3770:1-9-845. Game rule number eight hundred forty-five
-
(A) Title and term. Ohio lottery commission game rule number eight hundred forty-five, "Electric 8's Doubler" shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number eight hundred forty-five;
(B) General design.
(1) Game rule number eight hundred forty-five is a key number match game with a "doubler" feature, and is generally known as an "instant lottery."
(2) Holders of valid tickets will remove the coating off of the play area to reveal ten play spots. If the player reveals an "8" symbol, the player wins the prize shown for that symbol automatically. If the player reveals a "Lightening 8" symbol, the player wins double the prize shown for that symbol automatically. There are ten chances to win on each ticket, and a player may win up to ten times on one ticket.
(3) The only "prize values" which shall appear on a ticket in game rule number eight hundred forty-five are: one dollar, two dollars, four dollars, eight dollars, eighteen dollars, forty-eight dollars, eighty-eight dollars, one hundred eighty-eight dollars, eight hundred dollars and eight thousand eight hundred eighty-eight dollars. Numbers, prize values and play symbols appearing on any ticket in game rule number eight hundred forty-five shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.
(C) Price of tickets. The price of a ticket issued by the commission in game rule number eight hundred forty-five shall be two dollars.
(D) Structure, nature and value of prize awards.
(1) There shall be one type of prize in game rule number eight hundred forty-five called a "regular prize award."
(2) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: two dollars, four dollars, eight dollars, eighteen dollars, forty-eight dollars, eighty-eight dollars, one hundred eighty-eight dollars, eight hundred dollars and eight thousand eight hundred eighty-eight dollars. Each ticket in game rule number eight hundred forty-five shall be imprinted in such a way that prize awards from the set listed above may be won.
(a) Holder of a valid winning ticket on which a "Lightening 8" symbol is revealed for one dollar doubled shall win a regular prize award of two dollars;
(b) Holder of a valid winning ticket on which two "8" symbols are revealed for one dollar shall win a regular prize award of two dollars;
(c) Holder of a valid winning ticket on which an "8" symbol is revealed for two dollars shall win a regular prize award of two dollars;
(d) Holder of a valid winning ticket on which an "8" symbol is revealed for four dollars shall win a regular prize award of four dollars;
(e) Holder of a valid winning ticket on which two "8" symbols are revealed for two dollars shall win a regular prize award of four dollars;
(f) Holder of a valid winning ticket on which a "Lightening 8" symbol is revealed for two dollars doubled shall win a regular prize award of four dollars;
(g) Holder of a valid winning ticket on which four "8" symbols are revealed for one dollar shall win a regular prize award of four dollars;
(h) Holder of a valid winning ticket on which two "Lightening 8" symbols are revealed for two dollars doubled shall win a regular prize award of eight dollars;
(i) Holder of a valid winning ticket on which eight "8" symbols are revealed for one dollar shall win a regular prize award of eight dollars;
(j) Holder of a valid winning ticket on which a "Lightening 8" symbol is revealed for four dollars doubled shall win a regular prize award of eight dollars;
(k) Holder of a valid winning ticket on which an "8" symbol is revealed for eight dollars shall win a regular prize award of eight dollars;
(l) Holder of a valid winning ticket on which a "Lightening 8" symbol is revealed for eight dollars doubled and on which an "8" symbol is revealed for two dollars shall win a regular prize award of eighteen dollars;
(m) Holder of a valid winning ticket on which two "8" symbols are revealed for one dollar and eight "8" symbols are revealed for two dollars shall win a regular prize award of eighteen dollars;
(n) Holder of a valid winning ticket on which two "8" symbols are revealed for eight dollars once and two dollars once and a "Lightening 8" symbol is revealed for four dollars doubled shall win a regular prize award of eighteen dollars;
(o) Holder of a valid winning ticket on which an "8" symbol is revealed for eighteen dollars shall win a regular prize award of eighteen dollars;
(p) Holder of a valid winning ticket on which three "Lightening 8" symbols are revealed for eight dollars doubled shall win a regular prize award of forty-eight dollars;
(q) Holder of a valid winning ticket on which two "8" symbols are revealed for eight dollars once and four dollars once, and a "Lightening 8" symbol is revealed for eighteen dollars doubled shall win a regular prize award of forty-eight dollars;
(r) Holder of a valid winning ticket on which eight "8" symbols are revealed for four dollars once, two dollars two times and eight dollars five times shall win a regular prize award of forty-eight dollars;
(s) Holder of a valid winning ticket on which an "8" symbol is revealed for forty-eight dollars shall win a regular prize award of forty-eight dollars;
(t) Holder of a valid winning ticket on which two "Lightening 8" symbols are revealed for eighteen dollars doubled and a "Lightening 8" symbol is revealed for eight dollars doubled shall win a regular prize award of eighty-eight dollars;
(u) Holder of a valid winning ticket on which an "8" symbol is revealed for eighty-eight dollars shall win a regular prize award of eighty-eight dollars;
(v) Holder of a valid winning ticket on which eight "8" symbols are revealed for eighteen dollars five times, eighty-eight dollars once, eight dollars once and two dollars once shall win a regular prize award of one hundred eighty-eight dollars;
(w) Holder of a valid winning ticket on which four "8" symbols are revealed for eighty-eight dollars two times, eight dollars once and four dollars once shall win a regular prize award of one hundred eighty-eight dollars;
(x) Holder of a valid winning ticket on which a "Lightening 8" symbol is revealed for eighty-eight dollars doubled and three "8" symbols are revealed for four dollars shall win a regular prize award of one hundred eighty-eight dollars;
(y) Holder of a valid winning ticket on which an "8" symbol is revealed for one hundred eighty-eight dollars shall win a regular prize award of one hundred eighty-eight dollars;
(z) Holder of a valid winning ticket on which on which two "Lightening 8" symbols are revealed for one hundred eighty-eight dollars doubled and an "8" symbol is revealed for forty-eight dollars shall win a regular prize award of eight hundred dollars;
(aa) Holder of a valid winning ticket on which an "8" symbol is revealed for eight hundred dollars once shall win a regular prize award of eight hundred dollars; and
(bb) Holder of a valid winning ticket on which an "8" symbol is revealed for eight thousand eight hundred eighty-eight dollars shall win a regular prize award of eight thousand eight hundred eighty-eight dollars.
