3770:1-9-776. Game rule number seven hundred seventy-six
-
(A) Title and term. Ohio lottery commission game rule number seven hundred seventy-six, "$100,000 Silver & Gold" shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date allocated to them during the period in game rule number seven hundred seventy-six.
(B) General design.
(1) Game rule number seven hundred seventy-six is a key number match game with a "multiplier" feature and is generally known as an "instant lottery."
(2) Holders of valid tickets will remove the covering off the entire play area to reveal three "Winning Numbers, fifteen "Your Numbers" and fifteen corresponding prize values. If any one of "Your Numbers" match one or more of the "Winning Numbers," the player wins the corresponding prize value shown below the matching "Your Number(s)." If the player reveals a "Silver Bar" symbol in any of the "Your Numbers" play spots, the player wins five times the corresponding prize value automatically. If the player reveals a "Gold Bar" symbol in any of the "Your Numbers" play spots, the player wins ten times the corresponding prize value automatically. If the player reveals a "TPD" symbol in any of "Your Numbers" play spots, the player wins five thousand five hundred dollars automatically, and upon filing a valid claim at an Ohio lottery commission office, shall automatically be entered in a Top Prize Drawing ("TPD") for a chance to win a one hundred thousand dollar prize. The Top Prize Drawing shall be conducted in accordance with Ohio Lottery rules and procedures established and approved by the director.
(3) The only "prize values" which shall appear on a ticket in game rule number seven hundred seventy-six are: one dollar, two dollars, three dollars, four dollars, five dollars, ten dollars, fifteen dollars, twenty dollars, fifty dollars, one hundred dollars, five hundred dollars, one thousand dollars, five thousand dollars, "TPD" symbol corresponding to a prize value of five thousand five hundred dollars, ten thousand dollars and one hundred thousand dollars. Numbers, prize values and play symbols appearing on any ticket in game rule number seven hundred seventy-six shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.
(C) Price of tickets. The price of a ticket issued by the commission in game rule number seven hundred seventy-six shall be five dollars.
(D) Structure, nature and value of prize awards.
(1) There shall be two types of prizes in game rule seven hundred seventy-six, a "regular prize award" and a "TPD" prize award.
(2) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: five dollars, ten dollars, fifteen dollars, twenty dollars, fifty dollars, one hundred dollars, five hundred dollars, one thousand dollars, five thousand dollars, five thousand five hundred dollars, ten thousand dollars and one hundred thousand dollars.
(a) Holder of a valid winning ticket on which a "Silver Bar" symbol is revealed in one of the "Your Numbers" play spots for one dollar times five shall win a regular prize award of five dollars;
(b) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for four dollars once and one dollar once shall win a regular prize award of five dollars;
(c) Holder of a valid winning ticket on which one of the "Winning Numbers"is matched by one of "Your Numbers" for five dollars once shall win a regular prize award of five dollars;
(d) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for five dollars two times shall win a regular prize award of ten dollars;
(e) Holder of a valid winning ticket on which a "Silver Bar" symbol is revealed in one of the "Your Numbers" play spots for two dollars times five shall win a regular prize award of ten dollars;
(f) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by four of "Your Numbers" for one dollar once, two dollars two times and five dollars once shall win a regular prize award of ten dollars;
(g) Holder of a valid winning ticket on which a "Gold Bar" symbol is revealed in one of the "Your Numbers" play spots for one dollar times ten shall win a regular prize award of ten dollars;
(h) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for ten dollars once shall win a regular prize award of ten dollars;
(i) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by three of "Your Numbers" for five dollars three times shall win a regular prize award of fifteen dollars;
(j) Holder of a valid winning ticket on which a "Silver Bar" symbol is revealed in one of the "Your Numbers" play spots for three dollars times five shall win a regular prize award of fifteen dollars;
(k) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by fifteen of "Your Numbers" for one dollar fifteen times shall win a regular prize award of fifteen dollars;
(l) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for five dollars once and ten dollars once shall win a regular prize award of fifteen dollars;
(m) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for fifteen dollars once shall win a regular prize award of fifteen dollars;
(n) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by four of "Your Numbers" for five dollars four times shall win a regular prize award of twenty dollars;
(o) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" for two dollars ten times shall win a regular prize award of twenty dollars;
(p) Holder of a valid winning ticket on which a "Silver Bar" symbol is revealed in one of the "Your Numbers" play spots for four dollars times five shall win a regular prize award of twenty dollars;
(q) Holder of a valid winning ticket on which a "Silver Bar" symbol is revealed in one of the "Your Numbers" play spots for two dollars times five, and on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" for one dollar ten times shall win a regular prize award of twenty dollars;
(r) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for twenty dollars once shall win a regular prize award of twenty dollars;
(s) Holder of a valid winning ticket on which a "Gold Bar" symbol is revealed in one of the "Your Numbers" play spots for four dollars times ten, and on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for five dollars two times shall win a regular prize award of fifty dollars;
(t) Holder of a valid winning ticket on which a "Gold Bar" symbol is revealed in one of the "Your Numbers" play spots for five dollars times ten shall win a regular prize award of fifty dollars;
