3770:1-9-602. Game rule number six hundred two
-
(A) Title and term. Ohio lottery commission game rule number six hundred two, "Cash for Life ," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number six hundred two.
(B) General design.
(1) Game rule number six hundred two is a key number match game and is generally known as an "instant lottery."
(2) Holders of valid tickets will remove the covering off the entire play area to reveal three "Winning Numbers," fifteen "Your Numbers" and fifteen corresponding prize values. If any one or more of "Your Number(s)" matches one or more of the "Winning Numbers," the player wins the corresponding prize value(s) shown below the matching "Your Number(s)." If the player matches any one of "Your Numbers" to a "Winning Number" and the corresponding prize revealed below the matching "Your Number" is a "Life" symbol, the player wins the "Life Prize Award" (which is twenty-five thousand dollars per year for life (before taxes) until a minimum of seven hundred fifty thousand dollars (before taxes) is reached, or for the life span of the original prize winner, whichever is greater) or the "Elected Cash-Option Prize Award" of approximately three hundred thousand dollars (before taxes) in lieu of the "Life Prize Award." If the player matches any one of "Your Numbers" to one of the "Winning Numbers" and the corresponding prize revealed below the matching "Your Number" is a "TPD" symbol, the player wins one thousand dollars automatically, and, upon the filing of a valid claim at an Ohio lottery commission office, shall also be automatically entered in the Top Prize Drawing ("TPD") to win the "Life Prize Award" as described in Section (B)(2) herein or approximately three hundred thousand dollars (before taxes) in lieu of the "Life Prize Award." The Top Prize Drawing shall be conducted in accordance with Ohio lottery rules and procedures established and approved by the director. The duration of the "Life Prize Award" shall be determined by the original prize winner's life span. If there is more than one prize winner of the "Life Prize Award," then all claimants shall only be entitled to share the cash-option prize award. Should the life span of the originally designated winner be less than thirty years, then the prize winner's beneficiary(ies) shall be entitled to continue receiving annual payments of twenty-five thousand dollars a year (before taxes) until seven hundred fifty thousand dollars is reached. Should the "Life Prize Award" be claimed by any "person" other than an individual (specifically; a corporation, limited liability company, business trust, estate, trust, partnership or association, etc.) such claimant(s) shall only be entitled to the cash-option prize award. Any claimant under eighteen years of age shall only be entitled to the cash-option award. There are fifteen chances to win on each ticket, and a player may win up to fifteen times on one ticket
(3) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: five dollars, ten dollars, fifteen dollars, twenty dollars, forty dollars, fifty dollars, one hundred dollars, five hundred dollars, one thousand dollars, two thousand dollars, five thousand dollars, ten thousand dollars, fifty thousand dollars and a "Life Prize Award" as described in Section (B)(2) of this rule or the "Elected Cash-Option Prize Award" of approximately three hundred thousand dollars (before taxes) in lieu of the "Life Prize Award." Each ticket in game rule number six hundred two shall be imprinted in such a way that prize awards from the set listed above may be won.
(C) Price of tickets. The price of a ticket issued by the commission in game rule number six hundred two shall be five dollars.
(D) Structure, nature and value of prize awards.
(1) There shall be three types of prizes in game rule number six hundred two, a "regular prize award," a "Life Prize Award" and a "TPD" prize award.
(2) The only "prize values" which shall appear on a ticket in game rule number six hundred two are: one dollar, two dollars, three dollars, four dollars, five dollars, ten dollars, fifteen dollars, twenty dollars, forty dollars, fifty dollars, one hundred dollars, five hundred dollars, the "TPD" symbol corresponding to a prize value of one thousand dollars, two thousand dollars, five thousand dollars, ten thousand dollars, fifty thousand dollars and a "Life Prize" as described in Section (B)(2) of this rule or the "Elected Cash-Option Prize Award" of approximately three hundred thousand dollars (before taxes) in lieu of the "Life Prize Award." Numbers, prize values and play symbols appearing on any ticket in game rule number six hundred two shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.
