  • (A) Title and term. Ohio lottery commission game rule number seven hundred ninety-six, "Red, White & Blue 7's," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number seven hundred ninety-six.

    (B) General design.

    (1) Game rule number seven hundred ninety-six is a match game and is generally known as an "instant lottery."

    (2) Holders of valid tickets will remove the covering off the entire play area to reveal ten symbols and ten corresponding prize values. If the player reveals a "White Seven" symbol, the player wins the corresponding prize value automatically. If the player reveals a "Red Seven" symbol, the player wins two times the corresponding prize value and if the player reveals a "Blue Seven" symbol, the player wins five times the corresponding prize value. There are ten chances to win on each ticket, and a player may win up to ten times on one ticket.

    (3) The only "prize values" which shall appear on a ticket in game rule number seven hundred ninety-six are: one dollar, two dollars, three dollars, four dollars, five dollars, six dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars, five hundred dollars and seven thousand seven hundred seventy-seven dollars. Numbers, prize values and play symbols appearing on any ticket in game rule number seven hundred ninety-six shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.

    (C) Price of tickets. The price of a ticket issued by the commission in game rule number seven hundred ninety-six shall be two dollars.

    (D) Structure, nature and value of prize awards.

    (1) There shall be one type of prize in game rule number seven hundred ninety-six, a "regular prize award."

    (2) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: two dollars, three dollars, four dollars, five dollars, six dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars, five hundred dollars and seven thousand seven hundred seventy-seven dollars. Each ticket in game rule number seven hundred ninety-six shall be imprinted in such a way that prize awards from the set listed above may be won.

    (a) Holder of a valid winning ticket on which a "Red Seven" symbol is revealed in one play spot for one dollar two times shall win a regular prize award of two dollars;

    (b) Holder of a valid winning ticket on which a "White Seven" symbol is revealed in one play spot for two dollars once shall win a regular prize award of two dollars;

    (c) Holder of a valid winning ticket on which a "Red Seven" symbol is revealed in one play spot for one dollar two times and a "White Seven" is revealed in one play spot for one dollar once shall win a regular prize award of three dollars;

    (d) Holder of a valid winning ticket on which "White Seven" symbols are revealed in three play spots for one dollar three times shall win a regular prize award of three dollars;

    (e) Holder of a valid winning ticket on which a "White Seven" symbol is revealed in one play spot for three dollars once shall win a regular prize award of three dollars;

    (f) Holder of a valid winning ticket on which "White Seven" symbols are revealed in two play spots for one dollar once and two dollars once shall win a regular prize award of three dollars;

    (g) Holder of a valid winning ticket on which a "White Seven" symbol is revealed in one play spot for four dollars once shall win a regular prize award of four dollars;

    (h) Holder of a valid winning ticket on which "White Seven" symbols are revealed in four play spots for one dollar four times shall win a regular prize award of four dollars;

    (i) Holder of a valid winning ticket on which a "Red Seven" symbol is revealed in one play spot for two dollars two times shall win a regular prize award of four dollars;

    (j) Holder of a valid winning ticket on which a "Red Seven" symbol is revealed in one play spot for one dollar two times and "White Seven" symbols are revealed in two play spots for two dollars once and one dollar once shall win a regular prize award of five dollars;

    (k) Holder of a valid winning ticket on which a "Blue Seven" symbol is revealed in one play spot for one dollar five times shall win a regular prize award of five dollars;

    (l) Holder of a valid winning ticket on which "White Seven" symbols are revealed in five play spots for one dollar five times shall win a regular prize award of five dollars;

    (m) Holder of a valid winning ticket on which a "White Seven" symbol is revealed in one play spot for five dollars once shall win a regular prize award of five dollars;

    (n) Holder of a valid winning ticket on which "White Seven" symbols are revealed in six play spots for one dollar six times shall win a regular prize award of six dollars;

    (o) Holder of a valid winning ticket on which a "Red Seven" symbol is revealed in one play spot for three dollars two times shall win a regular prize award of six dollars;

    (p) Holder of a valid winning ticket on which a "White Seven" symbol is revealed in one play spot for six dollars once shall win a regular prize award of six dollars;

