NOTICE OF PUBLIC HEARING
Notice is hereby given that the Ohio Board of Building Standards will convene for a public hearing at 10:00 A.M., Friday, February 28, 2014, in Hearing Room #1, at 6606 Tussing Road, Reynoldsburg, Ohio, 43068. The purpose of the hearing is to solicit testimony on proposed actions taken on select rules of the Administrative Code, identified as Amendments Group LXXXVIII (88), pursuant to Chapters 119., 3781., 3791., and 4104. of the Revised Code.
Synopsis of the proposed rule changes:
PART A - OHIO BUILDING CODE RULES
Consider the following amended rules of the Administrative Code: 4101:1-1-01 to clarify the exemption for amusement park rides, to clarify that the installing contractor of fire protection systems is to be certified by the State Fire Marshal, to replace product approval language, and to make general editorial corrections; 4101:1-2-01 to amend or add definitions of "Amusement Park Ride", "Approved Agency", "Custodial Care", "Dwelling", "Dwelling Unit", "Special Inspection Agency", and "Special Inspector"; 4101:1-3-01 to clarify applicability of RCO application to Group R-1 and R-2, to amend or add definitions of "Dwelling", "Dwelling Unit", and "Custodial Care", and to make general editorial corrections; 4101:1-10-01 to modify the means of egress width requirements in response to Petition #12-01 and to modify the controlled egress lock provisions for Group I-2 in response to Petition #13-01; 4101:1-11-01 to further update provisions of the chapter consistent with the federal accessibility guidelines; 4101:1-13-01 to modify the 2009 IECC related to fireplace doors, air barriers, and swimming pool accessories; and 4101:1-17-01 to revise and move definition of "Approved Agency", to add definition of "Special Inspection Agency", to add definition of "Special Inspector", to delete Section 1703 and refer to Section 114.3, to clarify Section 1704.1, and to clarify fabricator requirements consistent with new Section 114 and Section 1702.1 definitions.
PART B - OHIO PLUMBING CODE RULES
Consider the following amended rules of the Administrative Code: 4101:3-2-01 to change the definition of "Approved Agency" to be consistent with the OBC and to delete the definition of "Lead- Free Pipe and Fittings"; 4101:3-3-01 to insert the exemptions found in the Residential Code of Ohio plumbing chapter; 4101:3-4-01 to insert the exemptions found in the Residential Code of Ohio plumbing chapter; 4101:3-6-01 to make the rule consistent with the federal Safe Water Drinking Act law change relating to lead content of plumbing components; 4101:3-10-01 to allow the use of barrier- type trap seal protection devices in response to Petition #13-03 and to insert the exemption for trap seal primers found in the Residential Code of Ohio plumbing chapter; and 4101:3-13-01 to add standard NSF 372 which is the new standard used to evaluate the weighted average of lead.
PART C - RESIDENTIAL CODE OF OHIO RULES
Consider the following amended rules of the Administrative Code: 4101:8-1-01 to clarify that model homes are within the scope of the RCO, to clarify that 2- and 3-family dwellings that share an exit are within the scope of the OBC, to reference Chapter 29 for non-required fire protection systems, to replace entire section 103 with a reference to 4101:7, to clarify that the installing contractor of fire protection systems is to be certified by the State Fire Marshal, to mirror proposed OBC Section 114 product approval process language, to mirror OBC Board Organization Section 116, and to make general editorial corrections; 4101:8-2-01 to revise definitions of "Approved Agency", "Dwelling", "Dwelling, One-, Two- or Three-family", "Dwelling Unit", "Exit", "Fire Separation Distance", and to

add definition of "Residential Building"; 4101:8-3-01 to reorganize Section 314 and add language to allow wireless smoke alarms in certain existing conditions, to clarify intent of carbon monoxide alarm requirements, to add beam and header to diagonal cross bracing/girt attachment in Table 324.7, to clarify that roof truss designs must account for all imposed loads required by Section 324.8, and to make general editorial corrections; 4101:8-4-01 to make general editorial corrections; 4101:8-5-01 to make general editorial corrections; 4101:8-6-01 to add the new simplified bracing section from the 2012 IRC and to make general editorial corrections; 4101:8-11-01 to modify the 2009 IECC to make technical corrections for fireplaces and air barrier requirements consistent with the 2015 IECC language, to delete references to swimming pool accessories, and to make general editorial corrections; 4101:8-15-01 to make general editorial corrections and to clarify the make-up air requirements for kitchen hood systems; 4101:8-20-01 to delete the requirements relating to swimming pool heaters because the code does not currently regulate pools; and 4101:8-44-01 to update the reference to the Ohio Plumbing Code to include March 1, 2013 updates, to update a few of the ASME standards, to delete the TIA to NFPA 70 because pools and spas are not currently within the scope of the RCO, and to make general editorial corrections.
PART D - CERTIFICATION RULES
Consider the following amended, rescinded, and new rules of the Administrative Code: 4101:7-1-01 to add a reference to new certification rule 4101:7-6-01; 4101:7-3-01 (rescind and adopt new) to revise building department personnel certification requirements and remove the certification requirements for residential building department personnel from the Residential Code of Ohio Section 103 and incorporate them into one administrative certification rule; and 4101:7-6-01 to clarify and codify the process for obtaining board recognition as an accreditation body, conformity assessment body, and industry trade association certification program.

The full text of the proposed rules were filed electronically with the Legislative Service Commission, the Joint Committee on Agency Rule Review, and the Secretary of State as required in section 119.03 of the Revised Code. Prior to electronic filing of the rules, stakeholder meetings were held and electronic notification was provided to all stakeholders. The proposed rules and a Business Impact Analysis were posted and submitted to the Common Sense Initiative Office. Additionally, the Clerks of the 88 County Commissioners were notified of the filings as required by statute.
