3770:1-9-744. Game rule number seven hundred forty-four
-
(A) Title and term. Ohio lottery commission game rule number seven hundred forty-four, "Aerosmith" shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number seven hundred forty-four.
(B) General design.
(1) Game rule number seven hundred forty-four is a key number match game which includes second chance drawing opportunities and is generally known as an "instant lottery."
(2) Holders of valid tickets will remove the covering off the entire play area to reveal two "Winning Tracks," fifteen "Your Tracks" and fifteen corresponding prize values. If any one or more of "Your Tracks(s)" matches one or more of the "Winning Track(s)," the player wins the corresponding prize values shown below the matching "Your Track(s)." If the player reveals a "Guitar" symbol in any of the "Your Tracks" play spots, the player wins the corresponding prize value shown. For (D) and (E) herein, revealing a "Guitar" symbol in the "Your Tracks" play spots shall be equivalent to matching one of the "Winning Tracks" to one of "Your Tracks." If the player reveals an "Aerosmith" symbol in any of the "Your Tracks" play spots, the player wins five times the corresponding prize value shown automatically. If the player reveals a "TPD" symbol, the player wins five thousand five hundred dollars automatically, and upon filing a valid claim at an Ohio lottery commission office, shall automatically be entered in a Top Prize Drawing ("TPD") for a chance to win a one hundred thousand dollar prize. There are fifteen chances to win on each ticket, and a player may win up to fifteen times on one ticket.
(3) The only "prize values" which shall appear on a ticket in game rule number seven hundred forty-four are: two dollars, three dollars, four dollars, five dollars, ten dollars, twenty dollars, twenty-five dollars, thirty dollars, forty dollars, fifty dollars, one hundred dollars, two hundred dollars, five hundred dollars, one thousand dollars, the "TPD" symbol corresponding to a prize value of five thousand five hundred dollars, ten thousand dollars, fifty thousand dollars and one hundred thousand dollars. Numbers, prize values and play symbols appearing on any ticket in game rule number seven hundred forty-four shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.
(C) Price of tickets. The price of a ticket issued by the commission in game rule number seven hundred forty-four shall be five dollars.
(D) Structure, nature and value of prize awards.
(1) There shall be two types of prizes in game rule number seven hundred forty-four, a "regular prize award" and a "TPD" prize award. In addition, as determined by the director, prizes may be awarded in connection with second chance drawings associated with game number seven hundred forty-four.
(2) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: five dollars, ten dollars, twenty dollars, twenty-five dollars, thirty dollars, forty dollars, fifty dollars, one hundred dollars, two hundred dollars, five hundred dollars, one thousand dollars, five thousand five hundred dollars, ten thousand dollars, fifty thousand dollars and one hundred thousand dollars. Each ticket in game rule number seven hundred forty-four shall be imprinted in such a way that prize awards from the set listed above may be won.
