3770:1-9-787. Game rule number seven hundred eighty-seven
-
(A) Title and term. Ohio lottery commission game rule number seven hundred eighty-seven, "Orange Twist," which shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number seven hundred eighty-seven.
(B) General design.
(1) Game rule number seven hundred eighty-seven is a match three like symbols game and is generally known as an "instant lottery."
(2) The player will remove the covering over the entire play are to reveal three play symbols in each of ten rows, "Spin 1" through "Spin 10" and ten corresponding prize values. If the player matches three like symbols in any one "Spin" across, the player wins the corresponding prize value shown in the "Prize" area for that "Spin". If the player reveals an "Orange" symbol in any "Spin" across, the player wins the corresponding prize value shown in the "Prize" area for that "Spin" automatically. If the player reveals a "Twist" symbol in any "Spin" across, the player wins all ten prizes automatically. There are ten chances to win on each ticket, and a player may win up to ten times on one ticket.
(3) The only "prize values" which shall appear on a ticket in game rule number seven hundred eighty-seven are: one dollar, two dollars, three dollars, four dollars, five dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars, one thousand dollars and ten thousand dollars. Numbers, prize values and play symbols appearing on any ticket in game rule number seven hundred eighty-seven shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.
(C) Price of tickets. The price of a ticket issued by the commission in game rule number seven hundred eighty-seven shall be two dollars.
(D) Structure, nature and value of prize awards.
(1) There shall be one type of prize in game rule number seven hundred eighty-seven called a "regular prize award."
(2) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: two dollars, three dollars, four dollars, five dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars, one thousand dollars and ten thousand dollars. Each ticket in game rule number seven hundred eighty-seven shall be imprinted in such a way that prize awards from the set listed above may be won.
(a) Holder of a valid winning ticket on which three identical symbols are revealed in two "Spins" across or on which an "Orange" symbol is revealed in two "Spins" across, or any combination thereof, for one dollar two times shall win a regular prize award of two dollars;
(b) Holder of a valid winning ticket on which three identical symbols are revealed in one "Spin" across or on which an "Orange" symbol is revealed in one "Spin" across for two dollars once shall win a regular prize award of two dollars;
(c) Holder of a valid winning ticket on which three identical symbols are revealed in three "Spins" across or on which an "Orange" symbol is revealed in three "Spins" across, or any combination thereof, for one dollar three times shall win a regular prize award of three dollars;
(d) Holder of a valid winning ticket on which three identical symbols are revealed in three "Spins" across or on which an "Orange" symbol is revealed in one "Spin" across for three dollars once shall win a regular prize award of three dollars;
(e) Holder of a valid winning ticket on which three identical symbols are revealed in four "Spins" across or on which an "Orange" symbol is revealed in four "Spins" across, or any combination thereof, for one dollar four times shall win a regular prize award of four dollars;
(f) Holder of a valid winning ticket on which three identical symbols are revealed in one "Spin" across or on which an "Orange" symbol is revealed in one "Spin" across for four dollars once shall win a regular prize award of four dollars;
(g) Holder of a valid winning ticket on which three identical symbols are revealed in two "Spins" across or on which an "Orange" symbol is revealed in two "Spins" across, or any combination thereof, for two dollars two times shall win a regular prize award of four dollars;
(h) Holder of a valid winning ticket on which three identical symbols are revealed in two "Spins" across or on which an "Orange" symbol is revealed in two "Spins" across, or any combination thereof, for one dollar once and three dollars once shall win a regular prize award of four dollars;
(i) Holder of a valid winning ticket on which three identical symbols are revealed in two "Spins" across or on which an "Orange" symbol is revealed in two "Spins" across, or any combination thereof, for one dollar once and four dollars once shall win a regular prize award of five dollars;
(j) Holder of a valid winning ticket on which three identical symbols are revealed in five "Spins" across or on which an "Orange" symbol is revealed in five "Spins" across, or any combination thereof, for one dollar five times shall win a regular prize award of five dollars;
(k) Holder of a valid winning ticket on which three identical symbols are revealed in two "Spins" across or on which an "Orange" symbol is revealed in two "Spins" across, or any combination thereof, for two dollars once and three dollars once shall win a regular prize award of five dollars;
(l) Holder of a valid winning ticket on which three identical symbols are revealed in one "Spin" across or on which an "Orange" symbol is revealed in one "Spin" across for five dollars once shall win a regular prize award of five dollars;