(u) Holder of a valid winning ticket on which a "Silver Bar" symbol is revealed in one of the "Your Numbers" play spots for six dollars times five and on which one of the "Winning Numbers" is matched by one of "Your Numbers" for twenty dollars once shall win a regular prize award of fifty dollars;
(v) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by eight of "Your Numbers" for five dollars six times and ten dollars two times shall win a regular prize award of fifty dollars;
(w) Holder of a valid winning ticket on which a "Silver Bar" symbol is revealed in one of the "Your Numbers" play spots for ten dollars times five shall win a regular prize award of fifty dollars;
(x) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by three of "Your Numbers" for twenty dollars two times and ten dollars once shall win a regular prize award of fifty dollars;
(y) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by fifteen of "Your Numbers" for two dollars eight times, four dollars once and five dollars six times shall win a regular prize award of fifty dollars;
(z) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for fifty dollars once shall win a regular prize award of fifty dollars;
(aa) Holder of a valid winning ticket on which a "Gold Bar" symbol is revealed in one of the "Your Numbers" play spots for ten dollars times ten shall win a regular prize award of one hundred dollars;
(bb) Holder of a valid winning ticket on which a "Silver Bar" symbol is revealed in one of the "Your Numbers" play spots for twenty dollars times five shall win a regular prize award of one hundred dollars;
(cc) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for one hundred dollars once shall win a regular prize award of one hundred dollars;
(dd) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by seven of "Your Numbers" for five dollars four times, ten dollars once, twenty dollars once and fifty dollars once shall win a regular prize award of one hundred dollars;
(ee) Holder of a valid winning ticket on which a "Gold Bar" symbol is revealed in one of the "Your Numbers" play spots for two dollars times ten, and on which one or more of the "Winning Numbers" are matched by four of "Your Numbers" for five dollars two times, twenty dollars once and fifty dollars once shall win a regular prize award of one hundred dollars;
(ff) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for five hundred dollars once shall win a regular prize award of five hundred dollars;
(gg) Holder of a valid winning ticket on which a "Silver Bar" symbol is revealed in one of the "Your Numbers" play spots for one hundred dollars times five shall win a regular prize award of five hundred dollars;
(hh) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by fifteen of "Your Numbers" for twenty dollars ten times, fifty dollars four times and one hundred dollars once shall win a regular prize award of five hundred dollars;
(ii) Holder of a valid winning ticket on which a "Gold Bar" symbol is revealed in one of the "Your Numbers" play spots for one hundred dollars times ten shall win a regular prize award of one thousand dollars;
(jj) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for one thousand dollars once shall win a regular prize award of one thousand dollars;
(kk) Holder of a valid winning ticket on which a "Gold Bar" symbol is revealed in one of the "Your Numbers" play spots for five hundred dollars times ten shall win a regular prize award of five thousand dollars;
(ll) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for five thousand dollars once shall win a regular prize award of five thousand dollars;
(mm) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" to reveal a "TPD" symbol shall win a regular prize award of five thousand five hundred dollars, and, upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing for a chance to win a grand prize of one hundred thousand dollar;
(nn) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for five thousand dollars two times shall win a regular prize award of ten thousand dollars;
(oo) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for ten thousand dollars once shall win a regular prize award of ten thousand dollars;
(pp) Holder of a valid winning ticket on which a "Gold Bar" symbol is revealed in one of the "Your Numbers" play spots for ten thousand dollars times ten shall win a regular prize award of one hundred thousand dollars; and
(qq) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for one hundred thousand dollars once shall win a regular prize award of one hundred thousand dollars.
(E) Number of prize awards. The number of prize awards in any sales cycle of game rule number seven hundred seventy-six will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:
(1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and
(2) Mathematical reasoning indicates that the number of winning tickets per four million tickets sold in the following prize categories should be as follows:
(a) One ticket matching numbers for one hundred thousand dollars once to win one hundred thousand dollars;
(b) One ticket revealing a "Gold Bar" symbol for ten thousand dollars times ten to win one hundred thousand dollars;
(c) Two tickets matching numbers for ten thousand dollars once to win ten thousand dollars:
(d) Two tickets matching numbers for five thousand dollars two times to win ten thousand dollars;
(e) Twenty tickets revealing the "TPD" prize symbol to win a prize award of five thousand five hundred dollars, and, upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing for a chance to win a grand prize of one hundred thousand dollars;.
(f) Fifty-five tickets matching numbers for five thousand dollars once to win five thousand dollars;
(g) Sixty tickets revealing a "Gold Bar" symbol for five hundred dollars times ten to win five thousand dollars;
(h) One hundred fifty tickets matching numbers for one thousand dollars once to win one thousand dollars;
(i) One hundred fifty tickets revealing a "Gold Bar" symbol for one hundred dollars times ten to win one thousand dollars;
(j) Two hundred fifty tickets matching numbers for twenty dollars ten times, fifty dollars four times and one hundred dollars once to win five hundred dollars;
(k) Two hundred fifty tickets revealing a "Silver Bar" symbol for one hundred dollars times five to win five hundred dollars; and
(l) Two hundred fifty tickets matching numbers for five hundred dollars once to win five hundred dollars.