(a) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by two of "Your Tracks" for two dollars once and three dollars once shall win a regular prize award of five dollars;
(b) Holder of a valid winning ticket on which one of the "Winning Tracks" is matched by one of "Your Tracks" for five dollars once shall win a regular prize award of five dollars;
(c) Holder of a valid winning ticket on which one of the "Winning Tracks" is matched by one of "Your Tracks" for ten dollars once shall win a regular prize award of ten dollars;
(d) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by two of "Your Tracks" for five dollars two times shall win a regular prize award of ten dollars;
(e) Holder of a valid winning ticket on which an "Aerosmith" symbol is revealed in one of "Your Tracks" play spots for two dollars times five shall win a regular prize award of ten dollars;
(f) Holder of a valid winning ticket on which one of the "Winning Tracks" is matched by one of "Your Tracks" for twenty dollars once shall win a regular prize award of twenty dollars;
(g) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by two of "Your Tracks" for ten dollars two times shall win a regular prize award of twenty dollars;
(h) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by four of "Your Tracks" for five dollars four times shall win a regular prize award of twenty dollars;
(i) Holder of a valid winning ticket on which an "Aerosmith" symbol is revealed in one of "Your Tracks" play spots for four dollars times five shall win a regular prize award of twenty dollars;
(j) Holder of a valid winning ticket on which one of the "Winning Tracks" is matched by one of "Your Tracks" for twenty-five dollars once shall win a regular prize award of twenty-five dollars;
(k) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by two of "Your Tracks" for twenty dollars once and five dollars once shall win a regular prize award of twenty-five dollars;
(l) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by three of "Your Tracks" for ten dollars two times and five dollars once shall win a regular prize award of twenty-five dollars;
(m) Holder of a valid winning ticket on which an "Aerosmith" symbol is revealed in one of "Your Tracks" play spots for five dollars times five shall win a regular prize award of twenty-five dollars;
(n) Holder of a valid winning ticket on which an "Aerosmith" symbol is revealed in one of "Your Tracks" play spots for three dollars times five and three of the "Winning Tracks" are matched by three of "Your Tracks" for five dollars three times shall win a regular prize award of thirty dollars;
(o) Holder of a valid winning ticket on which one of the "Winning Tracks" is matched by one of "Your Tracks" for thirty dollars once shall win a regular prize award of thirty dollars;
(p) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by ten of "Your Tracks" for three dollars ten times shall win a regular prize award of thirty dollars;
(q) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by two of "Your Tracks" for twenty-five dollars once and five dollars once shall win a regular prize award of thirty dollars;
(r) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by fifteen of "Your Tracks" for two dollars fifteen times shall win a regular prize award of thirty dollars;
(s) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by five of "Your Tracks" for ten dollars once and five dollars four times shall win a regular prize award of thirty dollars;
(t) Holder of a valid winning ticket on which one of the "Winning Tracks" is matched by one of "Your Tracks" for forty dollars once shall win a regular prize award of forty dollars;
(u) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by fifteen of "Your Tracks" for two dollars seven times, three dollars seven times and five dollars once shall win a regular prize award of forty dollars;
(v) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by ten of "Your Tracks" for four dollars ten times shall win a regular prize award of forty dollars;
(w) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by four of "Your Tracks" for ten dollars four times shall win a regular prize award of forty dollars;
(x) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by eight of "Your Tracks" for five dollars eight times shall win a regular prize award of forty dollars;
(y) Holder of a valid winning ticket on which an "Aerosmith" symbol is revealed in one of "Your Tracks" play spots for five dollars times five and two of the "Winning Tracks" are matched by two of "Your Tracks" for ten dollars once and five dollars once shall win a regular prize award of forty dollars;
(z) Holder of a valid winning ticket on which one of the "Winning Tracks" is matched by one of "Your Tracks" for fifty dollars once shall win a regular prize award of fifty dollars;
(aa) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by two of "Your Tracks" for twenty-five dollars two times shall win a regular prize award of fifty dollars;
(bb) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by fifteen of "Your Tracks" for two dollars five times, three dollars five times and five dollars five times shall win a regular prize award of fifty dollars;
