3701-55-02 Required screening; facility requirements.

    NOTICE OF PUBLIC HEARING

     

     

     

    The Director of the Ohio Department of Health has proposed to amend rules 3701-55-02 and 3701-55-20 of the Ohio Administrative Code (O.A.C.); and to adopt new rule 3701-55-10. These rules which pertain to genetic, endocrine, metabolic screening of newborn infants are authorized by Revised Code 3701.501. The amendments and new rule are being proposed at the recommendation of the Ohio Newborn Screening Advisory Council.

     

    Amendments to rule 3701-55-02 will add two disorders (cystic fibrosis and carnitine uptake defect) to the newborn screening test panel. New rule 3701-55-10 will allow the Bureau of Public Health Laboratories to perform supplemental studies for future newborn screening conditions. The rule will assist in the evaluation and collection of data for conditions being considered for addition to the newborn screening panel. And, finally, amendments to rule 3701- 55-20 change the genetic services fee to $23.16, an increase of $3.15. The increase is necessitated by the two disorders proposed for addition to the test panel.

     

    In accordance with Chapter 119 of the Revised Code, the Director, or his designee, will conduct a public hearing on the proposed action on Friday, March 3, 2006 at 10:00 a.m. The hearing will be conducted in the 7th Floor Large Conference Room of the Ohio Department of Health, 246 North High Street, Columbus, Ohio 43215.

     

    At the hearing, persons affected by the proposed action may appear and be heard in person, by their attorney or both; may present their positions, arguments, or contentions orally or in writing; may offer witnesses; and may present evidence tending to show that the proposed rules, if adopted or effectuated, will be unreasonable or unlawful.
