  • (A) Title and term. Ohio lottery commission game rule number eight hundred eighty-eight, "Oktoberfest," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number eight hundred eighty-eight.

    (B) General design.

    (1) Game rule number eight hundred eighty-eight is a reveal symbol style game and is generally known as an "instant lottery."

    (2) Holders of valid tickets will remove the covering to reveal six play symbols and six corresponding prize values. If the player reveals a "Stein" symbol in any of the play spots, the player wins the corresponding prize value. If the player reveals an "Accordion" symbol in any of the play spots, the player wins "double" the corresponding prize value. There are six chances to win on each ticket, and a player may win up to six times on one ticket.

    (3) The only "prize values" which shall appear on a ticket in game rule number eight hundred eighty-eight are: one dollar, two dollars, three dollars, four dollars, five dollars, ten dollars, twenty dollars, twenty-five dollars, fifty dollars, one hundred dollars, five hundred dollars and one thousand dollars. Numbers, prize values and play symbols appearing on any ticket in game rule number eight hundred eighty-eight shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.

    (C) Price of tickets. The price of a ticket issued by the commission in game rule number eight hundred eighty-eight shall be one dollar.

    (D) Structure, nature and value of prize awards.

    (1) There shall be one type of prize in game rule number eight hundred eighty-eight called a "regular prize award."

    (2) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: one dollar, two dollars, three dollars, four dollars, five dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars and one thousand dollars. Each ticket in game rule number eight hundred eighty-eight shall be imprinted in such a way that prize awards from the set listed above may be won.

    (a) Holder of a valid winning ticket on which a "Stein" symbol is revealed in one of the play spots for one dollar shall win a regular prize award of one dollar;

    (b) Holder of a valid winning ticket on which a "Stein" symbol is revealed in one of the play spots for two dollars shall win a regular prize award of two dollars;

    (c) Holder of a valid winning ticket on which a "Stein" symbol is revealed in two of the play spots for one dollar shall win a regular prize award of two dollars;

    (d) Holder of a valid winning ticket on which an "Accordion" symbol is revealed in one of the play spots for one dollar doubled shall win a regular prize award of two dollars;

    (e) Holder of a valid winning ticket on which a "Stein" symbol is revealed in two of the play spots for one dollar once and two dollars once shall win a regular prize award of three dollars;

    (f) Holder of a valid winning ticket on which a "Stein" symbol is revealed in three of the play spots for one dollar shall win a regular prize award of three dollars;

    (g) Holder of a valid winning ticket on which a "Stein" symbol is revealed in one of the play spots for three dollars shall win a regular prize award of three dollars;

    (h) Holder of a valid winning ticket on which an "Accordion" symbol is revealed in one of the play spots for two dollars doubled shall win a regular prize award of four dollars;

    (i) Holder of a valid winning ticket on which a "Stein" symbol is revealed in two of the play spots for one dollar and one of the play spots for two dollars once shall win a regular prize award of four dollars;

    (j) Holder of a valid winning ticket on which a "Stein" symbol is revealed in four of the play spots for one dollar shall win a regular prize award of four dollars;

    (k) Holder of a valid winning ticket on which a "Stein" symbol is revealed in one of the play spots for four dollars shall win a regular prize award of four dollars;

    (l) Holder of a valid winning ticket on which a "Stein" symbol is revealed in five of the play spots for one dollar shall win a regular prize award of five dollars;

    (m) Holder of a valid winning ticket on which an "Accordion" symbol is revealed in one of the play spots for two dollars doubled and a "Stein" symbol is revealed in one of the play spots for one dollar shall win a regular prize award of five dollars;

    (n) Holder of a valid winning ticket on which a "Stein" symbol is revealed in one of the play spots for one dollar and two of the play spots for two dollars shall win a regular prize of five dollars;

    (o) Holder of a valid winning ticket on which a "Stein" symbol is revealed in one of the play spots for five dollars shall win a regular prize award of five dollars;

    (p) Holder of a valid winning ticket on which a "Stein" symbol is revealed in five of the play spots for two dollars shall win a regular prize award of ten dollars;

    (q) Holder of a valid winning ticket on which an "Accordion" symbol is revealed in one of the play spots for five dollars doubled shall win a regular prize award of ten dollars;

    (r) Holder of a valid winning ticket on which a "Stein" symbol is revealed in four of the play spots for two dollars and two of the play spots for one dollar shall win a regular prize award of ten dollars;

    (s) Holder of a valid winning ticket on which a "Stein" symbol is revealed in two of the play spots for three dollars and one of the play spots for four dollars shall win a regular prize award of ten dollars;

    (t) Holder of a valid winning ticket on which a "Stein" symbol is revealed in one of the play spots for ten dollars shall win a regular prize award of ten dollars;

    (u) Holder of a valid winning ticket on which an "Accordion" symbol is revealed in one of the play spots for ten dollars doubled shall win a regular prize award of twenty dollars;

    (v) Holder of a valid winning ticket on which a "Stein" symbol is revealed in five of the play spots for four dollars shall win a regular prize award of twenty dollars;

    (w) Holder of a valid winning ticket on which a "Stein" symbol is revealed in four of the play spots for four dollars and two of the play spots for two dollars shall win a regular prize award of twenty dollars;

    (x) Holder of a valid winning ticket on which a "Stein" symbol is revealed in one of the play spots for twenty dollars shall win a regular prize award of twenty dollars;

    (y) Holder of a valid winning ticket on which a "Stein" symbol is revealed in five of the play spots for ten dollars shall win a regular prize award of fifty dollars;