(cc) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by three of "Your Tracks" for twenty-five dollars once, twenty dollars once and five dollars once shall win a regular prize award of fifty dollars;
(dd) Holder of a valid winning ticket on which an "Aerosmith" symbol is revealed in one of "Your Tracks" play spots for ten dollars times five shall win a regular prize award of fifty dollars;
(ee) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by ten of "Your Tracks" for five dollars ten times shall win a regular prize award of fifty dollars;
(ff) Holder of a valid winning ticket on which one of the "Winning Tracks" is matched by one of "Your Tracks" for one hundred dollars once shall win a regular prize award of one hundred dollars;
(gg) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by two of "Your Tracks" for fifty dollars two times shall win a regular prize award of one hundred dollars;
(hh) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by ten of "Your Tracks" for ten dollars ten times shall win a regular prize award of one hundred dollars;
(ii) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by fifteen of "Your Tracks" for twenty dollars two times, ten dollars two times, five dollars six times and two dollars five times shall win a regular prize award of one hundred dollars;
(jj) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by four of "Your Tracks" for twenty-five dollars four times shall win a regular prize award of one hundred dollars;
(kk) Holder of a valid winning ticket on which an "Aerosmith" symbol is revealed in one of "Your Tracks" play spots for twenty dollars times five shall win a regular prize award of one hundred dollars;
(ll) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by fifteen of "Your Tracks" for forty dollars once, twenty-five dollars three times, ten dollars six times and five dollars five times shall win a regular prize award of two hundred dollars;
(mm) Holder of a valid winning ticket on which one of the "Winning Tracks" is matched by one of "Your Tracks" for two hundred dollars once shall win a regular prize award of two hundred dollars;
(nn) Holder of a valid winning ticket on which an "Aerosmith" symbol is revealed in one of "Your Tracks" play spots for forty dollars times five shall win a regular prize award of two hundred dollars;
(oo) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by six of "Your Tracks" for one hundred dollars once, fifty dollars once, twenty-five dollars once, ten dollars two times and five dollars once shall win a regular prize award of two hundred dollars;
(pp) Holder of a valid winning ticket on which one of the "Winning Tracks" is matched by one of "Your Tracks" for five hundred dollars once shall win a regular prize award of five hundred dollars;
(qq) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by fifteen of "Your Tracks" for one hundred dollars two times, fifty dollars four times, twenty dollars two times, ten dollars five times and five dollars two times shall win a regular prize award of five hundred dollars;
(rr) Holder of a valid winning ticket on which an "Aerosmith" symbol is revealed in one of "Your Tracks" play spots for fifty dollars times five, and four of the "Winning Tracks" are matched by four of "Your Tracks" for one hundred dollars two times and twenty-five dollars two times shall win a regular prize award of five hundred dollars;
(ss) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by fifteen of "Your Tracks" for one hundred dollars three times, fifty dollars two times and ten dollars ten times shall win a regular prize award of five hundred dollars;
(tt) Holder of a valid winning ticket on which one of the "Winning Tracks" is matched by one of "Your Tracks" for one thousand dollars once shall win a regular prize award of one thousand dollars;
(uu) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by fifteen of "Your Tracks" for five hundred dollars once, one hundred dollars two times, fifty dollars two times, forty dollars once, twenty-five dollars two times, twenty dollars five times and five dollars two times shall win a regular prize award of one thousand dollars;
(vv) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by two of "Your Tracks" for five hundred dollars two times shall win a regular prize award of one thousand dollars;
(ww) Holder of a valid winning ticket on which an "Aerosmith" symbol is revealed in one of "Your Tracks" play spots for one hundred dollars times five and one of the "Winning Tracks" is matched by one of "Your Tracks" for five hundred dollars once shall win a regular prize award of one thousand dollars;
(xx) Holder of a valid winning ticket on which one of the "Winning Tracks" is matched by one of "Your Tracks" to reveal a "TPD" symbol shall win a regular prize award of five thousand five hundred dollars, and, upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing for a chance to win a grand prize of one hundred thousand dollars;
(yy) Holder of a valid winning ticket on which one of the "Winning Tracks" is matched by one of "Your Tracks" for ten thousand dollars once shall win a regular prize award of ten thousand dollars;
(zz) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by fifteen of "Your Tracks" for one thousand dollars seven times, five hundred dollars five times, two hundred dollars two times and one hundred dollars once shall win a regular prize award of ten thousand dollars;
