    The rule is being proposed to adopt amendments made after a review to fulfill the requirements of ORC 106.03 and 106.031.

    The existing rule contains the requirements for allowable emission increases and ceiling levels from major sources of air pollution in attainment areas. It requires a PTI contain limits or other measures (e.g. control devices) necessary to ensure that emission increases stay under the levels required in this rule.

    References to Indian governing bodies were changed to Tribal governing bodies.

    This rule contains references to the Ohio Administrative Code (OAC) and Ohio Revised Code (ORC). While copies of these rules and statutes are generally available to the public through libraries and on-line sources, including the Ohio EPA website, ORC 121.76 (A) exempts such references from the provisions of ORC 121.71 through 121.75.

    This rule also contains references to the Code of Federal Regulations (CFR). These rules are generally available through libraries, Ohio EPA and U.S. EPA websites. CFR references have also been dated to reference the specific version of the rules. ORC 121.75 (D) exempts such references from the requirements of ORC 121.71 through 121.74.

    This rule also contains references to the Federal Power Act and Energy Supply and Environmental Coordination Act of 1974. This act is generally available through libraries, Ohio EPA and Government Printing Office's websites. References to this act have also been dated to reference the specific version of the act.     As noted above, the range of cost requirements in this rule can be quite large, from no cost to Millions of dollars. A no/low cost scenario would be a simple recordkeeping change or a minor housekeeping change. A high cost change would

    include the installation and operation of a control device.

    As noted above, there is a large cost range associated with compliance with this rule. Personnel costs do, however, tend to be low and/or a small portion of the overall costs of compliance as most of the highest cost compliance scenarios are associated with the installation and operation of capital equipment.

    (b)  New Equipment or Other Capital Costs

    As noted above, there is a large cost range associated with compliance with this rule. Personnel costs do, however, tend to be low and/or a small portion of the overall costs of compliance as most of the highest cost compliance scenarios are associated with the installation and operation of capital equipment.

    As noted above, there is a large cost range associated with compliance with this rule.     The amendments proposed as part of this action will not impose any additional cost for compliance. The existing requirements of this rule continue to require a cost of compliance that has existed for a number of years and has been funded through existing budgets.

    7.  Please provide a statement on the proposed rule's impact on economic development.

    The proposed amendments will have no additional impact on economic

    development. The existing requirements of this rule will continue to impact economic development in that any agency/local government or other entity installing or modifying an air contaminant source in the state of Ohio will have to incur additional costs for the project in order to address the air pollution control requirements of the state, and the requirement to obtain a permit-to-install prior to construction of such sources.

    Environmental Rule Adoption/Amendment Form

    Pursuant to Am. Sub. H.B. 106 of the 121st General Assembly, prior to adopting a rule or an amendment to a rule dealing with environmental protection, or containing a component dealing with environmental protection, a state agency shall:

    (1)    Consult with organizations that represent political subdivisions, environmental interests, business interests, and other persons affected by the proposed rule or amendment.

    (2)   Consider documentation relevant to the need for, the environmental benefits or consequences of, other benefits of, and the technological feasibility of the proposed rule or rule amendment.

    (3)  Specifically identify whether the proposed rule or rule amendment is being adopted or amended to enable the state to obtain or maintain approval to administer and enforce a federal environmental law or to participate in a federal environmental program, whether the proposed rule or rule amendment is more stringent than its federal counterpart, and, if the proposed rule or rule amendment is more stringent, the rationale for not incorporating its federal counterpart.

    A draft of these rules was released on November 13, 2014 for a 30-day public comment and review period. The rules were released to Ohio EPA's electronic interested parties list, posted on Ohio EPA's regulations website and shared with interested industry parties. Several comments were received as a result of the request for draft review.

    (B)  Was documentation that is relevant to the need for, the environmental benefits or consequences of, other benefits of, and the technological feasibility of the proposed rule or amendment considered ? Yes
