  • (A) Title and term. Ohio lottery commission game rule number seven hundred thirty-seven, "Double Blackjack" shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number seven hundred thirty-seven.

    (B) General design.

    (1) Game rule number seven hundred thirty-seven is generally known as an "instant lottery."

    (2) In each "Game" ("Table 1" and "Table 2"), there are five "Player's Hands" and one "Dealer's Hand." Holders of valid tickets will remove the covering off the entire play area in "Table 1" and "Table 2" to reveal one card value in the "Dealer's Hand" in each "Table" and the two card values in the five "Player's Hands" in each "Table" and their corresponding prize values. "Jack," "Queen" or "King" cards have a value of ten and the "Ace" card has a value of eleven. If the sum of any "Player's Hand" is higher than the "Dealer's Hand" in a "Table," the player wins the corresponding prize value revealed for that "Hand." If a "Bust" symbol is revealed in the "Dealer's Hand" in a "Table," the player wins the corresponding prize values revealed in all five "Hands" for that "Table" automatically. There are ten chances to win on each ticket, and a player may win up to ten times on one ticket.

    (3) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: two dollars, four dollars, five dollars, ten dollars, twenty dollars, twenty-five dollars, fifty dollars, one hundred dollars, five hundred dollars, one thousand dollars and ten thousand dollars.

    (C) Price of tickets. The price of a ticket issued by the commission in game rule number seven hundred thirty-seven shall be two dollars.

    (D) Structure, nature and value of prize awards.

    (1) There shall be one type of prize in game rule number seven hundred thirty-seven called a "regular prize award."

    (2) The only "prize values" which shall appear on a ticket in game rule number seven hundred thirty-seven are: one dollar, two dollars, four dollars, five dollars, ten dollars, twenty dollars, twenty-five dollars, fifty dollars, one hundred dollars, five hundred dollars, one thousand dollars and ten thousand dollars. Card values, prize values and play symbols appearing on any ticket in game rule number seven hundred thirty-seven shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying card values, prize values and play symbols.

    (a) A holder of a valid winning ticket on which a hand in one or more "Player's Hands" is higher than the hand in the "Dealer's Hand" in the same "Table" for one dollar two times shall win a regular prize award of two dollars;

    (b) A holder of a valid winning ticket on which a hand in one of the "Player's Hands" is higher than the "Dealer's Hand" in the same "Table" for two dollars once shall win a regular prize award of two dollars;

    (c) A holder of a valid winning ticket on which a hand in one or more "Player's Hands" is higher than the hand in the "Dealer's Hand" in the same "Table" for two dollars two times shall win a regular prize award of four dollars;

    (d) A holder of a valid winning ticket on which a hand in one of the "Player's Hands" is higher than the hand in the "Dealer's Hand" in the same "Table" for four dollars once shall win a regular prize award of four dollars;

    (e) A holder of a valid winning ticket on which a hand in one of the "Player's Hands" is higher than the hand in the "Dealer's Hand" in the same "Table" for five dollars once shall win a regular prize award of five dollars;

    (f) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" in the same "Table" for two dollars once and four dollars two times shall win a regular prize award of ten dollars;

    (g) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" in the same "Table" for one dollar two times and four dollars two times shall win a regular prize award of ten dollars;

    (h) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" in the same "Table" for five dollars two times shall win a regular prize award of ten dollars;

    (i) A holder of a valid winning ticket on which a "Bust" symbol is revealed in the "Dealer's Hand" for one dollar two times, two dollars two times and four dollars once in the same "Table" shall win a regular prize award of ten dollars;

    (j) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for one dollar ten times shall win a regular prize award of ten dollars;

    (k) A holder of a valid winning ticket on which a hand in one of the "Player's Hands" is higher than the hand in the "Dealer's Hand" in the same "Table" for ten dollars once shall win a regular prize award of ten dollars;

    (l) A holder of a valid winning ticket on which a "Bust" symbol is revealed in the "Dealer's Hand" for one dollar two times, four dollars two times and ten dollars once in the same "Table" shall win a regular prize award of twenty dollars;

    (m) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for four dollars five times in the same "Table" shall win a regular prize award of twenty dollars;

    (n) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for five dollars two times and ten dollars once in the same "Table" shall win a regular prize award of twenty dollars;

