5512-1-02. Public notice of meetings

  • Public notice of all regularly scheduled, special, and emergency meetings of the transportation review advisory council shall be provided by the director of transportation in the manner specified by this rule. As used in this rule, "director" includes the director's agent.

    (A) The director shall prepare notice of any regularly scheduled meeting no less than seven days prior to the date of the meeting. Notice shall contain the caption "notice of regularly scheduled TRAC meeting" and shall state the time and place, and may state the purpose or may include the agenda. The director shall display the notice on the website for the Ohio department of transportation.

    (B) The director shall prepare notice of any special meeting no less than twenty four hours prior to the scheduled meeting time. Notice shall contain the caption "notice of special TRAC meeting" and shall state the time, place, and purpose and may include the agenda. The director shall email the notice to news media that have requested meeting notice as provided in paragraph (C) of this rule.

    (C) For any regular or special meeting, the director shall email a copy of the prepared notice to any person who has requested it in writing if the person requesting the notice has furnished a email address . The director also may email the notice to all subscribers who have requested in writing to be placed on a distribution list and may post notice on the Ohio department of transportation website.

    The director shall provide a copy of the prepared notice to any person as a public record pursuant to section 149.43 of the Revised Code.

    (D) For any emergency meeting, immediate notice of the time, place, and purpose of the meeting shall be provided by email or telephone to news media that have requested meeting notice as provided in paragraph (C) of this rule. The director is not required to prepare written notice for any emergency meeting.
