  • (A) Title and term. Ohio lottery commission game rule number seven hundred fifty-three. "Jacks in the Box." shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number seven hundred fifty-three.

    (B) General design.

    (1) Game rule number seven hundred fifty-three is a reveal symbol style game and is generally known as an "instant lottery."

    (2) Holders of valid tickets will remove the covering to reveal six play symbols and six corresponding prize values. If the player reveals a "J" symbol in any of the play spots, the player wins the corresponding prize value. If the player reveals a "Dollar Bill" symbol in any of the play spots, the player wins three times the corresponding prize value. There are six chances to win on each ticket, and a player may win up to six times on one ticket.

    (3) The only "prize values" which shall appear on a ticket in game rule number seven hundred fifty-three are: one dollar, two dollars, three dollars, four dollars, six dollars, ten dollars, twenty dollars, thirty dollars, sixty dollars, one hundred dollars, five hundred dollars and one-thousand dollars. Numbers, prize values and play symbols appearing on any ticket in game rule number seven hundred fifty-three shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.

    (C) Price of tickets. The price of a ticket issued by the commission in game rule number seven hundred fifty-three shall be one dollar.

    (D) Structure, nature and value of prize awards.

    (1) There shall be one type of prize in game rule number seven hundred fifty-three called a "regular prize award."

    (2) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: one dollar, two dollars, three dollars, four dollars, six dollars, ten dollars, twenty dollars, thirty dollars, sixty dollars, one hundred dollars, five hundred dollars and one thousand dollars. Each ticket in game rule number seven hundred fifty-three shall be imprinted in such a way that prize awards from the set listed above may be won.

    (a) Holder of a valid winning ticket on which a "J" symbol is revealed in one of the play spots for one dollar once shall win a regular prize award of one dollar;

    (b) Holder of a valid winning ticket on which a "J" symbol is revealed in one of the play spots for two dollars once shall win a regular prize award of two dollars;

    (c) Holder of a valid winning ticket on which a "J" symbol is revealed in two of the play spots for one dollar two times shall win a regular prize award of two dollars;

    (d) Holder of a valid winning ticket on which a "Dollar Bill" symbol is revealed in one of the play spots for one dollar three times shall win a regular prize award of three dollars;

    (e) Holder of a valid winning ticket on which a "J" symbol is revealed in one of the play spots for three dollars once shall win a regular prize award of three dollars;

    (f) Holder of a valid winning ticket on which a "J" symbol is revealed in two of the play spots for two dollars two times shall win a regular prize award of four dollars;

    (g) Holder of a valid winning ticket on which a "J" symbol is revealed in four of the play spots for one dollar four times shall win a regular prize award of four dollars;

    (h) Holder of a valid winning ticket on which a "J" symbol is revealed in one of the play spots for four dollars once shall win a regular prize award of four dollars;

    (i) Holder of a valid winning ticket on which a "Dollar Bill" symbol is revealed in one of the play spots for two dollars three times shall win a regular prize award of six dollars;

    (j) Holder of a valid winning ticket on which a "J" symbol is revealed in all six of the play spots for one dollar six times shall win a regular prize award of six dollars;

    (k) Holder of a valid winning ticket on which a "J" symbol is revealed in one of the play spots for six dollars once shall win a regular prize award of six dollars;

    (l) Holder of a valid winning ticket on which a "J" symbol is revealed in five of the play spots for two dollars five times shall win a regular prize award often dollars;

    (m) Holder of a valid winning ticket on which a "J" symbol is revealed in one of the play spots for one dollar once and a "Dollar Bill" symbol is revealed in one of the play spots for three dollars three times shall win a regular prize award often dollars;

    (n) Holder of a valid winning ticket on which a "J" symbol is revealed in three of the play spots for three dollars two times and four dollars once shall win a regular prize award often dollars;

    (o) Holder of a valid winning ticket on which a "J" symbol is revealed in one of the play spots for ten dollars once shall win a regular prize award of ten dollars;

    (p) Holder of a valid winning ticket on which a "J" symbol is revealed in two of the play spots for four dollars two times and a "Dollar Bill" symbol is revealed in one of the play spots for four dollars three times shall win a regular prize award of twenty dollars;

    (q) Holder of a valid winning ticket on which a "J" symbol is revealed in one of the play spots for twenty dollars once shall win a regular prize award of twenty dollars;

    (r) Holder of a valid winning ticket on which a "Dollar Bill" symbol is revealed in one of the play spots for ten dollar three times shall win a regular prize award of thirty dollars;

    (s) Holder of a valid winning ticket on which a "J" symbol is revealed in five of the play spots for four dollars and one of the play spots for ten dollars shall win a regular prize award of thirty dollars;

    (t) Holder of a valid winning ticket on which a "J" symbol is revealed in one of the play spots for thirty dollars once shall win a regular prize award of thirty dollars;