    (q) Holder of a valid winning ticket on which a "White Seven" symbol is revealed in one play spot for two dollars once and a "Red Seven" symbol is revealed in one play spot for four dollars two times shall win a regular prize award of ten dollars;

    (r) Holder of a valid winning ticket on which "White Seven" symbols are revealed in ten play spots for one dollar ten times shall win a regular prize award of ten dollars;

    (s) Holder of a valid winning ticket on which a "Blue Seven" symbol is revealed in one play spot for two dollars five times shall win a regular prize award of ten dollars;

    (t) Holder of a valid winning ticket on which a "White Seven" symbol is revealed in one play spot for ten dollars once shall win a regular prize award of ten dollars;

    (u) Holder of a valid winning ticket on which a "Blue Seven" symbol is revealed in one play spot for two dollars five times and a "White Seven" is revealed in one play spot for ten dollars once shall win a regular prize award of twenty dollars;

    (v) Holder of a valid winning ticket on which "White Seven" symbols are revealed in ten play spots for two dollars ten times shall win a regular prize award of twenty dollars;

    (w) Holder of a valid winning ticket on which a "Red Seven" symbol is revealed in one play spot for ten dollars two times shall win a regular prize award of twenty dollars;

    (x) Holder of a valid winning ticket on which a "White Seven" symbol is revealed in one play spot for twenty dollars once shall win a regular prize award of twenty dollars;

    (y) Holder of a valid winning ticket on which "White Seven" symbols are revealed in ten play spots for five dollars ten times shall win a regular prize award of fifty dollars;

    (z) Holder of a valid winning ticket on which a "Red Seven" symbol is revealed in one play spot for twenty dollars two times and a "White Seven" symbol is revealed in one play spot for ten dollars once shall win a regular prize award of fifty dollars;

    (aa) Holder of a valid winning ticket on which a "Blue Seven" symbol is revealed in one play spot for two dollars five times and "White Seven" symbols are revealed in five play spots for twenty dollars once and five dollars four times shall win a regular prize award of fifty dollars;

    (bb) Holder of a valid winning ticket on which a "White Seven" symbol is revealed in one play spot for fifty dollars once shall win a regular prize award of fifty dollars;

    (cc) Holder of a valid winning ticket on which "White Seven" symbols are revealed in ten play spots for ten dollars ten times shall win a regular prize award of one hundred dollars;

    (dd) Holder of a valid winning ticket on which a "Red Seven" symbol is revealed in one play spot for fifty dollars two times shall win a regular prize award of one hundred dollars;

    (ee) Holder of a valid winning ticket on which a "White Seven" symbol is revealed in one play spot for one hundred dollars once shall win a regular prize award of one hundred dollars;

    (ff) Holder of a valid winning ticket on which a "Blue Seven" symbol is revealed in one play spot for one hundred dollars five times shall win a regular prize award of five hundred dollars;

    (gg) Holder of a valid winning ticket on which a "White Seven" symbol is revealed in one play spot for five hundred dollars once shall win a regular prize award of five hundred dollars; and

    (hh) Holder of a valid winning ticket on which a "White Seven" symbol is revealed in one play spot for seven thousand seven hundred seventy-seven dollars once shall win a regular prize award of seven thousand seven hundred seventy-seven dollars.

    (E) Number of prize awards. The number of prize awards in any sales cycle of game rule number seven hundred ninety-six will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:

    (1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

    (2) Mathematical reasoning indicates that the number of winning tickets per four million tickets sold in the following prize categories should be as follows:

    (a) Thirty tickets revealing a "White Seven" symbol for seven thousand seven hundred seventy-seven dollars once to win seven thousand seven hundred seventy-seven dollars;

    (b) One hundred tickets revealing a "White Seven" symbol for five hundred dollars once to win five hundred dollars; and

    (c) One hundred tickets revealing a "Blue Seven" symbol for one hundred dollars five times to win five hundred dollars.