(E) Number of prize awards. The number of prize awards in any sales cycle of game rule number eight hundred forty-five will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:
(1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance;
(2) Mathematical reasoning indicates that the number of winning tickets per six million tickets sold in the following prize categories should be as follows:
(a) Thirty tickets revealing an "8" symbol to win eight thousand eight hundred eighty-eight dollars;
(b) One hundred twenty tickets revealing an "8" symbol to win eight hundred dollars;
(c) One hundred fifty tickets revealing two "Lightening 8" symbols for one hundred eighty-eight dollars doubled and revealing one "8" symbol for forty-eight dollars to win eight hundred dollars;
(d) One hundred fifty tickets revealing an "8" symbol to win one hundred eighty-eight dollars;
(e) Six hundred tickets revealing a "Lightening 8" symbol for eighty-eight dollars doubled and revealing three "8" symbols for four dollars to win one hundred eighty-eight dollars;
(f) Four hundred eighty tickets revealing two "8" symbols for eighty-eight dollars and two "8" symbols for eight dollars once and four dollars once to win one hundred eighty-eight dollars;
(g) Five hundred forty tickets revealing five "8" symbols for eighteen dollars and revealing three "8" symbols for eighty-eight dollars once, eight dollars once and two dollars once to win one hundred eighty-eight dollars;
(h) One thousand two hundred tickets revealing an "8" symbol for eighty-eight dollars to win eighty-eight dollars;
(i) Two thousand four hundred tickets revealing two "Lightening 8" symbols for eighteen dollars doubled and one "Lightening 8" symbol for eight dollars doubled to win eighty-eight dollars;
(j) Three thousand tickets revealing an "8" symbol for forty-eight dollars to win forty-eight dollars;
(k) Six thousand tickets revealing eight "8" symbols for four dollars once, two dollars two times and eight dollars five times to win forty-eight dollars;
(l) Twelve thousand tickets revealing a "Lightening 8" symbol for eighteen dollars doubled and two "8" symbols for eight dollars once and four dollars once to win forty-eight dollars;
(m) Ten thousand five hundred tickets revealing three "Lightening 8" symbols for eight dollars doubled to win forty-eight dollars;
(n) Fifteen thousand tickets revealing an "8" symbol for eighteen dollars to win eighteen dollars;
(o) Fifteen thousand tickets revealing two "8" symbols for eight dollars once and two dollars once and revealing a "Lightening 8" symbol for four dollars doubled to win eighteen dollars;
(p) Fifteen thousand tickets revealing ten "8" symbols for one dollar two times and two dollars eight times to win eighteen dollars;
(q) Fifteen thousand tickets revealing a "Lightening 8" symbol for eight dollars doubled and revealing an "8" symbol for two dollars to win eighteen dollars;
(r) Fifteen thousand tickets revealing an "8" symbol for eight dollars to win eight dollars;
(s) Fifteen thousand tickets revealing a "Lightening 8" symbol for four dollars doubled to win eight dollars;
(t) Fifteen thousand tickets revealing eight "8" symbols for one dollar each to win eight dollars;
(u) Fifteen thousand tickets revealing two "Lightening 8" symbols for two dollars doubled to win eight dollars;
(v) One hundred eighty thousand tickets revealing four "8" symbols for one dollar to four dollars;
(w) One hundred eighty thousand tickets revealing a "Lightening 8" symbol for two dollars doubled to win four dollars;
(x) One hundred twenty thousand tickets revealing two "8" symbols for two dollars to win four dollars;
(y) One hundred twenty thousand tickets revealing an "8" symbol for four dollars to win four dollars;
(z) One hundred twenty thousand tickets revealing an "8" symbol for two dollars to win two dollars;
(aa) One hundred eighty thousand tickets revealing two "8" symbols for one dollar to win two dollars; and
(bb) Three hundred thousand tickets revealing a "Lightening 8" symbol for one dollar doubled to win two dollars.
(F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.
(G) Frequency of prize drawings.
(1) Random imprinting of prize awards on all tickets issued in game rule number eight hundred forty-five shall be accomplished in a manner which complies with the commission's rules and procedures.
(2) When a ticket issued in game rule number eight hundred forty-five is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number eight hundred forty-five in which the ticket was sold.
(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.
(I) Validity of tickets.
(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number eight hundred forty-five void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.
(J) Director's conduct of game rule number eight hundred forty-five.
(1) The director shall conduct game rule number eight hundred forty-five and any promotions or drawings associated therewith in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game and any promotions or drawings associated therewith. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number eight hundred forty-five. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.
(2) Names and definitions of elements of game rule number eight hundred forty-five used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number eight hundred forty-five and these elements may be given names or titles chosen by the commission.
