PUBLIC HEARING NOTICE
The Ohio Department of Rehabilitation and Correction (ODRC) will conduct a public hearing to receive comments concerning ODRC's proposed changes to the following administrative rules as required by section 119.03 of the Revised Code:
5120:1-3-01 Contracting and payment reimbursement for offenders placed in halfway houses.
ODRC is proposing to amend the rule by specifying that compensation paid to members of a licensed facility's governing board is not an allowable cost under a contract between the facility and the Division of Parole and Community Services. ODRC is also proposing to amend the rule by requiring facilities that wish to obtain state financial assistance to establish, maintain, and operate a licensed facility to submit contract negotiation materials that include proposed budget expenditures for the total cost of operating the facility for one year. In addition, ODRC is proposing to amend the rule by modifying procedures for disposing of offenders' property when they abscond from licensed facilities; authorizing licensed facilities to hold a bed for an offender hospitalized for five days or less if notified that the offender will return to the facility; removing references to furloughed offenders; removing provisions governing verification of mandays; and removing provisions governing expanded operations of a licensed facility.
5120:1-3-02 Licensing requirements for a halfway house or community residential center as a licensed facility.
ODRC is proposing to amend the rule by clarifying that the administrative appeal currently available for adverse decisions related to licensure may not be taken for the purpose of challenging a decision by the Division of Parole and Community Services to terminate a contract with a facility pursuant to the contract's terms or be taken for any other purpose other than reviewing an adverse decision on licensure.
5120:1-3-03 Inspection process.
ODRC is proposing to amend the rule by replacing the requirement that currently licensed facilities be notified of upcoming inspections between thirty and sixty days prior to expiration of the facility's license with a requirement that notification occur no less than thirty days prior to expiration of the license. ODRC is also proposing to amend the rule by removing existing provisions specifying the method by which notification must occur and its contents.
5120:1-3-04 Evaluation of licensed halfway house or community residential centers.
ODRC is proposing to amend the rule by requiring that licensed facilities submit to the Division of Parole and Community Services their organization's goals, objectives, and measurement criteria with their contract negotiation materials. ODRC is also proposing to amend the rule by removing the existing requirement that licensed facilities submit statistical intake and termination forms for each offender entering and leaving the facility.
5120:1-3-05 Glossary of terms.
ODRC is proposing replacing the existing glossary of terms currently codified in this rule with a revised glossary.
5120:1-3-06 Administration
ODRC is proposing replacing this rule with one that consolidates general standards for licensing halfway houses and other facilities. The new rule will also identify specific standards applicable to halfway houses.
5120:1-3-07 Fiscal management
ODRC is proposing replacing this rule with one that specifies independent housing licensing standards.
5120:1-3-08 Personnel
ODRC is proposing rescission of this rule specifying personnel standards that halfway houses and other facilities have to satisfy in order to be licensed by ODRC.
5120:1-3-09 Facility
ODRC is proposing rescission of this rule establishing facility standards that halfway houses and other facilities have to satisfy in order to be licensed by ODRC.
5120:1-3-10 Intake
ODRC is proposing rescission of this rule establishing intake standards that halfway houses and other facilities have to satisfy in order to be licensed by ODRC.
5120:1-3-11 Program
ODRC is proposing rescission of this rule establishing program standards that halfway houses and other facilities have to satisfy in order to be licensed by ODRC.
5120:1-3-12 Food service
ODRC is proposing rescission of this rule establishing food service standards that halfway houses and other facilities have to satisfy in order to be licensed by ODRC.
5120:1-3-13 Medical care and health services
ODRC is proposing rescission of this rule establishing medical care standards that halfway houses and other facilities have to satisfy in order to be licensed by ODRC.
5120:1-3-14 Special procedures
ODRC is proposing rescission of this rule establishing incident response standards that halfway houses and other facilities have to satisfy in order to be licensed by ODRC.
5120:1-3-15 Data reporting
ODRC is proposing rescission of this rule establishing data reporting requirements that halfway houses and other facilities have to satisfy in order to be licensed by ODRC.
5120:1-3-17 Records
ODRC is proposing rescission of this rule establishing record requirements that halfway houses and other facilities have to satisfy in order to be licensed by ODRC.
ODRC will conduct the hearing on Thursday November 4, 2010 in the Parole Board Hearing Room at the Department's offices at 770 West Broad Street, Columbus Ohio 43222. The hearing will begin at 10:00 a.m. and will continue until all parties in attendance at that time have had an opportunity to provide comment.
