NOTIFICATION OF PUBLIC HEARING

Notice of hearing to amend Rules 4501:1-1-01, -02, -03, -04, -05, -07, -08, -09, -10, -11, -

15, -18, -19, -20, -24, -25, -26, -28, -29, -31, -32, -33, -34, -35, and -37,

to rescind Rules 4501:1-1-21 and -23,

and to adopt new Rules 4501:1-1-21, -23, and -38 of the Ohio Administrative Code in accordance with Chapter 119. of the Ohio Revised Code

 

Notice is hereby given that a hearing will be held by the Registrar of the Bureau of Motor Vehicles division of the Ohio Department of Public Safety for the purpose of considering adoption of the above-listed proposed administrative rules.

 

Based on a review of Chapter 4501:1-1 of the Ohio Administrative Code and as authorized in Sections 3321.13, 4501.02, 4506.09, 4506.17, 4506.22, 4507.09, and

4510.32 of the Ohio Revised Code, the Registrar of the Bureau of Motor Vehicles has proposed to amend Rules 4501:1-1-01, -02, -03, -04, -05, -07, -08, -09, -10, -11, -15, -18,

-19, -20, -24, -25, -26, -28, -29, -31, -32, -33, -34, -35, and -37, to rescind Rules 4501:1-

1-21 and -23, and to adopt new Rules 4501:1-1-21, -23, and -38 of the Ohio Administrative Code regarding operator licenses and identification cards for the purposes of updating, enhancing, correcting, and clarifying the rules.

 

Proposed changes include spelling corrections, grammatical corrections, gender-neutral language changes, updates to referenced statutes to reflect statute renumbering, corrections to the numbers of referenced rules, conformation of rule language with Ohio statutes that were amended to conform with applicable federal motor carrier safety regulations including clarification that testing of commercial drivers for controlled substances or alcohol concentration can be by whole blood or breath at specified concentrations by blood serum or blood plasma or by urine, updates to the lists of authorizing and amplification statutes attributed to rules, updates to a listed federal agency name, addition of missing and clarifying language, clarification of the versions of incorporated texts, addition of language providing contact information for incorporated texts, provision for testing in languages other than English and provision that if such tests are available in a specified language an interpreter will not be available, and clarification of rule terminology including clarification that a valid, complete identification card issued by the Ohio department of rehabilitation and correction be acceptable identification to be submitted along with an application for a driver's license, commercial driver's license or identification card.

 

A public hearing on the proposed rules will be held Wednesday, February 15, 2006 at 10:00 a.m. in room 109 (first floor) of the Charles D. Shipley Building, Ohio Department of Public Safety, 1970 West Broad Street, Columbus, Ohio.

 

Either written or oral testimony will be received at the hearing. Additionally, written comments received at the address below before the hearing will be treated as testimony.