    (z) Holder of a valid winning ticket on which an "Accordion" symbol is revealed in one of the play spots for twenty-five dollars doubled shall win a regular prize award of fifty dollars;

    (aa) Holder of a valid winning ticket on which a "Stein" symbol is revealed in one of the play spots for fifty dollars shall win a regular prize award of fifty dollars;

    (bb) Holder of a valid winning ticket on which an "Accordion" symbol is revealed in one of the play spots for fifty dollars doubled shall win a regular prize award of one hundred dollars;

    (cc) Holder of a valid winning ticket on which a "Stein" symbol is revealed in one of the play spots for one hundred dollars shall win a regular prize award of one hundred dollars;

    (dd) Holder of a valid winning ticket on which an "Accordion" symbol is revealed in one of the play spots for five hundred dollars doubled shall win a regular prize award of one thousand dollars; and

    (ee) Holder of a valid winning ticket on which a "Stein" symbol is revealed in one of the play spots for one thousand dollars shall win a regular prize award of one thousand dollars.

    (E) Number of prize awards. The number of prize awards in any sales cycle of game rule number eight hundred eighty-eight will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:

    (1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

    (2) Mathematical reasoning indicates that the number of winning tickets per four million tickets sold in the following prize categories should be as follows:

    (a) Twenty tickets revealing a "Stein" symbol for one thousand dollars once to win one thousand dollars;

    (b) Twenty tickets revealing an "Accordion" symbol for five hundred dollars doubled to win one thousand dollars;

    (c) Two hundred tickets revealing a "Stein" symbol for one hundred dollars once to win one hundred dollars;

    (d) Three hundred tickets revealing an "Accordion" symbol for fifty dollars doubled to win one hundred dollars;

    (e) One hundred tickets revealing a "Stein" symbol for fifty dollars once to win fifty dollars;

    (f) Three hundred tickets revealing an "Accordion" symbol for twenty-five dollars doubled to win fifty dollars;

    (g) Two hundred tickets revealing a "Stein" symbol for ten dollars five times to win fifty dollars;

    (h) Five thousand tickets revealing a "Stein" symbol for twenty dollars once to win twenty dollars;

    (i) Five thousand tickets revealing a "Stein" symbol for four dollars four times and two dollars two times to win twenty dollars;

    (j) Five thousand tickets revealing a "Stein" symbolfor four dollars five times to win twenty dollars;

    (k) Five thousand tickets revealing an "Accordion" symbol for ten dollars doubled to win twenty dollars;

    (l) Five thousand tickets revealing a "Stein" symbol for ten dollars once to win ten dollars;

    (m) Five thousand tickets revealing a "Stein" symbol for three dollars two times and four dollars once to win ten dollars;

    (n) Ten thousand tickets revealing a "Stein" symbol for two dollars four times and one dollar two times to win ten dollars;

    (o) Fifteen thousand tickets revealing an "Accordion" symbol for five dollars doubled to win ten dollars;

    (p) Five thousand tickets revealing a "Stein" symbol for two dollars five times to win ten dollars;

    (q) Five thousand tickets revealing a "Stein" symbol for five dollars once to win five dollars;

    (r) Five thousand tickets revealing a "Stein" symbol for one dollar once and two dollars two times to win five dollars;

    (s) Twenty-five thousand tickets revealing an "Accordion" symbol for two dollars doubled and a "Stein" symbol for one dollar once to win five dollars;

    (t) Five thousand tickets revealing a "Stein" symbol for one dollar five times to win five dollars;

    (u) Five thousand tickets revealing a "Stein" symbol for four dollars once to win four dollars;

    (v) Ten thousand tickets revealing a "Stein" symbol for one dollar four times to win four dollars;

    (w) Five thousand tickets revealing a "Stein" symbol for one dollar two times and two dollars once to win four dollars;

    (x) Twenty thousand tickets revealing an "Accordion" symbol for two dollars doubled to win four dollars;

    (y) Twenty thousand tickets revealing a "Stein" symbol for three dollars once to win three dollars;

    (z) Twenty thousand tickets revealing a "Stein" symbol for one dollar three times to win three dollars;

    (aa) Twenty thousand tickets revealing a "Stein" symbol for one dollar once and two dollars once to win three dollars;

    (bb) Two hundred thousand tickets revealing an "Accordion" symbol for one dollar doubled to win two dollars;

    (cc) Eighty thousand tickets revealing a "Stein" symbol for one dollar two times to win two dollars;

    (dd) Eighty thousand tickets revealing a "Stein" symbol for two dollars once to win two dollars; and

    (ee) Two hundred sixty thousand tickets revealing a "Stein" symbol for one dollar once to win one dollar.

    (F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

    (G) Frequency of prize drawings.

    (1) Random imprinting of prize awards on all tickets issued in game rule number eight hundred eighty-eight shall be accomplished in a manner which complies with the commission's rules and procedures.

    (2) When a ticket issued in game rule number eight hundred eighty-eight is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number eight hundred eighty-eight in which the ticket was sold.

    (H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

    (I) Validity of tickets.

    (1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number eight hundred eighty-eight void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

    (J) Director's conduct of game rule number eight hundred eighty-eight.

    (1) The director shall conduct game rule number eight hundred eighty-eight and any promotions or drawings associated therewith in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number eight hundred eighty-eight. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

    (2) Names and definitions of elements of game rule number eight hundred eighty-eight used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number eight hundred eighty-eight and these elements may be given names or titles chosen by the commission.
