    This filing is based on a R.C. 119.032 rule review of Ohio Administrative Code Chapter 4501-1. Proposed changes are to provide clarity, access, and consistency regarding required office space and telephone service as well as establish minimum required hours of operation to increase accessiblity for used motor vehicle dealers.

    This rule sets forth place of business requirements for used motor vehicle dealers. Proposed change in paragraph (A) clarifies that the office shall have a landline telephone (not a cellular phone) in service at all times, that is listed in the local telephone directory as, and is answered in the name of, the used motor vehicle dealer. Another proposed change clarifies that the business hours be a minimum of thirty hours per week, at least six of which are to occur Monday through Friday from seven a.m. to five p.m. New language also clarifies that the required minimum square footage for office space refers to "interior" office area, that office area exclude restroom, storage, or utility space, that the office be kept neat and orderly at all times, and that it shall not be used as a storage or other utility area. Also added is an hours exemption for licensed auction owners who are also licensed used motor vehicle dealers and do not sell to the general public.

    As a result of testimony given at the public hearing held on August 18, 2008, the Board reconsidered and made changes as follows. In the initial proposed changes, in paragraph (A), the minimum number of weekly business hours required was 40

    per week, 30 of which were to occur from 9 AM to 5 PM Monday through Friday. In this revised rule, the minimum number of weekly business hours has been reduced from 40 to 30, 6 (rather than 10) of which are required to occur from 7 AM to 5 PM (rather than 9-5) Monday through Friday. Corresponding changes have been made to the responses to questions #7 and #15 in this rule summary and fiscal analysis.

    This rule filing clarifies requirements for office area, and makes more consistent requirements for an office telephone, and establishes minimum required weekly business hours. If landline service has been eliminated, costs may be incurred for reconnection. Additional costs would be incurred by a used motor vehicle dealer if

    current business hours are less than 30 hours per week and/or that are less than 6 hours per week from 7:00 a.m. to 5:00 p.m. Monday through Friday. Costs would also be incurred if the office area requirements are not currently met. Licensed auction owners who are also licensed used motor vehicle dealers and do not sell to the public will realize a reduction in costs by not having to maintain additional business hours.
