    PUBLIC HEARING NOTICE

    Pursuant to Ohio Revised Code Section 119.03, notice is hereby given that the Department of Administrative Services intends to conduct a public hearing for the purpose of adopting amending Ohio Administrative Code Sections 123:1-34-01, 123:1-34-09, 123:1-39-01,

    123:1-39-06, 123:1-39-07, 123:1-41-21, 123:1-43-02, 123:1-45-01, and

    123:1-46-04.

     

    The proposed to be amended rules deal with the following subject matter:

     

    123:1-34-01 Leave of Absence Without Pay - To clarify that an employee on a leave of absence without pay for a period lasting longer than one pay period  is responsible for both the employee's and employer's share of health care premiums.

     

    123:1-34-09 Bereavement Leave - To make the leave time granted for this purpose three consecutive days.

     

    123:1-39-01 Professional Development Fund - To require satisfactory completion of a course for it to be eligible for reimbursement and to tie the satisfactory completion determination to the criteria used by the entity providing the course in question.

     

    123:1-39-06 Educational Stipends - To require appointing authorities maintain information on such a program and to only submit it upon request by the Director of Administrative Services.

     

    123:1-39-07 Tuition Reimbursement - To require satisfactory completion of a course for it to be eligible for reimbursement and to tie the satisfactory completion determination to the criteria used by the entity providing the course in question.

     

     

     

     

     

     

     

     

    123:1-41-21   Layoff of Employees on Sick Leave, Leave Without Pay, or Receiving Disability Leave Benefits - To correct a cross-reference from OAC 123:1-24-01 to OAC 123:1- 34-01.

    123:1-43-02 Compensatory Time - To calculate compensatory time payments at appropriate rate at the time of payment, rather than at the time the compensatory time was earned.

    123:1-45-01 Implementation - To add policies to the list  of documents covered by the rule and to replace distribution of such documents with making them available to the public on the Department of Administrative Services' website.

    123:1-46-04 Leaves and Benefits: Adjutant General's Full-Time Firefighters - To delete language related to personal leave reductions in effect in 2009 and 2010.

    The Department of Administrative Services shall hold a public hearing on the proposed rule amendments on Tuesday, February 19, 2013, at 9:00 a.m. in Room 2793, on the 27th floor of the James A. Rhodes State Office Tower located at 30 East Broad Street, Columbus, Ohio. At this hearing, any person affected by the rules may appear and be heard in person, by the person's attorney, or both, may present the person's position, arguments, or contentions orally or in writing, offer and examine witnesses, and present evidence that tends to show that the rules, if adopted or effectuated, will be unreasonable or unlawful.

    Individuals desiring only to submit their position, arguments, or contentions in writing (written statement) may do so by submitting them to the following address:

    Any such written statements actually received by 5:00 p.m. on Friday, February 15, 2013, will be considered by the Department of Administrative Services.
