    PUBLIC HEARING NOTICE OHIO DEPARTMENT OF MEDICAID

    Pursuant to section 5164.02 and Chapter 119. of the Ohio Revised Code, and 42 CFR 447.205 the director of the Ohio Department of Medicaid gives notice of the Department's intent to consider the rescission of the rules identified below and to hold a public hearing on these rules.

     

    Rule 5160-21-02.3, "Limited family planning benefit," defines limited family planning services and family planning-related services, and it sets forth the scope of the package of the limited subset of family planning services and family planning-related services that are covered for individuals who meet the limited eligibility criteria specified in rule 5160:1-5-40 of the Ohio Administrative Code.  A list of these services is included as an appendix to the rule. The rule and its appendix are being proposed for rescission.

     

    Rule 5160-9-14, "Pharmacy services: Limited family planning benefit," defines limited family planning pharmacy services and family planning-related pharmacy services, and it sets forth the scope of the package of the limited subset of family planning services and family planning- related pharmacy services that are covered for individuals who meet the limited eligibility criteria specified in rule 5160:1-5-40 of the Ohio Administrative Code. A list of these services is included as an appendix to the rule. The rule and its appendix are being proposed for rescission.

     

    These rules are being rescinded to implement amendments to R.C. 5163.06, relating to the administration of the Medicaid program and eliminating the limited family planning benefit. It is estimated that these changes will decrease expenditures by $512,000 on an annual aggregate basis.

     

    The public hearing will be held at the date, time, and location listed at the top of this notice. Both written and oral testimony will be accepted at the public hearing, and written comments submitted or postmarked no later than the date of the public hearing will be treated as testimony.