(m) Holder of a valid winning ticket on which three identical symbols are revealed in three "Spins" across or on which an "Orange" symbol is revealed in three "Spins" across, or any combination thereof, for two dollars once and four dollars two times shall win a regular prize award of ten dollars;
(n) Holder of a valid winning ticket revealing a "Twist" symbol in one "Spin" across for one dollar times ten shall win a regular prize award of ten dollars;
(o) Holder of a valid winning ticket on which three identical symbols are revealed in ten "Spins" across or on which an "Orange" symbol is revealed in ten "Spins" across, or any combination thereof, for one dollar ten times shall win a regular prize award of ten dollars;
(p) Holder of a valid winning ticket on which three identical symbols are revealed in five "Spins" across or on which an "Orange" symbol is revealed in five "Spins" across, or any combination thereof, for two dollars five times shall win a regular prize award of ten dollars;
(q) Holder of a valid winning ticket on which three identical symbols are revealed in one "Spin" across or on which an "Orange" symbol is revealed in one "Spin" across for ten dollars once shall win a regular prize award of ten dollars;
(r) Holder of a valid winning ticket on which three identical symbols are revealed in six "Spins" across or on which an "Orange" symbol is revealed in six "Spins" across, or any combination thereof, for two dollars five times and ten dollars once shall win a regular prize award of twenty dollars;
(s) Holder of a valid winning ticket revealing a "Twist" symbol in one "Spin" across for two dollars times ten shall win a regular prize award of twenty dollars;
(t) Holder of a valid winning ticket on which three identical symbols are revealed in ten "Spins" across or on which an "Orange" symbol is revealed in ten "Spins" across, or any combination thereof, for two dollars ten times shall win a regular prize award of twenty dollars;
(u) Holder of a valid winning ticket on which three identical symbols are revealed in one "Spin" across or on which an "Orange" symbol is revealed in one "Spin" across for twenty dollars once shall win a regular prize award of twenty dollars;
(v) Holder of a valid winning ticket revealing a "Twist" symbol in one "Spin" across for five dollars times ten shall win a regular prize award of fifty dollars;
(w) Holder of a valid winning ticket on which three identical symbols are revealed in eight "Spins" across or on which an "Orange" symbol is revealed in eight "Spins" across, or any combination thereof, for ten dollars three times and four dollars five times shall win a regular prize award of fifty dollars;
(x) Holder of a valid winning ticket on which three identical symbols are revealed in ten "Spins" across or on which an "Orange" symbol is revealed in ten "Spins" across, or any combination thereof, for five dollars ten times shall win a regular prize award of fifty dollars;
(y) Holder of a valid winning ticket on which three identical symbols are revealed in ten "Spins" across or on which an "Orange" symbol is revealed in ten "Spins" across, or any combination thereof, for two dollars five times, five dollars four times and twenty dollars once shall win a regular prize award of fifty dollars;
(z) Holder of a valid winning ticket on which three identical symbols are revealed in one "Spin" across or an "Orange" symbol is revealed in one "Spin" across for fifty dollars once shall win a regular prize award of fifty dollars;
(aa) Holder of a valid winning ticket revealing a "Twist" symbol in one "Spin" across for ten dollars times ten shall win a regular prize award of one hundred dollars;
(bb) Holder of a valid winning ticket on which three identical symbols are revealed in ten "Spins" across or on which an "Orange" symbol is revealed in ten "Spins" across, or any combination thereof, for ten dollars ten times shall win a regular prize award of one hundred dollars;
(cc) Holder of a valid winning ticket on which three identical symbols are revealed in two "Spins" across or on which an "Orange" symbol is revealed in two "Spins" across, or any combination thereof, for fifty dollars two times shall win a regular prize award of one hundred dollars;
(dd) Holder of a valid winning ticket on which three identical symbols are revealed in seven "Spins" across or on which an "Orange" symbol is revealed in seven "Spins" across, or any combination thereof, for one dollar once, four dollars once, five dollars once, ten dollars two times, twenty dollars once and fifty dollars once shall win a regular prize award of one hundred dollars;
(ee) Holder of a valid winning ticket on which three identical symbols are revealed in one "Spin" across or on which an "Orange" symbol is revealed in one "Spin" across for one hundred dollars once shall win a regular prize award of one hundred dollars;
(ff) Holder of a valid winning ticket on which three identical symbols are revealed in one "Spin" across or on which an "Orange" symbol is revealed in one "Spin" across for one thousand dollars once shall win a regular prize award of one thousand dollars;
(gg) Holder of a valid winning ticket on which three identical symbols are revealed in one "Spin" across or on which an "Orange" symbol is revealed in one "Spin" across for ten thousand dollars once shall win a regular prize award of ten thousand dollars; and
(hh) Holder of a valid winning ticket revealing a "Twist" symbol in one "Spin" across for one thousand dollars times ten shall win a regular prize award of ten thousand dollars.
