3770:1-9-51. Game rule number fifty-one

(A) Title and term. Ohio lottery commission game rule number fifty-one, "Raffle Ticket Game," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period beginning on the date when raffle ticket sales are commenced and continuing through the date established by the director as the final sales date.
(B) General design.
(1) Game rule number fifty-one is a "raffle" style lottery game of the type generally known as an integer match game.
(2) Each raffle ticket in game rule number fifty-one shall be imprinted with one integer as generated from the computer gaming system, and recorded on the ticket at the time of purchase. The auto pick, "Play It Again" and multi-draw wagering features are not available for any raffle games. The integer shall be within the parameters of integers established by the director for each raffle game. For each raffle game under game rule number fifty-one, the director may establish a maximum number of raffle tickets that can be sold or designate the game to have no maximum number of tickets that can be sold. If the director establishes a maximum number of tickets that can be sold in the game, the maximum number of raffle tickets as predetermined by the director shall be the maximum range of integers that will be printed on a raffle ticket. There shall be one integer printed on each raffle ticket, and an integer will not be repeated on another raffle ticket. A raffle ticket shall only be valid for the specified raffle game. A raffle ticket may not be canceled once the raffle ticket is printed by the lottery terminal, even if such raffle ticket is printed in error. The director shall establish the prizes to be awarded for each raffle game prior to the start of such raffle game.
(3) At such times as determined by the director, raffle drawings will be conducted during which integers shall be selected at random from the total number of raffle tickets sold for that raffle game. The drawing method to select such integers shall be determined by the director.
A holder of a valid winning ticket for a given raffle drawing bearing the integer drawn in that drawing, shall be entitled to a prize award established by the director for that raffle game.
(C) Price of tickets. The price of a raffle ticket issued by the commission in game rule number fifty-one shall be the price as established by the director prior to the start of each raffle game.
(D) Value of prize awards. The director shall establish the number of prizes and prize amounts to be awarded per raffle game prior to the start of such raffle game. The type of prizes shall be awarded based upon the order of the integers drawn in accordance with commission rules, regulations and procedures for each raffle game.
(E) Frequency of raffle drawings. Raffle drawings shall be held at dates and times determined by the director. In games where a maximum number of tickets that can be sold is established by the director, if the maximum number of raffle tickets established by the director for a drawing in game rule number fifty-one are sold prior to the final sales date established by the director, the director may, in his discretion, hold the raffle drawing prior to the final sales date. If the maximum number of raffle tickets established by the director for a drawing in game rule number fifty-one are not sold prior to the final sales date established by the director, the director may, in his discretion, extend the final sales date and hold the raffle drawing after any extended final sales date.
(F) Manner of raffle drawings.
(1) Raffle drawings shall be open to the public and may be held at such places in the state that the director shall determine. The director shall inform the public as to the time and place of each raffle drawing.
(2) Each holder of a valid ticket for a given raffle drawing is eligible to win in that raffle drawing. If the holder of a winning raffle ticket does not have the raffle ticket fully validated and the prize is not claimed and presented for payment within one hundred eighty days after the date of the raffle drawing, in accordance with the procedures set forth in lottery rules, such unclaimed prize shall be paid into the state lottery fund and distributed in accordance with section 3770.06 of the Revised Code.
(3) All raffle drawings in game rule number fifty-one will be conducted in accordance with random drawing procedures approved by the director. For every raffle drawing in game rule number fifty-one, the director will approve procedures and mechanisms for the selection of winners and the awarding of prizes in order that random selection by the on-line computer system will be achieved.
(4) Valid prize winners are determined by the integers drawn and not the integers reported. The lottery shall not be responsible for game rule number fifty-one integers reported in error.
(G) Validity of tickets.
(1) Each purchaser of raffle tickets in game rule number fifty-one shall be responsible for verifying the information on each raffle ticket. The lottery shall have no liability to a purchaser who fails to verify the information on each raffle ticket.
(2) A raffle ticket may not be canceled once printed by the lottery terminal, even if the raffle ticket is printed in error. The lottery shall be free of any liability in connection with this paragraph.
(3) Each raffle ticket issued in game rule number fifty-one shall have imprinted thereon at the time of purchase a control number, bar code data, or both, supplied by the commission. No prize shall be paid by the commission for any raffle tickets without such control number or bar code data.
(4) All winning raffle tickets in game rule number fifty-one are subject to validation by the on-line computer system under procedures established by the director before the payment of any prize.
(5) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a raffle ticket in game rule number fifty-one void if it is stolen, not sold or deemed not sold in accordance with commission rules; if it is illegible, altered, mutilated, or counterfeit; or if the raffle ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a raffle ticket declared void, if any, is limited to refund of the retail sales price of the raffle ticket.
(H) Director's conduct of game rule number fifty-one.
(1) The director shall conduct game rule number fifty-one in a manner consistent with the Lottery Act, the rules of the commission, including without limitation this rule, and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this raffle style lottery game.
(2) Names and definitions of elements of game rule number fifty-one used in this rule are considered generic terms used solely for the purpose of this rule. In actual operation, game rule number fifty-one and these elements may be given names or titles chosen by the commission.
