NOTICE OF PUBLIC HEARING

 

 

Pursuant to section 119.03 of the Ohio Revised Code, the Ohio Department of Mental Health (ODMH) hereby gives notice of its intent to consider the adoption, amendment, or rescission of the Ohio Administrative Code rule or rules as identified below and of a public hearing thereon.

 

 

Certification of Community Mental Health Agencies

 

5122-26-03         Governing Body and Governance (Amend)

This rule is being amended, including the title of the rule. The rule identifies the governance responsibilities of agencies. In addition, current rule 5122-26-05 is being rescinded, and the requirement for a table of organization are now included in this rule.

 

                Table of Organization (Rescind)

This rule is being rescinded, and replaced by amended rule 5122-26-03.

 

                Personnel Management (Rescind)

This rule is being rescinded and replaced with a new rule due to amending over 50% of the current rule.

 

                Human Resources Management (New)

The rule requires an agency to have a human resources management system; defines who is considered "personnel", describes policy and procedure and staff orientation requirements, contents of personnel files, and requires a policy on handling of staff abuse and neglect allegations. In addition, current rule 5122-26-07 is being rescinded, and the requirement for personnel qualifications are now included in this rule.

 

                Personnel Qualifications (Rescind)

This rule is being rescinded, and replaced by new rule 5122-26-06.

 

5122-26-09         Agency Service Plan (Rescind)

This rule is being rescinded and replaced with a new rule due to amending over 50% of the current rule.

 

5122-26-09         Agency Service Plan (New)

This rule lists the content description of an agency service plan, and that an agency is required to review and update when changes occur.

5122-26-12        Physical Plant and Safety (Rescind)

This rule is being rescinded and replaced with a new rule due to amending over 50% of the current rule.

5122-26-12        Environment of Care and Safety (New)

This rule updates the emergency event policy and procedure requirements, staff origination standards, and agency self-inspection requirements, and reduces the frequency of required fire drills. In addition, current rule 5122-26-14 is being rescinded, and the requirements for infection control are now included in this rule

                Infection Control (Rescind)

This rule is being rescinded, and replaced by new rule 5122-26-12.

                Medication Control (Amend)

The rule updates, in accordance with state law, who is allowed to personally furnish samples of medications.

A public hearing on the proposed rules will be held on Monday, February 7, 2011, beginning at 10:30 am, continuing until all persons in attendance have had an opportunity to testify. The hearing will be held in Room 806 of the Rhodes State Office Tower located at 30 East Broad Street, Columbus, Ohio 43215, 8th FL. At this hearing, ODMH will accept verbal and/or written testimony on the proposed rules under consideration.

Persons may also submit written testimony via mail/e-mail. Any written comments received or postmarked on or before the public hearing date will be treated as testimony.