(a) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for five dollars one time shall win a regular prize award of five dollars;
(b) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" for one dollar five times shall win a regular prize award of five dollars;
(c) Holder of a valid winning ticket on which one or more of "Winning Numbers" are matched by ten of "Your Numbers" for one dollar ten times shall win a regular prize award of ten dollars;
(d) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" for two dollars five times shall win a regular prize award of ten dollars;
(e) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for five dollars two times shall win a regular prize award of ten dollars;
(f) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by four of "Your Numbers" for one dollar one time, two dollars two times and five dollars one time shall win a regular prize award of ten dollars;
(g) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for ten dollars one time shall win a regular prize award of ten dollars;
(h) Holder of a valid winning ticket on which one or more of the "Winning Numbers" is matched by three of "Your Numbers" for five dollars three times shall win a regular prize award of fifteen dollars;
(i) Holder of a valid winning ticket on which one or more of the "Winning Numbers" is matched by ten of "Your Numbers" for one dollar five times and two dollars five times shall win a regular prize award of fifteen dollars;
(j) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by all fifteen of "Your Numbers" for one dollar fifteen times shall win a regular prize award of fifteen dollars;
(k) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" for three dollars five times shall win a regular prize award of fifteen dollars;
(l) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for fifteen dollars one time shall win a regular prize award of fifteen dollars;
(m) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" for four dollars five times shall win a regular prize award of twenty dollars;
(n) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for ten dollars two times shall win a regular prize award of twenty dollars;
(o) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by all fifteen of "Your Numbers" for one dollar ten times and two dollars five times shall win a regular prize award of twenty dollars;
(p) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for twenty dollars one time shall win a regular prize award of twenty dollars;
(q) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by seven of "Your Numbers" for five dollars six times and ten dollars one time shall win a regular prize award of forty dollars;
(r) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by nine of "Your Numbers" for four dollars five times and five dollars four times shall win a regular prize award of forty dollars;
(s) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by six of "Your Numbers" for five dollars five times and fifteen dollars one time shall win a regular prize award of forty dollars;
(t) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by all fifteen of "Your Numbers" for one dollar eight times, two dollars one time and five dollars six times shall win a regular prize award of forty dollars;
(u) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for forty dollars one time shall win a regular prize award of forty dollars;
(v) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" for five dollars ten times shall win a regular prize award of fifty dollars;
(w) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" for ten dollars five times shall win a regular prize award of fifty dollars;
(x) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for fifty dollars one time shall win a regular prize award of fifty dollars;
(y) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by six of "Your Numbers" for ten dollars five times and fifty dollars one time shall win a regular prize award of one hundred dollars;
(z) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for one hundred dollars one time shall win a regular prize award of one hundred dollars;
(aa) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by seven of "Your Numbers" for five dollars four times, ten dollars one time, twenty dollars one time and fifty dollars one time shall win a regular prize award of one hundred dollars;
(bb) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by all fifteen of "Your Numbers" for two dollars ten times, five dollars two times, ten dollars two times and fifty dollars one time shall win a regular prize award of one hundred dollars;
(cc) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for five hundred dollars one time shall win a regular prize award of five hundred dollars;
(dd) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" for one hundred dollars five times shall win a regular prize award of five hundred dollars;
(ee) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by all fifteen of "Your Numbers" for twenty dollars ten times, fifty dollars four times and one hundred dollars one time shall win a regular prize award of five hundred dollars;
(ff) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" and a "TPD" prize symbol is revealed for one thousand dollars shall win a regular prize award of one thousand dollars, and, upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing to win a grand prize of a "Life Prize Award" as described in Section (B)(2) of this rule or the "Elected Cash-Option Prize Award" of approximately three hundred thousand dollars (before taxes) in lieu of the "Life Prize Award;"
(gg) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by four of "Your Numbers" for five hundred dollars four times shall win a regular prize award of two thousand dollars;
(hh) Holder of a valid winning ticket in which one of the "Winning Numbers" is matched by one of "Your Numbers" for two thousand dollars one time shall win a regular prize award of two thousand dollars;
(ii) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by seven of "Your Numbers" for five hundred dollars six times and two thousand dollars one time shall win a regular prize award of five thousand dollars;
(jj) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for five thousand dollars one time shall win a regular prize award of five thousand dollars;
(kk) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for ten thousand dollars one time shall win a regular prize award of ten thousand dollars;
(ll) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by thirteen of "Your Numbers" for two thousand dollars ten times and ten thousand dollars three times shall win a regular prize award of fifty thousand dollars;
(mm) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" for ten thousand dollars five times shall win a regular prize award of fifty thousand dollars;
(nn) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for fifty thousand dollars one time shall win a regular prize award of fifty thousand dollars; and
(oo) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" and the corresponding prize revealed below the matching "Your Number" is a "Life" symbol shall win a "Life Prize Award" of twenty-five thousand dollars per year for life (before taxes) or the "Elected Cash-Option Prize Award" of approximately three hundred thousand dollars (before taxes) in lieu of the "Life Prize Award."
(E) Number of prize awards. The number of prize awards in any sales cycle of game rule number six hundred two will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:
(1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and
(2) Mathematical reasoning indicates that the number of winning tickets per six million tickets sold in the following prize categories should be as follows
(a) Three tickets matching numbers and revealing the "Life" symbol for the "Life Prize Award" as described in Section (B)(2) of this rule or the "Elected Cash-Option Prize Award" of approximately three hundred thousand dollars (before taxes) in lieu of the "Life Prize Award;"
(b) Three tickets matching numbers for fifty thousand dollars one time to win fifty thousand dollars;
(c) Three tickets matching numbers for ten thousand dollars five times to win fifty thousand dollars;
(d) Four tickets matching numbers for two thousand dollars ten times and ten thousand dollars three times to win fifty thousand dollars;
(e) Eight tickets matching numbers for ten thousand one time to win ten thousand dollars;
(f) Seven tickets matching numbers for five thousand dollars one time to win five thousand dollars;
(g) Eight tickets matching numbers for five hundred dollars six times and two thousand dollars one time to win five thousand dollars;
(h) Ten tickets matching numbers for two thousand dollars one time to win two thousand dollars;
(i) Ten tickets matching numbers for five hundred dollars four times to win two thousand dollars;
(j) Thirty tickets matching numbers and revealing the "TPD" prize symbol to win one thousand dollars, and, upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing to win a grand prize of a "Life Prize Award" as described in Section (B)(2) of this rule or the "Elected Cash-Option Prize Award" of approximately three hundred thousand dollars (before taxes) in lieu of the "Life Prize Award;"
(k) Eighty tickets matching numbers for twenty dollars ten times, fifty dollars four times and one hundred dollars one time to win five hundred dollars;
(l) Eighty tickets matching numbers for one hundred dollars five times to win five hundred dollars; and
(m) Eighty tickets matching numbers for five hundred dollars one time to win five hundred dollars.
