    NOTIFICATION OF PUBLIC HEARING

    to amend Rules 4501:1-3-08, 4501:1-3-34, and 4501:1-3-35

    of the Ohio Administrative Code in accordance with Chapter 119. of the Ohio Revised Code

     

    Notice is hereby given that the Ohio Motor Vehicle Dealers Board will conduct a public hearing pursuant to R.C. 119.03 on Thursday, February 4, 2010, at 9:00 a.m. to consider the proposed adoption of rules 4501:1-3-08, 4501:1-3-34, and 4501:1-3-35 of the Administrative Code. The hearing will be held at the Ohio Department of Public Safety, 1970 West Broad Street, Room 134, Columbus, Ohio.

     

    These rules are being filed pursuant to a R.C. 119.032 five-year rule review.

     

    The purpose of amending rule 4501:1-3-08 is to enhance clarity and flexibility of the provisions governing motor vehicle dealers and salespersons and to expand patrons' accessibility to used motor vehicle dealerships. Amended language provides that dealerships can choose how telephone service is provided and how business hours and telephone service are displayed.  Minimum interior office space has been clarified.

    Proposed changes establish that a dealership shall be open for operation a minimum of sixteen hours per week to increase service and accessibility for patrons.

     

    4501:1-3-34 and 4501:1-3-35 are being amended to reflect that notices for public hearings will be issued in accordance with the requirements of R.C. 119.03, that notices for meetings of the Motor Vehicle Dealers Board will be made available on the Bureau of Motor Vehicles website, and that reasonable fees will be charged for the copying and mailing of written requests for meeting notices.

     

    Any persons affected by the proposed amendment of rules 4501:1-3-08, 4501:1-3-34, and/or 4501:1-3-35 may appear at the hearing and be heard in person, by an attorney, or both, or may present their positions, argument, or contention in writing, offer and examine witnesses, and present evidence to show that the proposed amendment, if adopted, will be unreasonable or unlawful.
