    NOTICE OF PUBLIC HEARING

     

     

    THE DEPARTMENT OF ADMINISTRATIVE SERVICES (DAS), pursuant to Chapter 119 of the Ohio Revised Code, hereby gives notice that a public hearing will be conducted for the purpose of considering the adoption and amendment of the following rules contained in the Ohio Administrative Code.

     

    The public hearing will be conducted on Friday, January 31, 2014, beginning at 10:30 a.m., in Lobby Hearing Room, located at the James A. Rhodes State Office Tower, 30 East Broad Street, Columbus, Ohio 43215. All interested persons affected by the proposed actions may be heard by oral or written testimony.

     

     

    The following rules are proposed for amendment:

     

    123:5-1-01      Definitions.

    Changes to this rule will clearly define terminology used throughout OAC 123:5

     

    123:5-1-02      Delegation of Procurement Authority.

    Changes to this rule will update the authorized positions and add information technology as an area of purchase.

     

    123:5-1-03      Permit to make purchases when impractical through the department.

    Changes to this rule will identify factors to be considered when DAS issues a release and permit to allow waiving of competitive bidding.

     

    123:5-1-06      Implementation of domestic Ohio bid preference.

    Changes to this rule will prescribe criteria and procedures to giving preference to United States and Ohio products as required by ORC 125.11.

     

    123:5-1-07      The invitation to bid process.

    Changes to this rule will establish processes for purchasing supplies and services through an invitation to bid.

     

    123:5-1-08      The request for proposal process.

    Changes  to  this  rule  will  establish  processes  for  making  purchases  through  a  competitive  sealed proposal.

     

    123:5-1-11      Model system of preference.

    Changes to this rule will provide guidance for counties, townships, and municipalities in applying Buy America and Buy Ohio preferences.

     

    123:5-1-12      The reverse auction process.

    Changes to this rule will establish the process for bidding supplies and services through a reverse auction.

     

     

     

     

     

     

     

    The following rules are being rescinded:

    123:5-1-04         Emergency purchases

    123:5-1-05         Bid Districts

    The following rule is being rescinded and a new one proposed:

    123:5-1-10      Specification authority.

    This rule establishes guidelines for preparing specifications for procurements of supplies and services. It is being filed as new because more than 50% of the current rule is being altered.

    All interested persons will be given an opportunity to be heard at the public hearing. Those persons who wish to provide oral testimony are encouraged to contact the Department of Administrative Services at 614-644-1773, no later than January 30, 2014, and may be given preference in the order of their testimony.