(3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:
(a) One hundred tickets revealing a "Gold Bar" symbol for two dollars times ten, and matching numbers for five dollars two times, twenty dollars once and fifty dollars once to win one hundred dollars;
(b) One hundred tickets matching numbers for five dollars four times, ten dollars once, twenty dollars once and fifty dollars once to win one hundred dollars;
(c) Two hundred tickets matching numbers for one hundred dollars once to win one hundred dollars;
(d) Two hundred tickets revealing a "Silver Bar" symbol for twenty dollars times five to win one hundred dollars;
(e) Two hundred tickets revealing a "Gold Bar" symbol for ten dollars times ten to win one hundred dollars;
(f) One hundred tickets matching numbers for fifty dollars once to win fifty dollars;
(g) Two hundred tickets matching numbers for two dollars eight times, four dollars once and five dollars six times to win fifty dollars;
(h) One hundred tickets matching numbers for twenty dollars two times and ten dollars once to win fifty dollars;
(i) Two hundred tickets revealing a "Silver Bar" symbol for ten dollars times five to win fifty dollars;
(j) One hundred tickets matching numbers for five dollars six times and ten dollars two times to win fifty dollars;
(k) Two hundred tickets revealing a "Silver Bar" symbol for six dollars times five and matching numbers for twenty dollars once to win fifty dollars;
(l) Two hundred tickets revealing a "Gold Bar" symbol for five dollars times ten to win fifty dollars;
(m) Two hundred tickets revealing a "Gold Bar" symbol for four dollars times ten and matching numbers for five dollars two times to win fifty dollars;
(n) One thousand tickets matching numbers for twenty dollars once to win twenty dollars;
(o) Two thousand tickets revealing a "Silver Bar" symbol for two dollars times five and matching numbers for one dollar ten times to win twenty dollars;
(p) Two thousand tickets revealing a "Silver Bar" symbol for four dollars times five to win twenty dollars;
(q) Two thousand tickets matching numbers for two dollars ten times to win twenty dollars;
(r) One thousand tickets matching numbers for five dollars four times to win twenty dollars;
(s) One thousand tickets matching numbers for fifteen dollars once to win fifteen dollars;
(t) One thousand tickets matching numbers for five dollars once and ten dollars once to win fifteen dollars;
(u) Two thousand tickets matching numbers for one dollar fifteen times to win fifteen dollars;
(v) Two thousand tickets revealing a "Silver Bar" symbol for three dollars times five to win fifteen dollars;
(w) Two thousand tickets matching numbers for five dollars three times to win fifteen dollars;
(x) One thousand tickets matching numbers for ten dollars once to win ten dollars;
(y) Two thousand tickets revealing a "Gold Bar" symbol for one dollar times ten to win ten dollars;
(z) Two thousand tickets matching numbers for one dollar once, two dollars two times and five dollars once to win ten dollars;
(aa) Two thousand tickets revealing a "Silver Bar" symbol for two dollars times five to win ten dollars.
(bb) One thousand tickets matching numbers for five dollars two times to win ten dollars;
(cc) Four thousand tickets matching numbers for five dollars once to win five dollars;
(dd) Eight thousand tickets matching numbers for one dollar once and four dollars once to win five dollars; and
(ee) Twelve thousand tickets revealing a "Silver Bar" symbol for one dollar times five to win five dollars.
(F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.
(G) Frequency of prize drawings.
(1) Random imprinting of prize awards on all tickets issued in game rule number seven hundred seventy-six shall be accomplished in a manner which complies with the commission's rules and procedures.
(2) When a ticket issued in game rule number seven hundred seventy-six is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number seven hundred seventy-six in which the ticket was sold.
(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.
(I) Validity of tickets.
(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number seven hundred seventy-six void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.
(3) The Top Prize Drawing to award one grand prize of one hundred thousand dollars shall take place in accordance with rules and procedures established and approved by the director, and specifically, rule 3770:1-6-05 of the Administrative Code governing "Prize drawings" and rule 3770:1-6-06 of the Administrative Code governing "Special lottery drawings." Such drawings shall be held on dates determined and announced by the director, however, the earliest Top Prize Drawing date shall be one hundred eighty days from the game close date or when all tickets winning a prize value corresponding with a "TPD" symbol have been claimed, whichever is earlier.
(J) Director's conduct of game rule number seven hundred seventy-six.
(1) The director shall conduct game rule number seven hundred seventy-six and any promotions or drawings associated therewith in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number seven hundred seventy-six. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.
(2) Names and definitions of elements of game rule number seven hundred seventy-six used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number seven hundred seventy-six and these elements may be given names or titles chosen by the commission.