(E) Number of prize awards. The number of prize awards in any sales cycle of game rule number seven hundred eighty-seven will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:
(1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance;
(2) Mathematical reasoning indicates that the number of winning tickets per six million tickets sold in the following prize categories should be as follows:
(a) Fifteen tickets revealing a "Twist" symbol in one "Spin" across for one thousand dollars times ten to win ten thousand dollars;
(b) Fifteen tickets revealing three identical symbols in one "Spin" across or revealing an "Orange" symbol in one "Spin" across for ten thousand dollars once to win ten thousand dollars; and
(c) One hundred thirty-five tickets revealing three identical symbols in one "Spin" across or revealing an "Orange" symbol in one "Spin" across for one thousand dollars once to win one thousand dollars.
(3) Mathematical reasoning indicates that the number of winning tickets per two hundred thousand tickets sold in the following prize categories should be as follows:
(a) Fifty tickets revealing three identical symbols in one "Spin" across or revealing an "Orange" symbol in one "Spin" across for one hundred dollars once to win one hundred dollars;
(b) Fifty tickets revealing three identical symbols in seven "Spins" across or revealing an "Orange" symbol in seven "Spins" across, or any combination thereof, for one dollar once, four dollars once, five dollars once, ten dollars two times, twenty dollars once and fifty dollars once to win one hundred dollars;
(c) Fifty tickets revealing three identical symbols in two "Spins" across or revealing an "Orange" symbol in two "Spins" across, or any combination thereof, for fifty dollars two times to win one hundred dollars;
(d) Fifty tickets revealing three identical symbols in ten "Spins" across or revealing an "Orange" symbol in ten "Spins" across, or any combination thereof, for ten dollars ten times to win one hundred dollars;
(e) One hundred tickets revealing a "Twist" symbol in one "Spin" across for ten dollars times ten to win one hundred dollars;
(f) Fifty tickets revealing three identical symbols in one "Spin" across or revealing an "Orange" symbol in one "Spin" across for fifty dollars once to win fifty dollars;
(g) One hundred tickets revealing three identical symbols in ten "Spins" across or revealing an "Orange" symbol in ten "Spins" across, or any combination thereof, for two dollars five times, five dollars four times and twenty dollars once to win fifty dollars;
(h) One hundred tickets revealing three identical symbols in ten "Spins" across or revealing an "Orange" symbol in ten "Spins" across, or any combination thereof, for five dollars ten times to win fifty dollars;
(i) One hundred tickets revealing three identical symbols in eight "Spins" across or revealing an "Orange" symbol in eight "Spins" across, or any combination thereof, for four dollars five times and ten dollars three times to win fifty dollars;
(j) Two hundred tickets revealing a "Twist" symbol in one "Spin" across for five dollars times ten to win fifty dollars;
(k) Five hundred tickets revealing three identical symbols in one "Spin" across or revealing an "Orange" symbol in one "Spin" across for twenty dollars once to win twenty dollars;
(l) Five hundred tickets revealing three identical symbols in ten "Spins" across or revealing an "Orange" symbol in ten "Spins" across, or any combination thereof, for two dollars ten times to win twenty dollars;
(m) Five hundred tickets revealing a "Twist" symbol in one "Spin" across for two dollars times ten to win twenty dollars;
(n) Five hundred tickets revealing three identical symbols in six "Spins" across or revealing an "Orange" symbol in six "Spins" across, or any combination thereof, for two dollars five times and ten dollars once to win twenty dollars;
(o) Five hundred tickets revealing three identical symbols in one "Spin" across or revealing an "Orange" symbol in one "Spin" across for ten dollars once to win ten dollars;
(p) Five hundred tickets revealing three identical symbols in five "Spins" across or revealing an "Orange" symbol in five "Spins" across, or any combination thereof, for two dollars five times to win ten dollars;