(aaa) Holder of a valid winning ticket on which one of the "Winning Tracks" is matched by one of "Your Tracks" for fifty thousand dollars once shall win a regular prize award of fifty thousand dollars;
(bbb) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by fifteen of "Your Tracks" for ten thousand dollars four times, one thousand dollars nine times and five hundred dollars two times shall win a regular prize award of fifty thousand dollars;
(ccc) Holder of a valid winning ticket on which one of the "Winning Tracks" is matched by one of "Your Tracks" for one hundred thousand dollars once shall win a regular prize award of one hundred thousand dollars;
(ddd) Holder of a valid winning ticket on which one or more of the "Winning Tracks" are matched by two of "Your Tracks" for fifty thousand dollars two times shall win a regular prize award of one hundred thousand dollars;
(E) Number of prize awards. The number of prize awards in any sales cycle of game rule number seven hundred forty-four will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:
(1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance;
(2) Mathematical reasoning indicates that the number of winning tickets per four million tickets sold in the following prize categories should be as follows:
(a) One ticket matching numbers for fifty thousand dollars two times to win one hundred thousand dollars;
(b) One ticket matching numbers for one hundred thousand dollars once to win one hundred thousand dollars;
(c) Two tickets matching numbers for ten thousand dollars four times, one thousand dollars nine times and five hundred dollars two times to win fifty thousand dollars;
(d) Two tickets matching numbers for fifty thousand dollars once to win fifty thousand dollars;
(e) Two tickets matching numbers for one thousand dollars seven times, five hundred dollars five times, two hundred dollars two times and one hundred dollars once to win ten thousand dollars;
(f) Two tickets matching numbers for ten thousand dollars once to win ten thousand dollars;
(g) Eighteen tickets matching numbers to reveal a "TPD" symbol for five thousand five hundred dollars to win five thousand five hundred dollars and, upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing for a chance to win a grand prize of one hundred thousand dollars;
(h) Two tickets matching numbers for five hundred dollars once and revealing an "Aerosmith" symbol for one hundred dollars times five to win one thousand dollars;
(i) Two tickets matching numbers for five hundred dollars two times to win one thousand dollars;
(j) Two tickets matching numbers for five hundred dollars once, one hundred dollars two times, fifty dollars two times, forty dollars once, twenty-five dollars two times, twenty dollars five times and five dollars two times to win one thousand dollars;
(k) Two tickets matching numbers for one thousand dollars once to win one thousand dollars;
(3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per five hundred thousand tickets sold should be as follows:
(a) One ticket matching numbers for one hundred dollars three times, fifty dollars two times and ten dollars ten times to win five hundred dollars;
(b) One ticket matching numbers for one hundred dollars two times and twenty-five dollars two times and revealing an "Aerosmith" symbol for fifty dollars times five to win five hundred dollars;
(c) One ticket matching numbers for one hundred dollars two times, fifty dollars four times, twenty dollars two times, ten dollars five times and five dollars two times to win five hundred dollars;
(d) One ticket matching numbers for five hundred dollars once to win five hundred dollars;
(e) Ten tickets matching numbers for one hundred dollars once, fifty dollars once, twenty-five dollars once, ten dollars two times and five dollars once to win two hundred dollars;
(f) Ten tickets revealing an "Aerosmith" symbol for forty dollars times five to win two hundred dollars;
(g) Ten tickets matching numbers for two hundred dollars once to win two hundred dollars;
(h) Ten tickets matching numbers for forty dollars once, twenty-five dollars three times, ten dollars six times and five dollars five times to win two hundred dollars;
(i) Five hundred tickets revealing an "Aerosmith" symbol for twenty dollars times five to win one hundred dollars;
(j) One hundred tickets matching numbers for twenty-five dollars four times to win one hundred dollars;
(k) One hundred tickets matching numbers for twenty dollars two times, ten dollars two times, five dollars six times and two dollars five times to win one hundred dollars;
(l) One hundred tickets matching numbers for ten dollars ten times to win one hundred dollars;
(m) One hundred tickets matching numbers for fifty dollars two times to win one hundred dollars;
(n) One hundred tickets matching numbers for one hundred dollars once to win one hundred dollars;
(o) Three hundred tickets matching numbers for five dollars ten times to win fifty dollars;
(p) One thousand five hundred tickets revealing an "Aerosmith" symbol for ten dollars times five to win fifty dollars;
(q) Three hundred tickets matching numbers for twenty-five dollars once, twenty dollars once and five dollars once to win fifty dollars;