    (o) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for ten dollars two times in the same "Table" shall win a regular prize award of twenty dollars;

    (p) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for two dollars ten times in the same "Table" shall win a regular prize award of twenty dollars;

    (q) A holder of a valid winning ticket on which a hand in one of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for twenty dollars once in the same "Table" shall win a regular prize award of twenty dollars;

    (r) A holder of a valid winning ticket on which a "Bust" symbol is revealed in the "Dealer's Hand" for two dollars once, four dollars two times, five dollars once and ten dollars once in the same "Table" shall win a regular prize award of twenty-five dollars;

    (s) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for five dollars three times and ten dollars once in the same "Table" shall win a regular prize award of twenty-five dollars;

    (t) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for five dollars once and ten dollars two times in same "Table" shall win a regular prize award of twenty-five dollars;

    (u) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for five dollars once and twenty dollars once in the same "Table" shall win a regular prize award of twenty-five dollars;

    (v) A holder of a valid winning ticket on which a hand in one of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for twenty-five dollars once in the same "Table" shall win a regular prize award of twenty-five dollars;

    (w) A holder of a valid winning ticket on which a "Bust" symbol is revealed in the "Dealer's Hand" for two dollars once, four dollars two times and twenty dollars two times in the same "Table" shall win a regular prize award of fifty dollars;

    (x) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for four dollars five times and ten dollars three times shall win a regular prize award of fifty dollars;

    (y) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for ten dollars three times and twenty dollars once in the same "Table" shall win a regular prize award of fifty dollars;

    (z) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for twenty-five dollars two times in the same "Table" shall win a regular prize award of fifty dollars;

    (aa) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for five dollars ten times shall win a regular prize award of fifty dollars;

    (bb) Holder of a valid winning ticket on which a hand in one of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for fifty dollars once in the same "Table" shall win a regular prize award of fifty dollars;

    (cc) A holder of a valid winning ticket on which a "Bust" symbol is revealed in the "Dealer's Hand" for ten dollars once, twenty dollars two times and twenty-five dollars two times in the same "Table" shall win a regular prize award of one hundred dollars;

    (dd) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for twenty dollars five times in the same "Table" shall win a regular prize award of one hundred dollars;

    (ee) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for ten dollars once, twenty dollars two times and fifty dollars once in the same "Table" shall win a regular prize award of one hundred dollars;

    (ff) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for twenty-five dollars two times and fifty dollars once in the same "Table" shall win a regular prize award of one hundred dollars;

    (gg) A holder of a valid winning ticket on which a hand in one of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for one hundred dollars once in the same "Table" shall win a regular prize award of one hundred dollars;

    (hh) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for twenty dollars five times, fifty dollars two times and one hundred dollars three times shall win a regular prize award of five hundred dollars;

    (ii) A holder of a valid winning ticket on which a hand in one or more of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for ten dollars once, twenty dollars two times, fifty dollars five times and one hundred dollars twice shall win a regular prize award of five hundred dollars;

    (jj) A holder of a valid winning ticket on which a hand in one of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for five hundred dollars once in the same "Table" shall win a regular prize award of five hundred dollars;

    (kk) A holder of a valid winning ticket on which a hand in one of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for one thousand dollars once in the same "Table" shall win a regular prize award of one thousand dollars; and

    (ll) A holder of a valid winning ticket on which a hand in one of the "Player's Hands" is higher than the hand in the "Dealer's Hand" for ten thousand dollars once in the same "Table" shall win a regular prize award of ten thousand dollars.

    (E) Number of prize awards. The number of prize awards in any sales cycle of game rule number seven hundred thirty-seven will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:

    (1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

    (2) Mathematical reasoning indicates that the number of winning tickets per six million tickets sold in the following prize categories should be as follows:

    (a) Twenty-four tickets winning ten thousand dollars once to win ten thousand dollars;

    (b) Twelve tickets winning one thousand dollars once to win one thousand dollars;

    (c) Twelve tickets winning five hundred dollars once to win five hundred dollars:

    (d) Twelve tickets winning ten dollars once, twenty dollars two times, fifty dollars five times and one hundred dollars two times to win five hundred dollars;

    (e) Twelve tickets winning twenty dollars five times, fifty dollars two times and one hundred dollars three times to win five hundred dollars.