(3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:
(a) Eighty tickets matching numbers for two dollars ten times, five dollars two times, ten dollars two times and fifty dollars one time to win one hundred dollars;
(b) Seventy-five tickets matching numbers for five dollars four times, ten dollars one time, twenty dollars one time and fifty dollars one time to win one hundred dollars;
(c) Fifty tickets matching numbers for one hundred dollars one time to win one hundred dollars;
(d) One hundred thirty tickets matching numbers for ten dollars five times and fifty dollars one time to win one hundred dollars;
(e) Three hundred tickets matching numbers for fifty dollars one time to win fifty dollars;
(f) Four hundred tickets matching numbers for ten dollars five times to win fifty dollars;
(g) Four hundred tickets matching numbers for five dollars ten times to win fifty dollars;
(h) One hundred tickets matching numbers for forty dollars one time to win forty dollars;
(i) Two hundred tickets matching numbers for one dollar eight times, two dollars one time and five dollars six times to win forty dollars;
(j) Three hundred tickets matching numbers for five dollars five times and fifteen dollars one time to win forty dollars;
(k) Three hundred tickets matching numbers for four dollars five times and five dollars four times to win forty dollars;
(l) One hundred tickets matching numbers for five dollars six times and ten dollars one time to win forty dollars;
(m) One thousand tickets matching numbers for twenty dollars one time to win twenty dollars;
(n) One thousand tickets matching numbers for one dollar ten times and two dollars five times to win twenty dollars;
(o) One thousand tickets matching numbers for ten dollars two times to win twenty dollars;
(p) One thousand tickets matching numbers for four dollars five times to win twenty dollars;
(q) Two thousand tickets matching numbers for fifteen dollars one time to win fifteen dollars;
(r) Two thousand tickets matching numbers for three dollars five times to win fifteen dollars;
(s) One thousand tickets matching numbers for one dollar fifteen times to win fifteen dollars;
(t) Two thousand tickets matching numbers for one dollar five times and two dollars five times to win fifteen dollars;
(u) One thousand tickets matching numbers for five dollars three times to win fifteen dollars;
(v) Four thousand tickets matching numbers for ten dollars one time to win ten dollars;
(w) Four thousand tickets matching numbers for one dollar one time, two dollars two times and five dollars one time to win ten dollars;
(x) Four thousand tickets matching numbers for five dollars two times to win ten dollars;
(y) Four thousand tickets matching numbers for two dollars five times to win ten dollars;
(z) Four thousand tickets matching numbers for one dollar ten times to win ten dollars;
(aa) Eight thousand tickets matching numbers for one dollar five times to win five dollars; and
(bb) Eight thousand tickets matching numbers for five dollars one time to win five dollars.
(F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.
(G) Frequency of prize drawings.
(1) Random imprinting of prize awards on all tickets issued in game rule number six hundred two shall be accomplished in a manner which complies with the commission's rules and procedures.
(2) When a ticket issued in game rule number six hundred two is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number six hundred two in which the ticket was sold.
(3) The Top Prize Drawing to award one grand prize of a "Life Prize Award" as described in Section (B)(2) of this rule or the "Elected Cash-Option Prize Award" of approximately three hundred thousand dollars (before taxes) in lieu of the "Life Prize Award" shall take place in accordance with rules and procedures established and approved by the director, and specifically, rule 3770:1-6-05 of the Administrative Code governing"Prize drawings" and rule 3770:1-6-06 of the Administrative Code governing"Special lottery drawings." Such drawings shall be held on dates determined and announced by the director, however, the earliest Top Prize Drawing date shall be one hundred eighty days from the game close date or when all tickets winning a prize value corresponding with a "TPD" symbol have been claimed, whichever is earlier.
(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules, as well as procedures for entry into the Top Prize Drawings described in Section (G)(3) of this Rule. Prize awards shall be claimed within the time limits set forth by commission rules.
(I) Validity of tickets.
(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number six hundred two void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.
(J) Director's conduct of game rule six hundred two.
(1) The director shall conduct game rule number six hundred two in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number six hundred two. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.
(2) Names and definitions of elements of game rule number six hundred two used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number six hundred two and these elements may be given names or titles chosen by the commission.