    (3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:

    (a) Fifty tickets revealing a "White Seven" symbol for one hundred dollars once to win one hundred dollars;

    (b) One hundred forty tickets revealing a "Red Seven" symbol for fifty dollars two times to win one hundred dollars;

    (c) Fifty tickets revealing "White Seven" symbols for ten dollars ten times to win one hundred dollars;

    (d) Fifty tickets revealing a "White Seven" symbol for fifty dollars once to win fifty dollars;

    (e) One hundred fifty tickets revealing a "Blue Seven" symbol for two dollars five times and revealing "White Seven" symbols for twenty dollars once and five dollars four times to win fifty dollars;

    (f) One hundred fifty tickets revealing a "Red Seven" symbol for twenty dollars two times and revealing a "White Seven" symbol for ten dollars once to win fifty dollars;

    (g) One hundred tickets revealing "White Seven" symbols for five dollars ten times to win fifty dollars;

    (h) Five hundred tickets revealing a "White Seven" symbol for twenty dollars once to win twenty dollars;

    (i) Five hundred tickets revealing a "Red Seven" symbol for ten dollars two times to win twenty dollars;

    (j) Five hundred tickets revealing "White Seven" symbols for two dollars ten times to win twenty dollars;

    (k) Five hundred tickets revealing a "Blue Seven" symbol for two dollars five times and revealing a "White Seven" symbol for ten dollars once to win twenty dollars;

    (l) Five hundred tickets revealing a "White Seven" symbol for ten dollars once to win ten dollars;

    (m) One thousand tickets revealing a "Blue Seven" symbol for two dollars five times to win ten dollars;

    (n) Five hundred tickets revealing "White Seven" symbols for one dollar ten times to win ten dollars;

    (o) Two thousand tickets revealing a "White Seven" symbol for two dollars once and revealing a "Red Seven" symbol for four dollars two times to win ten dollars;

    (p) Five hundred tickets revealing a "White Seven" symbol for six dollars once to win six dollars;

    (q) One thousand tickets revealing a "Red Seven" symbol for three dollars two times to win six dollars;

    (r) Five hundred tickets revealing "White Seven" symbols for one dollar six times to win six dollars;

    (s) Five hundred tickets revealing a "White Seven" symbol for five dollars once to win five dollars;

    (t) Five hundred tickets revealing "White Seven" symbols for one dollar five times to win five dollars;

    (u) Two thousand tickets revealing a "Blue Seven" symbol for one dollar five times to win five dollars;

    (v) One thousand tickets revealing a "Red Seven" symbol for one dollar two times and revealing "White Seven" symbols for two dollars once and one dollar once to win five dollars;

    (w) One thousand tickets revealing a "Red Seven" symbol for two dollars two times to win four dollars;

    (x) Five hundred tickets revealing "White Seven" symbols for one dollar four times to win four dollars;

    (y) Five hundred tickets revealing a "White Seven" symbol for four dollars once to win four dollars;

    (z) Two thousand tickets revealing "White Seven" symbols for one dollar once and two dollars once to win three dollars;

    (aa) Two thousand tickets revealing a "White Seven" symbol for three dollars once to win three dollars;

    (bb) Six thousand tickets revealing "White Seven" symbols for one dollar three times to win three dollars;

    (cc) Eight thousand tickets revealing a "Red Seven" symbol for one dollar two times and revealing a "White Seven" symbol for one dollar once to win three dollars;

    (dd) Four thousand tickets revealing a "White Seven" symbol for two dollars once to win two dollars; and

    (ee) Eight thousand tickets revealing a "Red Seven" symbol for one dollar two times to win two dollars.

    (F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

    (G) Frequency of prize drawings.

    (1) Random imprinting of prize awards on all tickets issued in game rule seven hundred ninety-six shall be accomplished in a manner which complies with the commission's rules and procedures.

    (2) When a ticket issued in game rule number seven hundred ninety-six is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game number seven hundred ninety-six in which the ticket is sold.

    (H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

    (I) Validity of tickets.

    (1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number seven hundred ninety-six void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

    (J) Director's conduct in game rule seven hundred ninety-six.

    (1) The director shall conduct game rule number seven hundred ninety-six and any promotions or drawings associated therewith in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number seven hundred ninety-six. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

    (2) Names and definitions of elements of game rule number seven hundred ninety-six used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number seven hundred ninety-six and these elements may be given names or titles chosen by the commission.
