NOTICE OF PUBLIC RULES HEARING

In accordance with Chapter 119 of the Revised Code (R.C.), the Director (Director) of the Ohio Department of Health (ODH), or his designee, shall conduct a public rules hearing at the date, time, and place listed above to consider proposed changes to the following rules:

 

O.A.C. Chapter 3701-21 - FOOD SERVICE OPERATIONS

 

By authority of R.C. Chapters 3717.04 and 3717.51 and in fulfillment of five-year review requirements, the Director proposes to amend the following O.A.C. rules:

3701-21-02.4 -            Food service operation inspection frequency 3701-21-25 -  Certification in food protection

 

ODH is making only minor edits to the first three rules, consisting of the addition or substitution of a few words and the clarification of citations. More significant amendments include the addition of "cut leafy greens" in rule 3701-21-01 to the list of time/temperature controlled for safety (TCS) food; and in rule 3701-21-25, amending requirements for examinations to match federal requirements.

 

Previously announced rules also on the agenda:

 

ODH has previously announced that two other sets of rules will be on the February 12, 2015 agenda. Those rules pertain to Poison Control: Maintenance and reporting of data; and Hospital Registration and Reporting Requirements.

 

Hearing and Comment Procedure:

 

At the hearing, people affected by the proposed actions may appear and be heard in person, by an attorney or both;  may present their positions, arguments, or contentions orally or in writing; may offer witnesses; and may present evidence tending to show that the proposed rules, if adopted or effectuated, will be unreasonable or unlawful. To aid in getting visitors through building security, both persons intending to testify at the hearing and those simply intending to observe are encouraged to pre-register by writing to the
