4713-11-08. Residential salons and barber shops

(A) Except for salons and barber shops licensed prior to September 5, 1977, a salon or barber shop may be located in a residence provided the salon or barber shop shall have an entrance to the outside separate from the living quarters or garage of the residence. If the salon or barber shop has doors within its interior that allow access into the living quarters, garage, or basement of the residence, the doors shall be solid, have a wood frame or other solid frame, shall be able to be secured, and shall be kept closed during the time when the salon or barber shop is open for business. The salon or barber shop shall also be equipped with at least one restroom, which must include a toilet and a sink with hot and cold running water, that is separate from the living quarters, garage, and basement of the residence.
(1) Residential salons and barber shops shall be properly licensed according to the branch of cosmetology and/or barbering practiced in the salon.
(2) Residential salons and barber shops shall be subject to all laws and rules of Chapters 4709. and 4713. of the Revised Code and the rules promulgated thereunder, as applicable, in order to obtain and maintain licensure, and shall comply with all licensure and operating requirements prescribed in this chapter for salons and barber shops.
(3) All applicants for a license to operate a residential salon or barber shop shall submit, along with the forms supplied by the board and required fee, a floor plan that is legible, clearly labeled, and drawn to scale. The floor plan must identify the following:
(a) The size of the premises;
(b) Each room contained therein;
(c) The location of the salon or barber shop and the residence's living quarters;
(d) All equipment and plumbing fixtures; and
(e) All areas accessible to the salon through doors or any other openings.
(4) All applicants for a license to operate a residential salon or barber shop must obtain proper approval from the local zoning authority to operate a business at the residential location.