(q) Five hundred tickets revealing three identical symbols in ten "Spins" across or revealing an "Orange" symbol in ten "Spins" across, or any combination thereof, for one dollar ten times to win ten dollars;
(r) Two thousand tickets revealing a "Twist" symbol in one "Spin" across for one dollar times ten to win ten dollars;
(s) Five hundred tickets revealing three identical symbols in three "Spins" across or revealing an "Orange" symbol in three "Spins" across, or any combination thereof, for two dollars once and four dollars two times to win ten dollars;
(t) One thousand tickets revealing three identical symbols in one "Spin" across or revealing an "Orange" symbol in one "Spin" across for five dollars once to win five dollars;
(u) One thousand tickets revealing three identical symbols in two "Spins" across or revealing an "Orange" symbol in two "Spins" across, or any combination thereof, for two dollars once and three dollars once to win five dollars;
(v) One thousand tickets revealing three identical symbols in five "Spins" across or revealing an "Orange" symbol in five "Spins" across, or any combination thereof, for one dollar five times to win five dollars;
(w) One thousand tickets revealing three identical symbols in two "Spins" across or revealing an "Orange" symbol in two "Spins" across, or any combination thereof, for one dollar once and four dollars once to win five dollars;
(x) Two thousand tickets revealing three identical symbols in two "Spins" across or revealing an "Orange" symbol in two "Spins" across, or any combination thereof, for one dollar once and three dollars once to win four dollars;
(y) Two thousand tickets revealing three identical symbols in two "Spins" across or revealing an "Orange" symbol in two "Spins" across, or any combination thereof, for two dollars two times to win four dollars;
(z) Two thousand tickets revealing three identical symbols in one "Spin" across or revealing an "Orange" symbol in one "Spin" across for four dollars once to win four dollars;
(aa) Four thousand tickets revealing three identical symbols in four "Spins" across or revealing an "Orange" symbol in four "Spins" across, or any combination thereof, for one dollar four times to win four dollars;
(bb) Two thousand tickets revealing three identical symbols in one "Spin" across or revealing an "Orange" symbol in one "Spin" across for three dollars once to win three dollars;
(cc) Two thousand tickets revealing three identical symbols in three "Spins" across or revealing an "Orange" symbol in three "Spins" across, or any combination thereof, for one dollar three times to win three dollars;
(dd) Ten thousand tickets revealing three identical symbols in one "Spin" across or revealing an "Orange" symbol in one "Spin" across for two dollars once to win two dollars; and
(ee) Eight thousand tickets revealing three identical symbols in two "Spins" across or revealing an "Orange" symbol in two "Spins" across, or any combination thereof, for one dollar two times to win two dollars.
(F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.
(G) Frequency of prize drawings.
(1) Random imprinting of prize awards on all tickets issued in game rule number seven hundred eighty-seven shall be accomplished in a manner which complies with the commission's rules and procedures.
(2) When a ticket issued in game rule number seven hundred eighty-seven is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number seven hundred eighty-seven in which the ticket was sold.
(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.
(I) Validity of tickets.
(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number seven hundred eighty-seven void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.
(J) Director's conduct of game rule number seven hundred eighty-seven.
(1) The director shall conduct game rule number seven hundred eighty-seven in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number seven hundred eighty-seven. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.
(2) Names and definitions of elements of game rule number seven hundred eighty-seven used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number seven hundred eighty-seven and these elements may be given names or titles chosen by the commission.
