3770:1-9-828. Game rule number eight hundred twenty-eight
-
(A) Title and term. Ohio lottery commission game rule number eight hundred twenty-eight, "Lucky Times 10," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number eight hundred twenty-eight.
(B) General design.
(1) Game rule number eight hundred twenty-eight is a key number match game with an instant win feature and a "Bonus" multiplying feature, and is generally known as an "instant lottery."
(2) Holders of valid tickets will remove the covering off the entire play area to reveal three "Lucky Numbers," ten "Your Numbers" and ten corresponding prize values. If any one or more of "Your Number(s)" matches one or more of the "Lucky Number(s)," the player wins the corresponding prize value(s) shown below the matching "Your Number(s)." If the player reveals a "Star" symbol in any of the "Your Numbers" play areas, the player wins its corresponding prize value automatically. The player will then scratch the "Bonus" number play area under which a number will be revealed. The player will multiply the total prize amount won in the main play area by the "Bonus" number revealed to determine the total prize award. "Bonus" numbers may include the numbers one, two, three, four, five, seven and ten. Revealing a "one" in the "Bonus" number does not increase the prize amount won in the main play area. If the player matches any one of "Your Numbers" to one of the "Lucky Numbers" or a "Star" symbol is revealed in any of the "Your Numbers" play areas and the corresponding prize value revealed is a "TPD" symbol, the player wins five thousand five hundred dollars automatically, and, upon the filing of a valid claim at an Ohio lottery commission office, shall also automatically be entered in the Top Prize Drawing ("TPD") for a chance to win a two hundred fifty thousand dollar top prize. The Top Prize Drawing shall be conducted in accordance with Ohio lottery rules and procedures established and approved by the director. There are ten chances to win on each ticket, and a player may win up to ten times on one ticket.
(3) The only "prize values" which shall appear on a ticket in game rule number eight hundred twenty-eight are: one dollar, two dollars, five dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars, five hundred dollars, one thousand dollars, five thousand dollars, the "TPD" symbol corresponding to a prize value of five thousand five hundred dollars, fifty thousand dollars and two hundred fifty thousand dollars. Numbers, prize values and play symbols appearing on any ticket in game rule number eight hundred twenty-eight shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.
(C) Price of tickets. The price of a ticket issued by the commission in game rule number eight hundred twenty-eight shall be five dollars.
(D) Structure, nature and value of prize awards.
(1) There shall be two types of prizes in game rule number eight hundred twenty-eight, a "regular prize award" and a "TPD" prize award.
(2) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket or the total of all winning prize values multiplied by any applicable "Bonus" number: five dollars, ten dollars, twenty dollars, thirty-five dollars, fifty dollars, seventy-five dollars, one hundred dollars, five hundred dollars, one thousand dollars, five thousand dollars, five thousand five hundred dollars, fifty thousand dollars and two hundred fifty thousand dollars. Each ticket in game rule number eight hundred twenty-eight shall be imprinted in such a way that prize awards from the set listed above may be won
(a) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for five dollars with a multiplying "Bonus" number of one shall win a regular prize award of five dollars;
(b) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for one dollar with a multiplying "Bonus" number of five shall win a regular prize award of five dollars;
(c) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by five of "Your Numbers" for one dollar each with a multiplying "Bonus" number of one shall win a regular prize award of five dollars;
(d) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for ten dollars with a multiplying "Bonus" number of one shall win a regular prize award of ten dollars;
(e) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for five dollars with a multiplying "Bonus" number of two shall win a regular prize award of ten dollars;
(f) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for one dollar with a multiplying "Bonus" number of ten shall win a regular prize award of ten dollars;
(g) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by five of "Your Numbers" for one dollar each with a multiplying "Bonus" number of two shall win a regular prize award of ten dollars;
(h) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for twenty dollars with a multiplying "Bonus" number of one shall win a regular prize award of twenty dollars;
(i) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for ten dollars with a multiplying "Bonus" number of two shall win a regular prize award of twenty dollars;
(j) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by two of "Your Numbers" for five dollars each with a multiplying "Bonus" number of two shall win a regular prize award of twenty dollars;
(k) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by two of "Your Numbers" for ten dollars each with a multiplying "Bonus" number of one shall win a regular prize award of twenty dollars;
(l) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by five of "Your Numbers" for one dollar each and one of "Your Numbers" for five dollars once with a multiplying "Bonus" number of two shall win a regular prize award of twenty dollars;
(m) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for five dollars with a multiplying "Bonus" number of four shall win a regular prize award of twenty dollars;