    (u) Holder of a valid winning ticket on which a "Dollar Bill" symbol is revealed in one of the play spots for twenty dollar three times shall win a regular prize award of sixty dollars;

    (v) Holder of a valid winning ticket on which a "J" symbol is revealed in two of the play spots for thirty dollars two times shall win a regular prize award of sixty dollars;

    (w) Holder of a valid winning ticket on which a "J" symbol is revealed in one of the play spots for sixty dollars once shall win a regular prize award of sixty dollars;

    (x) Holder of a valid winning ticket on which a "J" symbol is revealed in one of the play spots for ten dollars once and a "Dollar Bill" symbol is revealed in one of the play spots for thirty dollars three times shall win a regular prize award of one hundred dollars;

    (y) Holder of a valid winning ticket on which a "J" symbol is revealed in one of the play spots for one hundred dollars once shall win a regular prize award of one hundred dollars;

    (z) Holder of a valid winning ticket on which a "J" symbol is revealed in five of the play spots for one hundred dollars five times shall win a regular prize award of five hundred dollars;

    (aa) Holder of a valid winning ticket on which a "J" symbol is revealed in one of the play spots for five hundred dollars once shall win a regular prize award of five hundred dollars; and

    (bb) Holder of a valid winning ticket on which a "J" symbol is revealed in one of the play spots for one thousand dollars once shall win a regular prize award of one thousand dollars.

    (E) Number of prize awards. The number of prize awards in any sales cycle of game rule number seven hundred fifty-three will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by. but not limited to. circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:

    (1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

    (2) Mathematical reasoning indicates that the number of winning tickets per two hundred thousand tickets sold in the following prize categories should be as follows:

    (a) One ticket winning one thousand dollars once shall win one thousand dollars;

    (b) One ticket winning five hundred dollars once shall win five hundred dollars;

    (c) One ticket winning one hundred dollars five times shall win five hundred dollars;

    (d) Ten tickets winning one hundred dollars once shall win one hundred dollars;

    (e) Twenty tickets winning ten dollars once and thirty dollars three times shall win one hundred dollars;

    (f) Ten tickets winning sixty dollars once shall win sixty dollars;

    (g) Ten tickets winning thirty dollars two times shall win sixty dollars;

    (h) Ten tickets winning twenty dollars three times shall win sixty dollars;

    (i) Fifty tickets winning thirty dollars once shall win thirty dollars;

    (j) Eighty tickets winning four dollars five times and ten dollars once shall win thirty dollars;

    (k) Eighty tickets winning ten dollars three times shall win thirty dollars;

    (l) Two hundred fifty tickets winning twenty dollars once shall win twenty dollars;

    (m) Two hundred fifty tickets winning four dollars two times and four dollars three times shall win twenty dollars;

    (n) Two hundred fifty tickets winning ten dollars once shall win ten dollars;

    (o) Five hundred tickets winning three dollars two times and four dollars once shall win ten dollars;

    (p) Seven hundred fifty tickets winning one dollar once and three dollars three times shall win ten dollars;

    (q) Five hundred tickets winning two dollars five times shall win ten dollars;

    (r) Two hundred fifty tickets winning six dollars once shall win six dollars;

    (s) One thousand tickets winning one dollar six times once shall win six dollars;

    (t) Seven hundred fifty tickets winning two dollars three times shall win six dollars;

    (u) Two hundred fifty tickets winning four dollars once shall win four dollars;

    (v) Seven hundred fifty tickets winning one dollars four times shall win four dollars;

    (w) Five hundred tickets winning two dollars two times shall win four dollars;

    (x) Two thousand tickets winning three dollars once shall win three dollars;

    (y) Two thousand tickets winning one dollar three times shall win three dollars;

    (z) Seven thousand tickets winning one dollar two times shall win two dollars;

    (aa) Ten thousand tickets winning two dollars once shall win two dollars; and

    (bb) Fifteen thousand tickets winning one dollar once shall win one dollar.

    (F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

    (G) Frequency of prize drawings.

    (1) Random imprinting of prize awards on all tickets issued in game rule number seven hundred fifty-three shall be accomplished in a manner which complies with the commission's rules and procedures.

    (2) When a ticket issued in game rule number seven hundred fifty-three is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number seven hundred fifty-three in which the ticket was sold.

    (H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

    (I) Validity of tickets.

    (1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2) In addition to. but not in limitation of. all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number seven hundred fifty-three void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered. reconstituted, miscut. defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

    (J) Director's conduct of game rule number seven hundred fifty-three.

    (1) The director shall conduct game rule number seven hundred fifty-three and any promotions or drawings associated therewith in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number seven hundred fifty-three. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

    (2) Names and definitions of elements of game rule number seven hundred fifty-three used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number seven hundred fifty-three and these elements may be given names or titles chosen by the commission.
