    NOTICE OF PUBLIC HEARINGS

    In accordance with Chapter 119 of the Revised Code (R.C.), the Public Health Council (PHC) will conduct four public hearings beginning at 10:00 a.m. on Thursday, February 5, 2009, in the 8th Floor Large Conference Room of the Ohio Department of Health (ODH), 246 N. High Street, Columbus, Ohio. The hearings concern the following rules and actions:

     

    HEARING #1: By authority of R.C. 3748.04, the PHC proposes to amend Ohio Administrative Code (O.A.C.) rules 3701:1-38-01, -10, -12, and -21. These rules pertain to general radiation protection standards for sources of radiation, and they are proposed for amendment to keep them current with federal regulations. Among other changes, the proposed amendments provide a new definition of "total effective dose equivalent" and new requirements for reporting dose to occupational radiation workers.

     

    HEARING #2: By authority of R.C. 3748.02 and 3748.04, the PHC proposes to amend

    O.A.C. rules 3701:1-40-08, -09, and -11; and to rescind rule 3701:1-40-10. These rules pertain to radiation protection requirements. These actions are proposed because the

    U.S. Nuclear Regulatory Commission (NRC) was granted new jurisdiction over naturally- occurring or accelerator-produced radioactive material. This new federal jurisdiction requires Ohio to amend or rescind rules dealing with exempt radioactive material. The NRC retains sole regulatory authority over the distribution of exempt radioactive material.

     

    HEARING #3: By authority of R.C. 3748.04, the PHC proposes to amend O.A.C. rules 3701:1-46-05, -15, and -30; and to rescind rules 3701:1-46-13, -14 and -16 to -29. These rules pertain to licenses for manufacturing and distribution of radioactive material for certain laboratory and medical uses. Changes are proposed due to the new NRC jurisdiction over naturally-occurring or accelerator-produced radioactive material.

     

    HEARING #4: By authority of R.C. 3748.04, the PHC proposes to amend O.A.C. rules 3701:1-66-06 and -11; and to rescind current and file new rules 3701:1-66-07, -08, - 10, and -12. These rules pertain to dental, fluoroscopic, mammography, computed tomography, bone densitometry radiation-generating equipment, and industrial radiography and irradiation devices utilizing radiation-generating equipment. These rules have been reviewed pursuant to R.C. 119.032 (five-year review). Among the changes are a reorganization and clarification of requirements in rule 3701:1-66-07 relating to tests required for dose, image quality and spot films, and allowing a designee to perform air kerma tests following maintenance for the radiation expert.

     

    At the rules hearings, people affected by the proposed actions may appear and be heard in person, by their attorney or both; may present their positions, arguments, or contentions orally or in writing; may offer witnesses; and may present evidence tending to show that the proposed rules, if adopted or effectuated, will be unreasonable or unlawful.