(r) Three hundred tickets matching numbers for two dollars five times, three dollars five times and five dollars five times to win fifty dollars;
(s) Three hundred tickets matching numbers for twenty-five dollars two times to win fifty dollars;
(t) Three hundred tickets matching numbers for fifty dollars once to win fifty dollars;
(u) One thousand five hundred tickets matching numbers for ten dollars once and five dollars once and revealing an "Aerosmith" symbol for five dollars times five to win forty dollars;
(v) Three hundred tickets matching numbers for five dollars eight times to win forty dollars;
(w) Three hundred tickets matching numbers for ten dollars four times to win forty dollars;
(x) Three hundred tickets matching numbers for four dollars ten times to win forty dollars;
(y) Three hundred tickets matching numbers for two dollars seven times, three dollars seven times and five dollars once to win forty dollars;
(z) Three hundred tickets matching numbers for forty dollars once to win forty dollars;
(aa) Three hundred tickets matching numbers for ten dollars once and five dollars four times to win thirty dollars;
(bb) Three hundred tickets matching numbers for two dollars fifteen times to win thirty dollars;
(cc) Three hundred tickets matching numbers for twenty-five dollars once and five dollars once to win thirty dollars;
(dd) Three hundred tickets matching numbers for three dollars ten times to win thirty dollars;
(ee) Three hundred tickets matching numbers for thirty dollars once to win thirty dollars;
(ff) One thousand five hundred tickets matching numbers for five dollars three times and revealing an "Aerosmith" symbol for three dollars times five to win thirty dollars;
(gg) Three thousand tickets revealing an "Aerosmith" symbol for five dollars times five to win twenty-five dollars;
(hh) One thousand tickets matching numbers for ten dollars two times and five dollars once to win twenty-five dollars;
(ii) One thousand tickets matching numbers for twenty dollars once and five dollars once to win twenty-five dollars;
(jj) One thousand tickets matching numbers for twenty-five dollars once to win twenty-five dollars;
(kk) Four thousand tickets revealing an "Aerosmith" symbol for four dollars times five to win twenty dollars;
(ll) Two thousand tickets matching numbers for five dollars four times to win twenty dollars;
(mm) Two thousand tickets matching numbers for ten dollars two times to win twenty dollars;
(nn) Two thousand tickets matching numbers for twenty dollars once to win twenty dollars;
(oo) Twenty-six thousand tickets revealing an "Aerosmith" symbol for two dollars times five to win ten dollars;
(pp) Twelve thousand tickets matching numbers for five dollars two times and two dollars two times to win twenty dollars;
(qq) Twelve thousand tickets matching numbers for ten dollars once to win ten dollars;
(rr) Thirty thousand tickets matching numbers for five dollars once to win five dollars; and
(ss) Thirty thousand tickets matching numbers for two dollars once and three dollars once to win five dollars.
(F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.
(G) Frequency of prize drawings.
(1) Random imprinting of prize awards on all tickets issued in game rule number seven hundred forty-four shall be accomplished in a manner, which complies with the commission's rules and procedures.
(2) When a ticket issued in game rule number seven hundred forty-four is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number seven hundred forty-four in which the ticket was sold;.
(3) The Top Prize Drawing to award one grand prize of one hundred thousand dollars shall take place in accordance with rules and procedures established and approved by the director, and specifically, rule 3770:1-6-05 of the Administrative Code governing"Prize drawings" and rule 3770:1-6-06 of the Administrative Code governing"Special lottery drawings." Such drawings shall be held on dates determined and announced by the director, however, the earliest Top Prize Drawing date shall be one hundred eighty days from the game close date or when all tickets winning a prize value corresponding with a "TPD" symbol have been claimed, whichever is earlier.
(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.
(I) Validity of tickets.
(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number seven hundred forty-four void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price. Participation in game number seven hundred forty-four including any promotions or drawings conducted in connection therewith is void where prohibited by law.
(J) Director's conduct of game rule number seven hundred forty-four.
(1) The director shall conduct game rule number seven hundred forty-four and any promotions or drawings associated therewith in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game and any promotions or drawings associated therewith. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number seven hundred forty-four. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.
(2) Names and definitions of elements of game rule number seven hundred forty-four used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number seven hundred forty-four and these elements may be given names or titles chosen by the commission.
