    Pursuant to section 119.03 of the Ohio Revised Code, the Superintendent of Insurance, State of Ohio, will hold a public hearing at 10:00 a.m., on Monday, November 1, 2010 at the Ohio Department of Insurance, Public Hearing Room, 50 West Town Street, 3rd Floor, Suite 300, Columbus, Ohio, to consider the amendment of Ohio Administrative Code sections 3901-5-01 Licensees; 3901-5-02 Provider approval; 3901-5-03 Continuing education course approval; 3901-5-04 Market practices/audits; 3901-5-05 Violations; 3901-5-06 Fees; 3901-5-07 Regulation of agent pre-licensing education; and 3901-5-09 Agent licensing and appointments.

     

    The purpose of rule 3901-5-01 is to establish continuing education requirements, standards and procedures for insurance agents. The purpose for amending this rule is to implement the increase in agent continuing education hours required by HB300.

     

    The purpose of rule 3901-5-02 is to establish the procedure employed by the Ohio Department of Insurance in reviewing the applications of entities described in divisions (C)(1) to (C)(5) of section 3905.484 of the Revised Code to be providers of insurance continuing education courses. The purpose for amending this rule is to clarify the application and renewal procedures for providers of continuing education courses.

     

    The purpose of rule 3901-5-03 is to establish a procedure for the review and approval of continuing education courses which licensed agents must complete for the purpose of maintaining their licenses. The purpose for amending this rule is to identify approved methods of continuing education course instruction, provide course application procedures, and clarify requirements for professional association membership continuing education credits.

     

    The purpose of rule 3901-5-04 is to establish criteria, standards and procedures for providers of continuing education programs. The purpose for amending this rule is to clarify provider notification of course changes and/or cancellation to agents and course roster filing requirements to the Department of Insurance.

     

     

     

     

     

    The purpose of rule 3901-5-05 is to identify conduct related to continuing education that violates Ohio statutes or rules and may subject a continuing education provider or agent to administrative action. The purpose for amending this rule is to identify additional conduct which may result in administrative action.

    The purpose of rule 3901-5-06 is to establish the fees to be charged for certain services and transactions for the pre-licensing and the continuing education programs. The purpose for amending this rule is to clarify pre-licensing and continuing education service and transaction fees and procedures.

    The purpose of rule 3901-5-07 is to establish the criteria for agent pre-licensing education and to establish certain examination requirements. The purpose for amending this rule is to clarify qualifications and procedures for pre-license education exemptions and to set out the procedures for application as a pre-license education provider and/or instructor.

    The purpose of rule 3901-5-09 is to set forth procedures and requirements for the licensing and appointment of insurance agents in this state; and to identify lines of authority eligible for limited lines licenses. The purpose for amending this rule is to implement the license application and renewal requirements of HB300.