(n) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by four of "Your Numbers" for one dollar each with a multiplying "Bonus" number of five shall win a regular prize award of twenty dollars;
(o) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by two of "Your Numbers" for one dollar each with a multiplying "Bonus" number of ten shall win a regular prize award of twenty dollars;
(p) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by five of "Your Numbers" for one dollar each with a multiplying "Bonus" number of seven shall win a regular prize award of thirty-five dollars;
(q) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for fifty dollars with a multiplying "Bonus" number of one shall win a regular prize award of fifty dollars;
(r) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for ten dollars with a multiplying "Bonus" number of five shall win a regular prize award of fifty dollars;
(s) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for five dollars with a multiplying "Bonus" number of ten shall win a regular prize award of fifty dollars;
(t) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for five dollars with a multiplying "Bonus" number of five and one or more of the "Lucky Numbers" are matched by five of "Your Numbers" for one dollar each with a multiplying "Bonus" number of five shall win a regular prize award of fifty dollars;
(u) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by two of "Your Numbers" for ten dollars each and six of "Your Numbers" for five dollars each with a multiplying "Bonus" of one shall win a regular prize award of fifty dollars;
(v) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by ten of "Your Numbers" for five dollars each with a multiplying "Bonus" number of one shall win a regular prize award of fifty dollars;
(w) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by five of "Your Numbers" for two dollars each with a multiplying "Bonus" number of five shall win a regular prize award of fifty dollars;
(x) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by two of "Your Numbers" for ten dollars each and one of "Your Numbers" for five dollars with a multiplying "Bonus" number of three shall win a regular prize award of seventy-five dollars;
(y) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by two of "Your Numbers" for twenty dollars each, three of "Your Numbers" for ten dollars each and one of "Your Numbers" for five dollars with a multiplying "Bonus" number of one shall win a regular prize award of seventy-five dollars;
(z) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for fifty dollars with a multiplying "Bonus" number of two shall win a regular prize award of one hundred dollars;
(aa) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by two of "Your Numbers" for ten dollars each with a multiplying "Bonus" number of five shall win a regular prize award of one hundred dollars;
(bb) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by five of "Your Numbers" for twenty dollars each with a multiplying "Bonus" number of one shall win a regular prize award of one hundred dollars;
(cc) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by one of "Your Numbers" for five dollars and five of "Your Numbers" for one dollar each with a multiplying "Bonus" number of ten shall win a regular prize award of one hundred dollars;
(dd) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by ten of "Your Numbers" for one dollar each with a multiplying "Bonus" number of ten shall win a regular prize award of one hundred dollars;
(ee) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by ten of "Your Numbers" for two dollars each with a multiplying "Bonus" number of five shall win a regular prize award of one hundred dollars;
(ff) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by five of "Your Numbers" for ten dollars each with a multiplying "Bonus" number of two shall win a regular prize award of one hundred dollars;
(gg) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by ten of "Your Numbers" for ten dollars each with a multiplying "Bonus" number of one shall win a regular prize award of one hundred dollars;
(hh) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for fifty dollars with a multiplying "Bonus" number of ten shall win a regular prize award of five hundred dollars;
(ii) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by three of "Your Numbers" for fifty dollars each and five of "Your Numbers" for twenty dollars each with a multiplying "Bonus" number of two shall win a regular prize award of five hundred dollars;
(jj) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by five of "Your Numbers" for one hundred dollars each with a multiplying "Bonus" number of one shall win a regular prize award of five hundred dollars;
(kk) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for five hundred dollars with a multiplying "Bonus" number of one shall win a regular prize award of five hundred dollars;
(ll) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by ten of "Your Numbers" for five dollars each with a multiplying "Bonus" number of ten shall win a regular prize award of five hundred dollars;
(mm) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by five of "Your Numbers" for ten dollars each with a multiplying "Bonus" number of ten shall win a regular prize award of five hundred dollars;
(nn) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by ten of "Your Numbers" for ten dollars each with a multiplying "Bonus" number of five shall win a regular prize award of five hundred dollars;
(oo) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by four of "Your Numbers" for fifty dollars once, twenty dollars two times and ten dollars with a multiplying "Bonus" number of ten shall win a regular prize award of one thousand dollars;
(pp) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by two of "Your Numbers" for one hundred dollars each with a multiplying "Bonus" number of five shall win a regular prize award of one thousand dollars;
