing a "Star" symbol and a "Double Doubler" prize level to win one hundred dollars;

    (c) Twenty tickets matching twenty-five dollars three times and revealing a"Double Doubler" prize level to win one hundred dollars;

    (d) One hundred tickets matching fifty dollars two times and revealing a"Star" symbol and a "Single" prize level to win fifty dollars;

    (e) One hundred tickets matching fifty dollars three times and revealing a"Single" prize level to win fifty dollars;

    (f) One hundred tickets matching twenty-five dollars two times and revealing a "Star" symbol and a "Double" prize level to win fifty dollars;

    (g) One hundred tickets matching twenty-five dollars three times and revealing a "Double" prize level to win fifty dollars;

    (h) Two hundred fifty tickets matching five dollars two times and revealing a"Star" symbol and a "Double Doubler" prize level to win twenty dollars;

    (i) Two hundred fifty tickets matching five dollars three times and revealing a"Double Doubler" prize level to win twenty dollars;

    (j) One thousand five hundred tickets matching two dollars two times and revealing a "Star" symbol and a "Double Doubler" prize level to win eight dollars;

    (k) Five hundred tickets matching two dollars three times and revealing a"Double Doubler" prize level to win eight dollars;

    (l) Seven hundred fifty tickets matching five dollars two times and revealing a"Star" symbol and a "Single" prize level to win five dollars;

    (m) Two hundred fifty tickets matching five dollars three times and revealing a "Single" prize level to win five dollars;

    (n) One thousand tickets matching one dollar three times and revealing a"Double Doubler" prize level to win four dollars;

    (o) Five hundred tickets matching two dollars two times and revealing a"Star" symbol and a "Double" prize level to win four dollars;

    (p) Five hundred tickets matching two dollars three times and revealing a"Double" prize level to win four dollars;

    (q) Nine thousand tickets matching two dollars two times and revealing a"Star" symbol and a "Single" prize level to win two dollars;

    (r) Five thousand tickets matching two dollars three times and revealing a"Single" prize level to win two dollars;

    (s) Fourteen thousand tickets matching one dollar two times and revealing a"Star" symbol and a "Single" prize level to win one dollar; and

    (t) Seven thousand tickets matching one dollar three times and revealing a"Single" prize level to win one dollar.

    (F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

    (G) Frequency of prize drawings.

    (1) Random imprinting of prize awards on all tickets issued in game rule number four hundred fifty-nine shall be accomplished in a manner which complies with the commission's rules and procedures.

    (2) When a ticket issued in game rule number four hundred fifty-nine is sold or deemed sold in accordance with this rule and the covering material over the prize values, play symbols and prize levels has been removed, the holder shall be deemed to have drawn the prize values, play symbols and prize levels on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number four hundred fifty-nine in which the ticket was sold.

    (H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prizes which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

    (I) Validity of tickets.

    (1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number four hundred fifty-nine void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

    (J) Director's conduct of game rule number four hundred fifty-nine.

    (1) The director shall conduct game rule number four hundred fifty-nine in a manner consistent with the Lottery Act, the rules of the commission, including without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number four hundred fifty-nine. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

    (2) Names and definitions of elements of game rule number four hundred fifty-nine used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number four hundred fifty-nine and these elements may be given names or titles chosen by the commission.
