    Public Notice of Proposed Changes to the Ohio Fire Code and State Fire Marshal Rules

     

    The State Fire Marshal is considering the amendment of rule 1301:7-7-01 to add Section 124, Hazardous material incident reporting at a shale oil processing premises.

     

    In accordance with this intent and pursuant to Section 119.03 and Chapter 3737. of the Revised Code, the Division of State Fire Marshal will conduct a public hearing at 9:00 AM, on Tuesday, November 15, 2016, at the Division of State Fire Marshal, 8895 East Main Street, Reynoldsburg, Ohio 43068. The purpose of the hearing is to receive public comment on the following amended rule of the Ohio Administrative Code (OAC):

     

    OAC 1301:7-7-01 (X) Section 124, Hazardous material incident reporting at a shale oil processing premises.

     

    The SFM proposes to amend this rule to create a reporting / notification protocol for hazardous material incidents at a shale oil processing premises and fire incidents at a shale oil processing premises. The rule mandates  that  a responsible person (or anyone with knowledge, if the responsible person is not available) shall immediately report an incident to the state of Ohio by calling a "One-Call" hotline. The hotline number is provided in the rule. The rule also provides definitions of various relevant terms, including "hazardous material incident at a shale oil processing premises" and "fire incident at a shale oil processing premises," and outlines what information must be provided to the hotline.

     

    The full text of the proposed rule has been filed in electronic format with the Secretary of State, the Legislative Service Commission, the Joint Committee on Agency Rule Review, the Ohio Environmental  Protection Agency, the Ohio Department of Natural Resources, and the Public Utilities Commission of Ohio as required by Sections 119.03 of the Revised Code.
