    The Department is rescinding 23 existing rules governing licensed residential facilities and bringing forth 10 new replacement rules.

    The rule establishes uniform standards and procedures governing the development and renovation of residential facilities subject to licensure in accordance with Section 5123.19 of the Revised Code.

    New rule 5123:2-3-08 replaces existing rule 5123:2-3-26 and includes several new requirements:

    -   Setting forth that bedrooms shall not be occupied by more than two individuals.

    -   Setting forth that toilet and bathing facilities shall be at a minimum ratio of one facility to four residents.

    Paragraph (D) sets forth that no person or government entity may apply for a license to operate a residential facility without first obtaining development approval in accordance with this rule.

    Paragraph (I) sets forth that an applicant's failure to meet timelines for implementaion of a development proposal may result in withdrawal of development approval.

    C.) Does this rule require specific expenditures or the report of information as a condition of compliance? Yes

    Paragraph (I) requires an applicant to submit a written development proposal to the

    department and requires payment of licensure fees for the initial license.