    (3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per five hundred thousand tickets sold should be as follows:

    (a) Fifty tickets winning one hundred dollars once to win one hundred dollars;

    (b) Fifty tickets winning twenty-five dollars two times and fifty dollars once to win one hundred dollars;

    (c) Fifty tickets winning ten dollars once, twenty dollars two times and fifty dollars once to win one hundred dollars;

    (d) Fifty tickets winning twenty dollars five times to win one hundred dollars;

    (e) Fifty tickets winning ten dollars once, twenty dollars two times and twenty-five dollars two times to win one hundred dollars;

    (f) One hundred nine tickets winning fifty dollars once to win fifty dollars;

    (g) One hundred nine tickets winning five dollars ten times to win fifty dollars;

    (h) One hundred eight tickets winning twenty-five dollars two times to win fifty dollars;

    (i) One hundred eight tickets winning ten dollars three times and twenty dollars once to win fifty dollars;

    (j) One hundred eight tickets winning four dollars five times and ten dollars three times to win fifty dollars;

    (k) One hundred eight tickets winning two dollars once, four dollars two times and twenty dollars two times to win fifty dollars;

    (l) Two hundred eighty tickets winning twenty-five dollars once to win twenty-five dollars;

    (m) Two hundred eighty tickets winning five dollars once and twenty dollars once to win twenty-five dollars;

    (n) Two hundred eighty tickets winning five dollars once and ten dollars two times to win twenty-five dollars;

    (o) Two hundred eighty tickets winning five dollars three times and ten dollars once to win twenty-five dollars;

    (p) Two hundred eighty tickets winning two dollars once, four dollars two times, five dollars once and ten dollars once to win twenty-five dollars;

    (q) One thousand two hundred fifty tickets winning twenty dollars once to win twenty dollars;

    (r) One thousand two hundred fifty tickets winning two dollars ten times to win twenty dollars;

    (s) One thousand two hundred fifty tickets winning ten dollars two times to win twenty dollars;

    (t) One thousand two hundred fifty tickets winning five dollars two times and ten dollars once to win twenty dollars;

    (u) One thousand two hundred fifty tickets winning four dollars five times to win twenty dollars;

    (v) One thousand two hundred fifty tickets winning one dollar two times, four dollars two times and ten dollars once to win twenty dollars;

    (w) One thousand two hundred fifty tickets winning ten dollars once to win ten dollars;

    (x) Two thousand five hundred tickets winning one dollar ten times to win ten dollars;

    (y) One thousand two hundred fifty tickets winning one dollar two times, two dollars two times and four dollars once to win ten dollars;

    (z) Three thousand seven hundred fifty tickets winning five dollars two times to win ten dollars;

    (aa) Three thousand seven hundred fifty tickets winning one dollar two times and four dollars two times to win ten dollars;

    (bb) Two thousand five hundred fifty tickets winning two dollars once and four dollars two times to win ten dollars;

    (cc) Five thousand tickets winning five dollars once to win five dollars;

    (dd) Fifteen thousand tickets winning four dollars once to win four dollars;

    (ee) Five thousand tickets winning two dollars two times to win four dollars;

    (ff) Seven thousand five hundred tickets winning two dollars once to win two dollars; and

    (gg) Fifty-seven thousand five hundred tickets winning one dollar two times to win two dollars.

    (F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

    (G) Frequency of prize drawings.

    (1) Random imprinting of prize awards on all tickets issued in game rule number seven hundred thirty-seven shall be accomplished in a manner which complies with the commission's rules and procedures.

    (2) When a ticket issued in game rule number seven hundred thirty-seven is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number seven hundred thirty-seven in which the ticket was sold.

    (H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

    (I) Validity of tickets.

    (1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number seven hundred thirty-seven void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

    (J) Director's conduct of game rule number seven hundred thirty-seven.

    (1) The director shall conduct game rule number seven hundred thirty-seven and any promotions or drawings associated therewith in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number seven hundred thirty-seven. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

    (2) Names and definitions of elements of game rule number seven hundred thirty-seven used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number seven hundred thirty-seven and these elements may be given names or titles chosen by the commission.
