    The rule is being revised to align the rights for mental health consumers receiving inpatient, residential and community treatment. The rule incorporates recommendations of a committee comprised of ODMH staff and community, residential and inpatient providers, consumer representatives, and other stakeholders.

    then summarize the content of the rule:

    This rule describes that each agency shall have policies on the rights of persons receiving services; grievance procedure; abuse and neglect; and rights of other individuals, including those with human immunodeficiency virus.

    This rule references federal, state, and local laws, and Department of Health guidelines, all of which are generally available to persons via the Internet.

    Title & (H)(3) - Change "procedures" to "procedure"

    (D)(1)(a) and (F)(1)(2)(a) - Change requirement in (D)(1)(a) that agency provide written copy of rights to verbal explanation, including right of client to request written copy, and associated language to reflect this change in (F)(1)(2)(a)

    (D)(8) Change "due process" to "have a grievance reviewed" through a grievance process

    15.  Provide a summary of the estimated cost of compliance with the rule to all directly affected persons. When appropriate, please include the source for your information/estimated costs, e.g. industry, CFR, internal/agency:

    There will be an initial increase in cost of compliance for staff training and printing. The Department of Mental Health is unable to determine an estimate for staff

    training. Agencies will incur an initial expense to train staff on the new client rights and grievance procedure policy. The cost will vary by agency depending in part on the number of staff employed, whether the training can be incorporated into other scheduled training, agency's method of training, e.g. computer based, in person

    in-service, provide copy to staff to review, utilization of free ODMH training, etc. It is estimated that the average training time will be between 1 - 2 hours/staff. There will also be an initial cost to print copies of the new client rights and grievance procedure. These costs will vary by provider, dependent upon whether the agency will do its own printing in-house, number of copies needed to provide clients, whether agency prints on standard 8 1/2 X 11 paper or creates brochures, method of posting a copy in an accessible location (paper, poster, etc.). Based on outside printing costs of brochures, paper and posters, it is estimated the initial printing cost will be between $50 and $1000. After updating its existing stock of policies and procedures, the on-going costs should be the same as under the current rule.