(qq) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for one thousand dollars with a multiplying "Bonus" number of one shall win a regular prize award of one thousand dollars;
(rr) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by ten of "Your Numbers" for ten dollars each with a multiplying "Bonus" number of ten shall win a regular prize award of one thousand dollars;
(ss) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by ten of "Your Numbers" for one hundred dollars each with a multiplying "Bonus" number of one shall win a regular prize award of one thousand dollars;
(tt) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by two of "Your Numbers" for five hundred dollars each with a multiplying "Bonus" number of one shall win a regular prize award of one thousand dollars;
(uu) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for five hundred dollars with a multiplying "Bonus" number of ten shall win a regular prize award of five thousand dollars;
(vv) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by two of "Your Numbers" for five hundred dollars once and two thousand dollars once with a multiplying "Bonus" number of two shall win a regular prize award of five thousand dollars;
(ww) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by ten of "Your Numbers" for five hundred dollars each with a multiplying "Bonus" number of one shall win a regular prize award of five thousand dollars;
(xx) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for five thousand dollars with a multiplying "Bonus" number of one shall win a regular prize award of five thousand dollars;
(yy) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by ten of "Your Numbers" for one hundred dollars each with a multiplying "Bonus" number of five shall win a regular prize award of five thousand dollars;
(zz) Holder of a valid winning ticket on which one or more of the "Lucky Numbers" are matched by five of "Your Numbers" for one hundred dollars each with a multiplying "Bonus" number of ten shall win a regular prize award of five thousand dollars;
(aaa) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play areas and a "TPD" prize symbol is revealed for five thousand five hundred dollars shall win a regular prize award of five thousand five hundred dollars, and, upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing for a chance to win a two hundred fifty thousand dollar top prize;
(bbb) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for fifty thousand dollars with a multiplying "Bonus" number of one shall win a regular prize award of fifty thousand dollars;
(ccc) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for five thousand dollars with a multiplying "Bonus" number of ten shall win a regular prize award of fifty thousand dollars
(ddd) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for fifty thousand dollars with a multiplying "Bonus" number of five shall win a regular prize award of two hundred fifty thousand dollars; and
(eee) Holder of a valid winning ticket on which one of the "Lucky Numbers" is matched by one of "Your Numbers" for two hundred fifty thousand dollars with a multiplying "Bonus" number of one shall win a regular prize award of two hundred fifty thousand dollars.
(E) Number of prize awards. The number of prize awards in any sales cycle of game rule number eight hundred twenty-eight will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:
(1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and
(2) Mathematical reasoning indicates that the number of winning tickets per six million tickets sold in the following prize categories should be as follows
(a) Two tickets matching numbers for two hundred fifty thousand dollars with a multiplying "Bonus" number of one to win two hundred fifty thousand dollars;
(b) Two tickets matching numbers for fifty thousand dollars with a multiplying "Bonus" number of five to win two hundred fifty thousand dollars;
(c) Six tickets matching numbers for five thousand dollars with a multiplying "Bonus" number of ten to win fifty thousand dollars;
(d) Five tickets matching numbers for fifty thousand dollars with a multiplying "Bonus" number of one to win fifty thousand dollars;
(e) Thirty tickets matching numbers for five thousand five hundred dollars by revealing the "TPD" prize symbol, and, upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing for a chance to win a two hundred fifty thousand dollar top prize;
(f) Four tickets matching numbers for one hundred dollars five times with a multiplying "Bonus" number of ten to win five thousand dollars;
(g) Four tickets matching numbers for one hundred dollars ten times with a multiplying "Bonus" number of five to win five thousand dollars;
(h) Four tickets matching numbers for five thousand dollars with a multiplying "Bonus" number of one to win five thousand dollars;
(i) Four tickets matching numbers for five hundred dollars ten times with a multiplying "Bonus" number of one to win five thousand dollars;
(j) Four tickets matching numbers for five hundred dollars once and two thousand dollars once with a multiplying "Bonus" number of two to win five thousand dollars;
(k) Four tickets matching numbers for five hundred dollars with a multiplying "Bonus" number of ten to win five thousand dollars;
(l) Sixteen tickets matching numbers for five hundred dollars two times with a multiplying "Bonus" number of one to win one thousand dollars;
(m) Sixteen tickets matching numbers for one hundred dollars ten times with a multiplying "Bonus" number of one to win one thousand dollars;
(n) Sixteen tickets matching numbers for ten dollars ten times with a multiplying "Bonus" number of ten to win one thousand dollars;
(o) Sixteen tickets matching numbers for one thousand dollars with a multiplying "Bonus" number of one to win one thousand dollars;
(p) Sixteen tickets matching numbers for one hundred dollars two times with a multiplying "Bonus" number of five to win one thousand dollars;
