  • NOTICE OF PUBLIC HEARING

    The Ohio Board of Nursing (Board), pursuant to Chapter 119, Ohio Revised Code, hereby gives notice that it will conduct a public hearing for the purpose of amending, rescinding, or adopting new or no change rules following the five- year rule review for Ohio Administrative Code Chapters 4723-8, Advanced Practice Nurse Certification and Practice; 4723-9, Prescriptive Authority; and 4723-23, Dialysis Technicians. The Board proposes to amend or adopt new rules for Ohio Administrative Code Chapters 4723-1, Board Organization and Records; 4723-5, Nursing Education Program; 4723-7, Examination and Licensure; 4723-14, Continuing Education; and 4723-16, Hearings to provide updates and technical changes.

    The following is a summary listing of rules that the Nursing Board has proposed to be rescinded, amended or adopted as new rules that are to be considered by the Board at public hearing:

    Rules 4723-1-03 and 4723-1-10; 4723-5-01; 4723-7-09 and 4723-7-10; 4723-14-03; and 4723-16-12 of the Ohio

    Administrative Code.

    Rules 4723-8-01 through 4723-8-10; 4723-9-01 through 4723-9-12; and 4723-23-01 through 4723-23-03 and 4723-23-

    05 through 4723-23-10; and 4723-23-12 through 4723-23-14 of the Ohio Administrative Code.

    Copies of the proposed rules referenced above may be obtained at the Register of Ohio,  http://www.registerofohio.state.oh.us/jsps/publicdisplayrules/searchAgency.jsp, and at the Board's website,   www.nursing.ohio.gov, or by sending a request to the Board office with a check for $3.95 made payable to the "Treasurer, State of Ohio," to cover postage cost.

    The public hearing will be conducted on Thursday November 19, 2015 beginning at 1:00 p.m. in the Board of Nursing board meeting room, located at 17 South High Street, Suite 400, Columbus, OH, 43215-7410 and continue until all parties in attendance have had an opportunity to be heard.

    Any person affected by the proposed action may present oral or written testimony.

    All interested persons will be given the opportunity to be heard at the public hearing. Those persons who wish to provide oral testimony at the hearing are encouraged to inform the Board prior to the hearing date and may be given preference in the order of testimony.

    Written comments received by the Board before the close of the hearing record will be considered. Written comments in lieu of oral testimony may be submitted by:
