5101:2-12-37 Children's medical and enrollment records for licensed child care centers.
(A) Each child attending the licensed child care center, including those children who are attending kindergarten at the center, shall secure and have on file verification of a medical examination.
who is not attending a grade of kindergarten or above shallsecure and have on file verification of a medical examChildren who attend a grade of kindergarten and above in an elementary school are exempt from this requirement.(1)
TheA medical statement shall verifyathe date ofexama medical examination within the past twelve months.andThis statement shall be on file at the center within thirty days of the child's date of admission and every thirteen months thereafter, until the children are attending a grade of kindergarten orabove.(2) The medical statement shall contain the following information:
(a) The child's name and birth date.
(b) The date of the medical examination.
(b)(c)TheA statement that the child has been examined and is in suitable condition for participation in group caredate of examination.(c)(d) The signature, business address and telephone number of thelicensedphysician, physician's assistant (PA) orcertified nurse practitioneradvanced practice nurse (APN) who examined the child.(d)(e)The statement that aA record of the immunizations that the child has had, specifying the month, day and year of each immunizationisincluded and that the physician, physician's assistant or certified nursepractitioner has reviewed the child's record against the immunizationsrecommended by the Ohio department of health. The Ohio departmentof health's recommended immunization schedule is available asappendix A to this rule.(f) A statement that the physician, PA or APN reviewed the child's record against the immunizations recommended by the Ohio department of health (ODH). ODH recommended immunization schedule is appendix A to this rule.
(g) A statement of any immunization exemptions.
(e) The statement that the child has been examined and is in suitablecondition for participation in group care.(B)
CentersThe center shall maintain a completedenrollment records which includehealth records, emergency transportation information, and parent or guardian rosterpermissions for all childrenJFS 01234 "Child Enrollment and Health Information"(rev. 2/2009) for each child
attending
the
center
on the JFS 01234 "ChildEnrollment and Health Information" (rev. 09/2006).(1) The center shall
secure andhave on fileall children's Jeach child's JFS 01234enrollment recordsno later than the child's first day of attendance and it shall be. All records shall beimmediately accessible to the administrator or designee,. The JFS 01234andshall be reviewed and revised as needed and updated at least annually.(2)
Immunizations may be waived by the administrator for religious reasons uponsubmission of the parent or guardian's written request for exemption or formedical reasons upon submission of a physician's or certified nursepractitioner's written request for exemption. These statements shall be on fileat the center.(3)(2) The center shall set its own policy regarding the admittance of children whose parents or guardians refuse to grant consent for transportation for emergency treatment.(C) Children's records shall be confidential
, except that they shall be available to thedirector's representativebut shall be available to the Ohio department of job and family services for the purpose of administering Chapter 5104. of the Revised Code and Chapter 5101:2-12 of the Administrative Code. The immunization records shall be subject to review by thehealth department's representativeODH for disease outbreak control and for immunization level assessment purposes.Effective: 02/01/2009
