122:5-1-01                   Notice procedure.

 

 

The procedure of the department of development, office of community services, for giving public notice for the adoption, amendment or rescission of the rules under Chapter

119. of the Revised Code shall be as follows:

 

(A)  The office of community services shall cause:

 

(1)  A statement of its intention to consider adopting, amending or rescinding a rule;

 

(2)    A synopsis of the proposed rule, amendment, or rule to be rescinded or a general statement of the subject matter to which the proposed rule, amendment, or rescission relates;

 

(3)   A statement of the reason or purpose for adopting, amending or rescinding the rule;

 

(4)   The date, time, and place of hearing on the proposed action, to be inserted in at least two newspapers of general circulation in the state of Ohio at least thirty days prior to the hearing.

 

(B)    The office of community services shall furnish the public notice required under section 119.03 of the Revised Code and as detailed by paragraph (A) of this rule to any person who requests notice in writing and pays a reasonable fee, not to exceed the cost of copying and mailing.

 

(C)     Prior to the effective date of the rule, amendment or rescission, the office of community services shall make a reasonable effort to inform those affected by the rule, amendment or rescission and to have available for distribution to those requesting it, the full text of the rule as adopted, amended or rescinded.