(q) Sixteen tickets matching numbers for fifty dollars once, twenty dollars two times and ten dollars once with a multiplying "Bonus" number of ten to win one thousand dollars;
(r) Thirty tickets matching numbers for ten dollars ten times with a multiplying "Bonus" number of five to win five hundred dollars;
(s) Thirty tickets matching numbers for ten dollars five times with a multiplying "Bonus" number of ten to win five hundred dollars;
(t) Thirty tickets matching numbers for five dollars ten times with a multiplying "Bonus" number of ten to win five hundred dollars;
(u) Thirty tickets matching numbers for five hundred dollars with a multiplying "Bonus" number of one to win five hundred dollars;
(v) Thirty tickets matching numbers for one hundred dollars five times with a multiplying "Bonus" number of one to win five hundred dollars;
(w) Thirty tickets matching numbers for fifty dollars three times and twenty dollars five times with a multiplying "Bonus" number of two to win five hundred dollars;
(x) Thirty tickets matching numbers for fifty dollars with a multiplying "Bonus" number of ten to win five hundred dollars;
(y) Seven hundred fifty tickets matching numbers for ten dollars ten times with a multiplying "Bonus" number of one to win one hundred dollars;
(z) Seven hundred fifty tickets matching numbers for ten dollars five times with a multiplying "Bonus" number of two to win one hundred dollars;
(aa) Seven hundred fifty tickets matching numbers for two dollars ten times with a multiplying "Bonus" number of five to win one hundred dollars;
(bb) Seven hundred fifty tickets matching numbers for one dollar ten times with a multiplying "Bonus" number of ten to win one hundred dollars;
(cc) Seven hundred fifty tickets matching numbers for five dollars once and one dollar five times with a multiplying "Bonus" number of ten to win one hundred dollars;
(dd) Seven hundred fifty tickets matching numbers for twenty dollars five times with a multiplying "Bonus" number of one to win one hundred dollars;
(ee) Seven hundred fifty tickets matching numbers for ten dollars two times with a multiplying "Bonus" number of five to win one hundred dollars;
(ff) Seven hundred fifty tickets matching numbers for fifty dollars with a multiplying "Bonus" number of two to win one hundred dollars;
(gg) One thousand five hundred tickets matching numbers for twenty dollars two times, ten dollars three times and five dollars once with a multiplying "Bonus" number of one to win seventy-five dollars;
(hh) One thousand five hundred tickets matching numbers for ten dollars two times and five dollars once with a multiplying "Bonus" number of three to win seventy-five dollars;
(ii) Four thousand five hundred tickets matching numbers for two dollars five times with a multiplying "Bonus" number of five to win fifty dollars;
(jj) Four thousand five hundred tickets matching numbers for five dollars ten times with a multiplying "Bonus" number of one to win fifty dollars;
(kk) Four thousand five hundred tickets matching numbers for ten dollars two times and five dollars six times with a multiplying "Bonus" number of one to win fifty dollars;
(ll) Four thousand five hundred tickets matching numbers for five dollars once and one dollar five times with a multiplying "Bonus" number of five to win fifty dollars;
(mm) Four thousand five hundred tickets matching numbers for five dollars with a multiplying "Bonus" number of ten to win fifty dollars;
(nn) Four thousand five hundred tickets matching numbers for ten dollars with a multiplying "Bonus" number of five to win fifty dollars;

(tt) Thirty thousand tickets matching numbers for one dollar five times and five dollars once with a multiplying "Bonus" number of two to win twenty dollars;

(eee) Two hundred forty thousand tickets matching numbers for five dollars with a multiplying "Bonus" number of one to win five dollars.
(F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.
(G) Frequency of prize drawings.
(1) Random imprinting of prize awards on all tickets issued in game rule number eight hundred twenty-eight shall be accomplished in a manner, which complies with the commission's rules and procedures.
(2) When a ticket issued in game rule number eight hundred twenty-eight is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number eight hundred twenty-eight in which the ticket was sold.
(3) The Top Prize Drawing to award one top prize of two hundred fifty thousand dollars shall take place in accordance with rules and procedures established and approved by the director, and specifically, rule 3770:1-6-05 of the Administrative Code governing"Prize drawings" and rule 3770:1-6-06 of the Administrative Code governing"Special lottery drawings." Such drawings shall be held on dates determined and announced by the director, however, the earliest Top Prize Drawing date shall be one hundred eighty days from the game close date or when all tickets winning a prize value corresponding with a "TPD" symbol have been claimed, whichever is earlier.
(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.
(I) Validity of tickets.
(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number eight hundred twenty-eight void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.
(J) Director's conduct of game rule number eight hundred twenty-eight.
(1) The director shall conduct game rule number eight hundred twenty-eight and any drawings or promotions associated therewith in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game and any drawings or promotions associated therewith. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number eight hundred twenty-eight. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.
(2) Names and definitions of elements of game rule number eight hundred twenty-eight used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number eight hundred twenty-eight and these elements may be given names or titles chosen by the commission.
