    PUBLIC HEARING NOTICE OHIO DEPARTMENT OF MEDICAID

    Pursuant to section 5164.02 and Chapter 119.of the Ohio Revised Code, the director of the Ohio Department of Medicaid gives notice of the department's intent to consider the amendment of OAC 5160-1-06.1 Appendix A, 5160-31-05, and 5160-31-07 as identified below and of a public hearing thereon. The Department is proposing these changes in order to strengthen access to waiver services and pay comparable rates for similar services in the nursing facility level of care delivery system.  It is estimated that changes to this rule will have no impact on the annual aggregate Medicaid expenditures at the federal or state level.

     

    OAC 5160-1-06.1, entitled "Home and community-based services waivers: PASSPORT" is being proposed for amendment. The rule sets forth in Appendix A the billing maximums for services furnished through the PASSPORT waiver. The proposed amendment will increase the billing maximum for the PASSPORT personal care service and establish the billing maximum for the PASSPORT shared living service.

     

    OAC 5160-31-05, entitled "PASSPORT HCBS waiver program covered services" is being proposed for amendment. The rule sets forth the services covered by the PASSPORT program. The proposed amendment adds the Shared Living service as a covered service.

     

    OAC 5160-33-07, entitled "PASSPORT HCBS Waiver program rate setting" is being proposed for amendment.  The rule sets forth the methods used to determine provider rates in the PASSPORT program.  The proposed amendment establishes a statewide rate method for both the personal care service and the shared living service.

     

     

    A copy of the proposed rules are available, without charge, to any person affected by the rule at the address listed below and at the county departments of job and family services. The rules are also available on the internet at http://www.registerofohio.state.oh.us/. A public hearing on the proposed rules will be held at the date, time, and location listed at the top of this notice. Both written and oral testimony will be taken at the public hearing. Additionally, written comments submitted or postmarked no later than the date of the public hearing will be treated as testimony.
