    NOTICE OF PUBLIC HEARING

     

     

    Pursuant to Chapter 119. of the Revised Code and 42 CFR 447.205, the Ohio Department of Mental Retardation and Developmental Disabilities (ODMRDD) hereby gives notice of its intent to amend an existing rule and promulgate a new rule under Chapter 5123:2-9 of the Administrative Code and to promulgate a new rule under Chapter 5123:2-13 of the Administrative Code on a permanent basis on or about March 19, 2008, and to conduct a public hearing thereon.

     

    Rule 5123:2-9-06 entitled "HCBS Waivers - Waiver Reimbursement Methodology" is proposed for amendment. The purpose of the rule is to establish standards governing payment for Home and Community-Based Services (HCBS), other than Day Habilitation and transportation to access Day Habilitation services, provided to individuals enrolled on HCBS waivers administered by ODMRDD and to implement sections 5111.871 and 5111.873 of the Revised Code. The State of Ohio has asked the federal Centers for Medicare and Medicaid Services ("CMS") for an extension for completing activities necessary to transition from individually negotiated rates to a statewide payment system. Amendments to the rule are necessary to extend the transition timelines accordingly.

     

    Rule 5123:2-9-20 entitled "HCBS Waivers - Adult Day Support Services Provided Through Contract with ODA-Certified Providers" is a new rule proposed for adoption. The purpose of the rule is to specify the conditions under which agency providers and county boards of mental retardation and developmental disabilities certified by ODMRDD to provide Adult Day Support, as defined in rule 5123:2-9-17 of the Administrative Code, may contract with and reimburse providers certified by the Ohio Department of Aging (ODA) to provide Adult Day Support services to individuals enrolled on HCBS waivers administered by ODMRDD.

     

    Rule 5123:2-13-07 entitled "Individual Options Waiver - Homemaker/ Personal Care Daily Billing Unit for Congregate Settings Where Individuals Share Services" is a new rule proposed for adoption. The purpose of the rule is to establish a reimbursement process for Homemaker/Personal Care when individuals share the services of the same provider in the same setting as part of the HCBS Individual Options waiver. The rule provides a process for those individuals/settings that qualify, which shall be used instead of the billing requirements outlined in rule 5123:2-9-06 of the Administrative Code.

     

    A public hearing on the proposed rules will be held on February 4, 2008, beginning at 10:00 a.m., and continuing until all persons in attendance have had

    an opportunity to testify. The hearing will be held in the large conference room of the ODMRDD Administrative Offices Building located at 1810 Sullivant Avenue, Columbus, Ohio 43223-1239. At this hearing, the Department will accept verbal and/or written testimony on the proposed rules under consideration.

    Persons unable to attend the public hearing may submit written comments on the proposed rules. Any written comments received on or before the public hearing date will be treated as testimony and made available for public review.
