4501-52-01 Requirements for annual inspection of buses; incorporated materials.

    NOTIFICATION OF PUBLIC HEARING

    to amend, rescind, and adopt rules to Chapter 4501-52 of the Ohio Administrative Code in accordance with Chapter 119. of the Ohio Revised Code

     

    Notice is hereby given that the Ohio Department of Public Safety, division of State Highway Patrol, will conduct a public hearing pursuant to R.C. 119.03, on Thursday, February 3, 2011, at 10:00 a.m. to consider the proposal to amend, rescind, and adopt rules to Chapter 4501-52, entitled "Bus Inspection," of the Ohio Administrative Code. The hearing will be held at the Ohio Department of Public Safety, 1970 West Broad Street, Room 109, Columbus, Ohio.

     

    Based on a scheduled Revised Code Section 119.032 five-year rule review, and as authorized by Section 4513.52, of the Revised Code, the State Highway Patrol has proposed to:

     

    1)  Amend Rules 4501-52-02, Annual bus safety inspection program, and 4501-52-06, Other inspections. Proposed changes update terminology and information regarding availability of materials incorporated by reference;

     

    2)  Rescind Rule 4501:1-1-04, Insurance. This rule is proposed for rescission as its text has been added to Rule 4501-52-03 of the Administrative Code; and

     

    3)  Rescind, and adopt as New under the same rule number, Rule 4501-52-01, Requirements for annual inspection of buses and incorporated materials, and 4501-52-03, Annual inspection criteria. These rules are proposed for rescission and adoption as changes to the rules affect approximately 50% of the language. New Rule 4501-52-01 reflects changes in revision dates of referenced material; language, referring to information regarding availability of materials incorporated by reference has been revised; and readability has been enhanced. New Rule 4501-52-03 includes revisions to the brake data tables; adds inspection criteria regarding brake pads and brake linings for air drum brakes, air disc brakes, hydraulic brakes, and electric brakes; and language referring to evidence of liability insurance coverage, formerly found under 4501-52-04 of the Administrative Code, has been incorporated.

     

    Any persons affected by the proposed amendment, rescission, and/or adoption of these rules may appear at the hearing and be heard in person, or by an attorney, or both, or may present their position, argument, or contention in writing. Persons may offer and examine witnesses and present evidence to show that the proposed amendment, rescission, and/or adoption will be unreasonable or unlawful.
